5. Consider and take action on request from Wixon Water Supply
to install water line in county rights-of-ways of Ranchero
Road in Precinct 3.
6. Consider and take action on work outside of county rights-
of-ways for the enhancement of county road projects.
7. Acknowledge receipt of Treasurers Report.
8. Consider and take action on payment of claims.
9. Executive Session to discuss personnel 6252-17(2)(g) and
litigation 6252-17(2)(e).
10. Consider and take action on Executive Session.
11. Adjourn.

COMMISSIONERS' COURT
SPECIAL MEETING
NOVEMBER 27, 1989
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, November 27, 1989, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Dorton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge of
allegiance.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held November 6, 1989. On motion
by Commissioner Turner, seconded by Commissioner Sims, the Court
voted unanimously to approve the minutes as submitted.
The Court next considered Budget Amendment #15 for budget
year 1989, which would reallocate funds budgeted for the
Personnel Department, the 85th District Court, the Treasurer's
Office and the 272nd District Court. On motion by Commissioner
Wilcox, seconded by Commissioner Norton, the Court voted
unanimously to approve the budget amendment as submitted, a copy
of which is attached hereto.
The Court next considered the request by Wixon Water Supply
to install a water line within the right-of-way of Ranchero Road
/ in Precinct 4. The County Engineer noted that the original

drawing did not indicate the road would be bored. He then
recommended approval of the request with the stipulation that
Wixon Water bore under the road bed to install the water line.
On motion by Commissioner Sims, seconded by Commissioner Norton,
the Court voted unanimously to approve the request of Wixon Water
Supply and authorized the installation with the stipulation that
the road bed be bored. A copy of the request is attached hereto.
On motion by Commissioner Sims, seconded by Commissioner
Turner, the Court voted unanimously to authorize work to be done
'outside the county right-of-way on the Ploy S. Reed property on
Elmo Weedon Road. This will be for the replacement of a cattle
guard at the driveway entrance, change the slope and align the
driveway. This is necessary due to the realignment of Elmo
Weedon Road.

The Court received, approved and ordered filed as submitted
the Treasurer's report for October 1989. A copy of which is
attached to and made a part of these minutes.
The Court next considered the following Claims as submitted
by the County Treasurer for payment:

On line checks - 57298, 57908-57909 and 58103
Commissioner Sims questioned three items, the amount of
coffee and sodas purchase in the District Attorney's and County
Attorney's offices. Bill Turner, District Attorney stated this
was purchased for the Grand Jury only. Commissioner Sims
questioned the purchase of bottled water in the Courthouse and
the amount paid for testimony services.

Sims, the Court voted unanimously to approve the Claims as
submitted.
At 10:20 a.m. the County Judge announced the meeting closed
to the public so that the Court could meet in closed executive
session to discuss personnel.
At 10:36 a.m. the County Judge announced the meeting open to
the public. Commissioner Sims moved to set the entry level
salary of the part time employees of the Juvenile Detention
Department at $4.75 per hour with an increase to $5.25 per hour
after completing six months of employment. The County Judge
seconded the motion. Commissioner Sims and the County Judge
voted 'Aye' Commissioners Wilcox, Turner and Norton voted 'No'.
The motion failed, on motion by Commissioner Wilcox, seconded by
Commissioner Norton, the Court voted unanimously to increase the
entry level salary of the part time employees of the Juvenile
Detention Department to $4.60 per hour with and increase to $5.00
per hour after completing six months of employment.
On motion by Commissioner Sims, seconded by Commissioner
Wilcox and Norton,-the Court voted unanimously to approve the
request of the County Attorney to hire a secretary/clerk at a
group 5 step 2 entry level with no six month step increase.
There being no further business to come before the Court,
the meeting was recessed at 10:40 to await the arrival of Jim
Allison, legal counsel.
At 11:11 a.m. the County Judge reconvened the meeting then
announced the meeting closed to the public. At 12:33 a.m. the
County Judge announced the meeting open to the public and that no
action would be taken on the closed session.
There being no further business to come before the Court,
the meeting was adjourned.

BUDGET AMENDMENT(S) FOR THE 1989 BUDGET YEAR
NO. 15
On this the 4th day of December 1989 at a special meeting of the
Commissioners' Court, the following members were present:
R. J. Holmgreen, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
Walter Wilcox, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Milton Turner, Commissioner, Precinct 4;
Frank Boriskie, County Clerk.
The following proceedings were held:
THAT WHEREAS, on December 4, 1989, the Court heard and
approved a budget amendment for the 1989 budget year for Brazos
County, Texas.
WHEREAS, an emergency expenditure is necessary due to grave
public necessity to meet unusual and unforeseen conditions which
could not be reasonably included in the original budget adopted
September 29, 1988, the following amendment(s) to the original
are hereby authorized, as described on the attached 1 page(s).
ADOPTED AND APPROVED this the 4th day of December 1989

formal notice is hereby given that Wixon Water SuDDIy
(Aplicant), proposes to place a water line
within the right-of-way of Ranchero Road (name of
road) in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully
shown by copies of the drawings attached to this notice.
I understand and agree thatt
1. The County Engineer must be notified 72 hours prior to the beginning of
construction in order that he, along with the Commissioner of that
particular precinct, might be on hand to designate the actual location
of the installation.
2. That all damage to the roadways ■nd rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer and
Commissioner in which the roadway or eight-of-way lies.
3. That Brazos County reserves the right to require Applicant to relocate
or lower any such line at no cost to Brazos County, should some become
necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
night occur to any existing utility lines in the right-of-way.
S. That the line will be constructed and maintained on the county right-
of-way in accordance with governing laws.
6. That the line or lines will be constructed no leas than forty-eight
inches (48") lover than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (2') below the
center of the roadway.
7. That all sites will be barricaded during the construction period.
