REGULAR MEETING
DECEMBER 11, 1989
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, December 11, 1989, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Absent;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2, Presiding;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct A;
Frank Boriskie, County Clerk.
The following citizens and officials were in attendance:

Rebecca Caddel Texas Agr. Extension Agent
Commissioner Sims gate the invocation and led the pledge of
allegiance.
The Court recognized Irene A. Keating, District Extension
Agent, who introduced Rebecca Caddel as the new Agricultural
Extension Agent in Home Economics for Brazos County. Ms. Caddel
will begin work January 2, 1990. The Court welcomed Ms. Caddel
to the county.
The Court next heard a request from Jim Mazurkiewicz, County
Extension Agent, requesting approval for out of state travel for
himself. Mr. Mazurkiewicz would be traveling to Denver, Colorado
to accompany producers to the National Western Livestock Show in
Denver January 13 through 18, 1990. On motion by Commissioner
Sims, seconded by Commissioner Turner, the Court voted
unanimously to grant the request from the County Extension Agent

and approved payment of out of state travel expenses for Mr.
Mazurkiewicz.
The Court next considered Budget Amendment #17, which would
reallocate funds budgeted for the Court Master Fund, increase the
FM & Lateral Road Fund budget by $5,100.00, and reallocate funds
in the Oil & Gas fund. It will increase the budget of the
District Attorney by $10,000.00, increase the budget of the
Environmental Protection Department by $12,000.00, increase the
budget of the Sheriff's Department by $52,000.00 and increase the
budget of the Building and Yards Department by $20,000.00. This
will increase the General Fund Budget by $94,000.00. On motion
by Commissioner Turner, seconded by Commissioner Sims, the Court
voted unanimously to approve the budget amendment as submitted, a
copy of which is attached hereto. Consideration of Budget
Amendment #18 was postponed until later.
The Court next considered the transfer of a vehicle from the
Sheriff's Department to Precinct 7 Constable's Department and the
repair and painting of the vehicle. The painting will cost
$650.00. On motion by Commissioner Turner, seconded by
Commissioner Wilcox, the Court voted unanimously to transfer the
vehicle from the Sheriff's Department to Precinct 7 Constable's
Department and pay for the repair and painting of the vehicle.
The Court acknowledged receipt of the Extension Service
reports for November 1989 and acknowledged receipt of reports
from County and Precinct Offices showing revenues collected and
remitted to the County Treasurer. An excerpt from those reports
is attached hereto.
The Court proceeded to consider the change of status of the
following employees.

On motion by Commissioner Norton, seconded by Commissioner
Sims, the Court voted unanimously to approve the Claims as
submitted.
At 10:14 a.m. the Commissioner Wilcox announced the meeting
.closed to the public so that the Court could meet in closed
executive session to discuss personnel.
At 11:20 a.m. Commissioner Wilcox announced the meeting open
to the public. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to consider the
request of the District Attorney for a six month step increase
for an assistant District Attorney in six months. On motion by
Commissioner Sims, seconded by Commissioner Wilcox, the Court
I voted unanimously to approve the request to hire Willie Pearson
at a pay group 8 step 2 as bailiff for the 272nd District Court
with no six month probationary step increase. On motion by
Commissioner Turner, seconded by Commissioner Wilcox, the Court
voted unanimously to approve the request of Judge Delaney to pay
Allie Lewis $8.5894 per hour as part time bailiff as long as the
budgeted funds for part time help last. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to deny the request of County Attorney to
rehire an employee at a pay group 6 step 3 level. instead the
employee is to be hired at a pay group 6 step 2 level with no six
month step increase. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to approve

could not be reasonably included in the original budget adopted
September 29, 1986, the following amendment(s) to the original

Rte: Budget ammendment
Dear Judge Holmgreen & Commissioners:
Line item 10-22-5512 (court costs) was created to pay
expenses dealing with felony cases and processing them through
the criminal justice system. Historically, it has been the
Commissioner's Court's position to charge capital murder costs as
they were incurred instead of budgeting monies ahead of time in
budget proposals. Unfortunately, what was once the exception has
now become the ordinary. Transcript costs to date this year for
capital cases are as follows:
State vs Terry Washington - $ 4.599.00
State vs James Otto Earhart - 6,904.55
State vs Kevin Ford/Leon Washington - 306.25
State vs Marlin Webb - 2,433.75
TOTAL $14,243.55
The top three cases are still in the appellant process. The case
against Marlin Webb has yet to go to trial, along with two other
capital cases pending on the docket for next year.
Therefore, due to the heavy load of capital case expenses
this year, I am requesting a budget ammendment of $10,000 for
Line item 10-22-5512.
