SPECIAL MEETING
DECEMBER 4, 1989
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, December 4, 1989, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge of
} allegiance.

The County Judge recognized Ernie Wentrcek, Director of
Juvenile Services, who introduced Eugene Harris. Mr. Wentrcek
informed the Court that Mr. Harris was named Employee of the Year
for Juvenile Services and that day would be named Line Staff
Worker of the Year by the Texas Corrections Association South
East Region. The members of the Court congratulated Mr. Harris
on his awards.
The County Judge read aloud a Proclamation proclaiming the
week of December 10 through 16, 1989 as 'Drunk and Drugged
Driving Awareness Week. The Court urge's all in the County to
observe the week in a manner appropriate to its importance to the
safety and health of the citizens. On motion by Commissioner
Turner, seconded by Commissioner Sims the Court voted to proclaim

the week of December 10 through 16, 1989 as 'Drunk and Drugged
Driving Awareness Week* throughout Brazos County. The Court next
considered approval of the minutes of the Commissioners' Court
meetings held November 13, 1989. On motion by Commissioner
Turner, seconded by Commissioner Wilcox, the Court voted
unanimously to approve the minutes as submitted.
The Court next considered Budget Amendment #16, which would
increase the budget of the office of the Justice of the Peace
Precinct 4 Place 2 by $15,000.00. This was necessary due to the
increase in the number of autopsies. On motion by Commissioner
Sims, seconded by Commissioner Wilcox, the Court voted
unanimously to approve the budget amendment as submitted, a copy
of which is attached hereto.
The Court next considered the following proposed salary
structure for the office of the District Attorney.

Commissioner Sims stated that he thought it was a very innovative
way to compensate and retain quality prosecutors in that office.
He continued saying that in return for the implementation of the
salary structure, the District Attorney will turn over to the

Commissioners' Court meeting December 4, 1989
General Fund approximately $16,000.00 in discretionary funds
provided by the state. On motion by Commissioner Sims, seconded
by Commissioner Norton, the Court voted unanimously to accept the
salary structure as submitted.
The Court next considered a request from the County Attorney
for vehicles no longer used by the Sheriff's Department to
replace two (2) 1985 model cars for one (1) 1987 car and one (1)
1988 car. The County Attorney enumerated several problems with
the current vehicles. On motion by Commissioner Sims, seconded
by Commissioner Norton, the Court voted unanimously to authorize
the replacement of the two (2) 1985 with the two (2) cars being
turned in from the Sheriff's Department.
The County Attorney continued by informing the Court of the
status of the 'Work Release Program" being administrated in
conjunction with Judge Langley. To date there have been fifteen
completions, six pending cases and it has generated $11,159.50 in
revenue for the General Fund. The members of the Court
congratulated the County Attorney on an excellent program.
On motion by Commissioner Wilcox, seconded by Commissioner
Sims, the Court voted unanimously to reappoint Dr. Wesley Summers
to the Board of Managers of the Brazos County Emergency
Communications District.
The next matter for consideration was the hiring of an
outside auditor for Brazos County. The firm of Durst, Wood and
Millberger have audited the records for the past three years. On
motion by Commissioner Dorton, seconded by Commissioner Sims, the
Court voted unanimously to approach the firm of Durst Wood and
Millberger for a proposal which will be brought back before the
Court for consideration.
On motion by the County Judge, seconded by Commissioner
Norton, the Court voted unanimously to execute a letter of credit
for the County group health insurance in the amount of
$200,000,00,
The Court next considered designating a day of the week on

each month during the next fiscal year. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to designate the second Monday of the month as
the regular term of Court.
On motion by Commissioner Turner, seconded by Commissioner
Norton, the Court voted unanimously to approve an ordinance
providing for the taxation of property exempt under article VIII,
Section 1-j, Texas Constitution beginning with the 1990 tax year.
A full copy of the ordinance is attached hereto.
The Court next considered setting speed limits and
regulatory signs as discussed in the Public Hearing of November
27, 1989 on Cole Lane, Graham Road and in the Fox Fire
Subdivision. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to approve the
action taken at the Public Hearing to enforce all existing 'and
newly established traffic control devices or signs and set the
following speed limits:
Fox Fire Subdivision, Phase I, II, III and IV - Speed
limit on all roads in the subdivision shall be set at
30 miles per hour.
Graham Road - Between State Highway 6 South and
Schaffer Road the speed limit shall be set at 40 miles
per hour.
Between Schaffer Road and FM 2154 (Wellborn Road) -
Speed limit shall be set at 35 miles per hour.
Cole Lane - Speed limit shall be set at 35 miles per
hour.
The Court next considered the request by Brushy Water Supply
Corporation to install a water line within the right-of-way of
. Silver Hill Road in Precinct 4. On motion by Commissioner
Turner, seconded by Commissioner Norton, the Court voted
unanimously to approve the request of Brushy Water Supply
Corporation and authorized the installation. A copy of the
request is attached hereto.
The Court next considered authorizing work outside of county
rights-of-ways for the enhancement of county road projects. The
Road and Bridge Department requests permission to dump stumps and
debris from Matt Wright Road on to the George Sims property. On

Court voted unanimously to authorize the work.
The ^ourt next considered a request from Nu-Tech Pipeline,
Inc. for a temporary ninety (90) day permit to effect a crossing
under Rabbit Lane in Precinct 4. This is necessary to enable Nu-
Tech to connect its pipeline to the bright Sky Ranch which lies
east of Rabbit Lane to Nu-Tech's TGL system west of Rabbit Lane.
On motion by Commissioner Wilcox, seconded by Commissioner
Turner, the Court voted unanimously to authorize the temporary
permit to effect-& crossing under Rabbit Lane in Precinct 4.
The Court proceeded to consider the change of status of the
following employees.

On motion by the County Judge, seconded by Commissioner
Sims, the Court voted unanimously to approve the Claims as
submitted.
At 10:37 a.m. the County Judge announced the meeting closed
to the public so that the Court could meet in closed executive
session to discuss personnel.
At 10:55 a.m. the County Judge announced the meeting open to
the public. on motion by Commissioner Sims, seconded by

Commissioners' Court meeting December 4, 1989
Commissioner Wilcox, the Court voted unanimously to appoint
Jennifer Gose to the Brazos County Historical Commission. On
motion by Commissioner Wilcox,-seconded by Commissioner Sims, the
Court voted unanimously to deny the request of the District
Judges and County Court at Law Judges to increase the salary of
the Jury Services Coordinator Ginger Lanehart from a pay group 8
step 3 to a pay group 8 step 6.
There being no further business to come before the Court,
the meeting was adjourned.

public necessity to meet unusual and unforeseen conditions which
could not be reasonably included in the original budget adopted
September 29, 1988, the following amendment(s) to the original

AN ORDINANCE PROVIDING FOR THE TAXATION OF PROPERTY EXEMPT
UNDER ARTICLE VIII, SECTION 1-j, TEXAS CONSTITUTION BEGINNING
WITH THE 1990 TAX YEAR; AND DECLARING AN EMERGENCY.
WHEREAS, Brazos County, Texas finds that the taxation of
certain goods, wares, ores, and other tangible personal
property that is forwarded out of this state within 175
days of its acquisition or importation into this state is
in the public interest;
NOW THEREFORE, BE IT ORDAINED BY THE COMMISSIONERS COURT
OF BRAZOS COUNTY, TEXAS:
SECTION 1: All of that property described in the Texas
Constitution, Article VIII, Section 1-j, shall be fully
taxable in Brazos County beginning January 1, 1990.
SECTION 2: All ordinances and parts of ordinances in
conflict with this ordinance are hereby repealed to the
extent of the conflict.
SECTION 3: This Ordinance shall take effect immediately
from and after its passage and the publication of the cap-
tion, as the law in such cases provides.

Formal notice is hereby given that Rr„ahy warpr c„pp17 rorp
(Applicant), proposes to place a Wnrpr Line
within the right-of-way of Silvpr Hill RA_ (name of road) in
Brazos County, Texas as follows:
The location or description of the proposed installation is more
fully shown by 7 copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning of
construction in order that he, along with the Commissioner of that
particular precinct, might be on hand to designate the actual location
of the installation.
•
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer and
Commissioner in which the roadway or right-of-way lies.
3. That Brazos County reserves the right to require Applicant to relocate
or lower any such line at no cost to Brazos County,'should same become
necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of-way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (20) below the
center of the roadway.
7. That all sites will be barracaded during the construction period.

Dear Mr. Turner:
Nu-Tech Pipeline, Inc. has filed the above-referenced lawsuit against
Herbert Williams and Jerry Bullin in order to condemn a 40-foot easement to
enable Nu-Tech to connect its pipeline to the Bright Sky Ranch which lies east
of Rabbit Lane to Nu-Tech's TUL system west of Rabbit Lane.
Until this is settled in Judie Langley's court, we need a temporary ninety
(90) clay permit to effect a crossing under Rabbit lane through the property of
Mr. Willimas and Mr. Bullin. We would propose to make that crossing approximately
2.3 miles south of OSR on Rabbit Lane underneath the existing bridge on Rabbit Lars.
We are requesting approval of a temporary low pressure pipeline (maximum pressure
on line 30 psi) between these two systems.
Upon settlement of the above-referenced lawsuit, if same is not in Nu-
Tech's favor, Nu-Tech will make an application for a permnent crossing.
