A special meeting oof the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthodse in Bryan,, Brazos County, Texas, beginning at 10:00
a.m. on Monday, October 23, 1989, with the following members of
the Court present:

Commissioner Sims gave the invocation and led the pledge of
allegiance.
The Court first considered Budget Amendment #12, which would
reallocate funds budgeted for the Court Master Grant and increase
the budget of Constable Precinct 7, Winfred Pittman by $395.00
for the purchase of a radar unit. On motion by Commissioner
Sims, seconded by Commissioner Turner, the Court voted
unanimously to approve the budget amendment as submitted, a copy
of which is attached hereto.
The Court next considered approval of work outside of the

County right-of-way for the enhancement of County road projects.
The location of the proposed work is Riley Road at the north west
corner of the property owned by K. J. Company. The county will
clean out an outlet channel parallel to the North property line,

Commissioner Sims, seconded by Commissioner Turner, the Court
voted unanimously to authorize the work.
The next matter for consideration was a waiver of the
requirement that the vehicles of the County Attorney's Family
Violence Unit and Prisoner Transport be marked with the County
insignia. On motion by Commissioner Turner, seconded by
Commissioner Sims, the Court voted unanimously to waive the
requirement that vehicles be marked with the County ensign. A
copy of the waiver is attached hereto.
The Court next considered awarding the following bid:

submitted. On motion by the County Judge,
seconded by Commissioner Wilcox, the Court
voted unanimously to accept the recommen-
dation of the Data Processing Manager and
award the contract to Virtual Technology,
Inc.
The Court next considered two bids received for the
landscaping of thV new parking lot on 26th, Washington and 27th

Streets. Commissioner Sims recommended awarding the contract to
Brazos Valley Nursery due to their ability to supply all the

plant materials and give warranties on the Live Oak trees. On
motion by Commissioner Sims, seconded by Commissioner Norton,
the Court voted unanimously to award the contract to Brazos
Valley Nursery. A copy of the bid tabulation is attached hereto.
The next matter before the Court was consideration of two
bads submitted for the Asbestos Abatement Program for the New
Brazos County Health Unit to be located in the old Safeway
Building on Texas Avenue. Commissioner Sims informed the Court
that he had contacted two companies from the Houston area.
Commissioner Norton asked if these were the-only companies doing
this type of work. Commissioner Sims answered no, it was because
of knowledge of them from previous work done in the area and that
no one in Brazos County did this type of work. Commissioner Sims
then moved to accept the proposal from McClelland Management
Services. The motion was seconded by Commissioner Turner and
carried unanimously. A copy of the proposal is attached hereto.
The Court next considered an order relocating voting
Precinct 15 and voting Precinct 4 polling places. Precinct 15,
Fannin School, has been demolished and Precinct 4, Carver School,
can not be made to accommodate handicapped voters. On motion by
the County Judge, seconded by Commissioner Wilcox, the Court
voted unanimously to move voting Precinct 4 polling place to Kemp
School and voting Precinct 15 polling place to the Bryan Civic
Auditorium. A copy of the Order is attached hereto.
It was the consensus of the Court to table consideration of
the appointment of Election Judges for voting Precincts 4 and 30
and the appointment of an alternate Election Judge for voting
Precinct 30.

The Court next considered awarding the contract on the
Minimum Security Facility. Emmett Trant, Architect analyzed the
bids submitted and stated that the low bidder, Chappell Hill
Construction Company of Brenham, was a reliable bidder having
been in the business some thirty years. Mr. Trant informed the
Court that he had asked for credits on several items and that he
would like to visit with the County Engineer in regard to
Alternate •A• which is the dirt work. This would be to
determine if the Alternate bid will be accepted. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to accept the low bid submitted by Chappell
Hill Construction Company. The vote on Alternate •A• will be

INTRODUCTION
This proposal presents the scope of services and fee schedules for providing asbestos consulting services to
Brazos County for the old Safeway store on Texas Avenue in Bryan, Texas. We understand that Brazos
County Is considering renovating the building that encompasses approximately 16,000 square feet.
PURPOSE AND SCOPE OF WORK
The purpose of our proposed consulting service Is to (1) conduct a preliminary asbestos survey of the facility
to determine the presence or absence of ACBM, (2) provide recommendations and/or alternatives for
dealing with the asbestos, (3) develop a complete bid package for appropriate remedial action, and
(4) monitor abatement procedures for compliance to specifications. We propose the following scope of
services to meet these objectives:

3.0 ABATEMENT MONITORING
3.1 Monitor Abatement
3.2 Prepare Abatement Report
Each of time tasks Is described In more detail below.
TASK 1.0 - S(JRVEY AND RECOMMENDATIONS
Task 1.1 - Facility Survey. The Initial task of this project consists of performing an asbestos survey of the
facility. Our asbestos team will visit the building to visually Inspect for suspected ACBM. During the survey
we will:
Review available plans and specifications
Define the extent of suspected ACBM
Observe material conditions
Note material locations with respect to building occupants, potential for disturbance,
and air flow
Take bulk samples
Because of the recognized dangers associated with asbestos, we conduct our surveys In a manner which
reduces the exposure potential for our crew as well as any building occupants. OSHA- and EPA-
recommended safety procedures are followed closely during the building survey process. Safety equipment
may be used depending on the conditions at each sampling site. Safety equipment typically used during the
sampling process Includes a half-face respirator and rubber gloves. Other equipment will be used where
conditions dictate.
Each sampling area will be cleaned and covered with duct tape or other suitable encapsulating material
Immediately after sample recovery. These precautions will reduce the likelihood of any fiber release that may
occur during the sampling process. After recovery, each sample will be-sealed, packaged, and transported to
our laboratory for testing. Chain of custody forms will be initiated at each sampling site.
Further, our personnel may be wearing personal air monitoring devices to indicate their level of exposure
during the survey process. Each device will be calibrated to detect fiber levels as low as 0.01 fibers per cubic
centimeter (0.01 f/cc) of air. '
Task 1.2 - Laboratory Analyses. During the survey, two types of samples may be taken: (1) bulk samples
of suspected ACBM, and (2) air samples. Bulk samples will be analyzed using polarized light microscopy
(PLM) techniques, and air samples will be analyzed using phase contrast microscopy (PCM).
PLM is used to Identify asbestos fibers by their unique shape and optical properties. The EPA PLM method
will be used, and each analysis will be performed by an experienced analyst. Laboratory data will include
percentage of asbestos In sample, type of asbestos, and amounts and types of other fibrous constituents,
and binders.
Air samples will be analyzed following the NIOSH 7400 procedure. Airborne fibers are collected by pulling a
speck volume of air through a mixed cellulose ester filter using a small vacuum pump. A pie-shaped section

of the filter is prepared and analyzed at 40OX magnification under the phase contrast microscope. Phase
contrast Increases the light contrast between the object, I.e., the material on the filter and the background.
This enhances the analyst's ability to see fibers. Phase contrast results are reported as the number of fibers
per cubic centimeter of air, along with the pertinent sampling Information which Includes the volume of air
pulled through the filter.
A rigorous quality assurance and quality control (QA/QC) program is a routine part of every McClelland
Management Services' project.. This program Involves an Independent re-analysis of at least ten percent
(10%) of all bulk samples taken on a project. All analyses are performed by experienced analysts. Our
laboratory Is accredited by NVLAP/NIST for Bulk Analysis of Asbestos and Is a successful participant In the
NIOSH Proficiency Analytical Testing (PAT) Program.
Task 1.3 - Hazard Assessment. Data obtained from the previous tasks will provide the Information
required for a hazard assessment N ACBM are found. In particular, observations from the survey and
laboratory data are all combined to determine the location and relative severity of existing, as well as potential
hazards. The hazards are then prioritized.
Factors considered for developing hazard rankings Include:
Material type and asbestos content
Friability of material
- Material condition and physical state of repair
Exposed surface area
Accessibility
Activity, movement and proximity to disturbance
Use and activities In the adjacent space
Affected and potentially affected occupants
Task 1.4 - Recommendations and Report. The objective of the survey is to determine the extent of
ACBM present and to provide abatement alternatives and recommendations. A comprehensive set of
recommendations will provide the facility management with the information required for informed decision
making. Our abatement recommendations are designed to be cost-effective and safe for abatement workers
as well as building occupants and visitors.
We realize that total elimination of existing and potential hazards is likely cost-prohibhlve and logistically
difficult. Given these constraints, we will develop recommendations that address the following:
Interim Controls -

Operations & Maintenance Plans -
For Law and Intermediate Hazards where passive abatement procedures are appropriate

The results of this study will be summarized In a letter report that will include recommendations along with the
supporting data. The report will present the following In addition to appropriate remedial action
recommendations.

Recommendations and aftematives
TASK 20 - BID PACKAGE DEVELOPMENT
Successful asbestos abatement projects Include well-written, practical specifications and a good, qualified
contractor. These technical specifications will be combined with any Brazos County standard specification
sections to complete the bid package.
Task 2.1 - Review Policies. We understand that Brazos County may have established policies concerning
asbestos-related remedial action activities. The initial step of this assignment will require our staff to become
familiar with existing policies and procedures. By their very nature, asbestos abatement projects expose all of
the Involved parties to potential liability. Consistent application of those policies is a significant risk-reducing
measure.
Once familiar with any existing policies, we will review the standard specification sections that accompany the
bidding documents. In particular, we will review the package for the following topics:
- Type and limits of contractor's Insurance
- Bond requirements
- Liquidated damages
Notification of the proper regulatory offices
• Submittals including worker's release forms, evidence of workers physical, evidence of
worker training, and evidence of respirator fit testing
Disposal
Warning signs and labels
Task 2.2 - Prepare' Technical Specifications. The results of previous building surveys will form the basis
of the technical spQcifications. Data from the survey, including any drawings that are developed, will be
Incorporated Into the contractors scope of work.

In preparing technical specifications, we strive to provide guidance to the contractor for meeting and
exceeding the minimum regulatory requirements. While the specifications are not designed to tell the
contractor how to do his work, they are strict in defining safety requirements and the end results that are
required.
With the asbestos abatement Industry being relatively new, there are many unresolved Issues. Various
regulatory agencies have requirements that affect asbestos-related activities. Legal precedents also may
have an impact. The industry and technology are changing rapidly. Should a significant time period elapse
between development of the bid package for this building and actual performance of the work, the package
should be reviewed and modified, if necessary, to meet current requirements. Considering the rate at which
changes have occurred in recent years, we recommend that the specifications package be reviewed relative
to asbestos-related 'current events' on an annual basis.
Task 2.3 - Assist In Contractor Selection. We believe that careful selection of the abatement contractor
Is a key to a successful project. As such, we strongly recommend that a mandatory pre-bid walk-through and
a prequalification questionnaire be part of the requirements in the selection process.
The pre-bid walk-through helps familiarize prospective contractors with the project (or project site) and gives
them the opportunity to ask questions. Each contractor benefits from any discussion; the owner benefits
from receiving bids based on mutual understanding of the work scope.
The prequall icatlon questionnaire requires Information on the following:
Contractor's experience with similar projects
References, including other building owners
Brief written descriptions of how the contractor plans to meet the project specifications
and schedule
Standard operating procadures and employee health monitoring and respiratory
training programs

TASK 3.0 - ABATEMENT MONITORING
Asbestos abatement is a highly specialized melon procedure. Since the materials requiring abatement
are hazardous, the procedure must be accomplished in strict compliance with any Brazos County policies,
EPA guidelines, and other applicable regulations. During this task, we plan to monitor the abatement
procedures by making visual observations, taking air samples, and giving clearances to the contractor before
any segregated work area is dismantled.
After the abatement work Is completed, we provide the final project report. This final report represents the
permanent project documentation.
Task 3.1 - Monitor Abatement. During the abatement process, we will monitor the project on a full-time
basis. Monitoring will be accomplished by assigning a field technician who will be on-she from the
contractor's mobilization through final work area clearance and demobilization.
These monitoring services include conducting a pre-abatement conference, observing jobsite preparation
activities, establishing background data on pre-abatement conditions, and observing the abatement activities
during the course of the project. In addition, our site representative will:
- Observe work practices for compliance with project specifications

- Document abatement activities to describe the current practices at the time the work
was performed
{ - Collect air samples with analyses by phase contrast microscopy to monitor the
contractor's personnel, the containment, and the areas adjacent to the containment for
documentation purposes
• Provide work area clearance sampling
Report on work progress with a clear definition of whether clearance standards have
been met as an Independent, unbiased observer
Provide professional assistance for quick action and objective documentation in the
event of unanticipated and/or emergency situations
Be the owner's on-site representative at all times
Task 3.2 - Prepare Abatement Report The final activity of the abatement monitoring service Is
preparation of the overall project report. This documentation Includes contract documents and
specifications, contractor submittals, daily summaries of work accomplished, deviations from the
specifications, actions taken to correct deficiencies, and all laboratory test results Including clearance testing.
All pertinent data will be Included with this final project report.

We warrant that we will perform our services In accordance with the standards of care and diligence normally
practiced by recognized consulting firms In performing services of a similar nature. If, during the one-year
period following submission of our final report or completion or termination of our services, whichever is
earlier, it Is shown that those standards have not been met, and you have promptly notified us In writing of
such failure, we shall perform, on a reimbursable basis (as set forth herein), but without profit, such corrective
consulting services as may be necessary within the original scope of our services to remedy such deficiency.
This warranty shall constitute our sole liability with respect to our services or to any information or report
supplied to you. Acceptance of this proposal or use of any of the services or Information shall constitute a
release and agreement to defend and Indemnify us from and against all liability, whether arising in contract, or
due to negligence, or otherwise.
QUALIFICATIONS AND EXPERIENCE
We feel our qualifications and experience to provide asbestos consulting services are second to none. Since
we began providing asbestos services, much of our work has been repeat business. We invite you to call any
of our current or previous clients and have provided a reference list as Attachment 2.
All of our professional personnel, in addition to their formal degrees and education, have successfully
completed at least one EPA-approved asbestos' course. Many have completed advanced courses and
several are Instructors in asbestos training courses at the University of Texas at Arlington, Texas A&M
University, and with the National • Asbestos Council. These courses deal with basic asbestos safety,
procedures, handling, and other hazardous materials, as well as the AHERA regulations. Many of our
professional staff have completed accreditation courses for AHERA Inspectors and Management Planners,
and we are continuing to train additional professional staff.
When selecting an asbestos consultant, cost, qualifications, and experience are not the only considerations.
The AHERA regulations specifically require that local education agencies consider conflict-of-Interest issues
in selecting accredited consultants. EPA recommends that you be wary of employing Inspectors or
Management Planners with a vested' Interest in any possible abatement or response action activity. We have
no sucfr conflict of interest. We are not owned by, nor do we have any Interest in, or affiliate connections
with, any asbestos abatement contractor.

5. On-Call Response Services. Fees for providing On-Call Response Services (OCRS), services
requiring our presence on-site with less than 48-hours notice, are charged at 1.5 times the above rates
(except for laboratory testing fees). OCRS can be activated anytime by calling 713/995-9000,
800/225-3286, or our beeper number, 713/966-1182, on evenings, weekends, and holidays. Dial

ORDER RELOCATING POLLING PLACE 4 AND POLLING PLACE 15
WHEREAS, there exists at the present time two (2)
certain polling places which can no longer be used for the
purpose of conducting elections; and
WHEREAS, the polling place for voting precinct 4 is
located in the Carver Elementary School; and
WHEREAS, such Elementary School cannot be made to
comply with the handicapped regulations; and
WHEREAS, the Commissioners Court is desirous
permanently relocating the polling place of voting precinct 4 in
Kemp School Station which is approximately 500 feet west of
Carver School; and
WHEREAS, the polling place for voting precinct 15 is
located in Fannin Elementary School; and
WHEREAS, the building has been demolished to allow a
new school building to be constructed on the site; and
WHEREAS, the Commissioners Court is desirous of
temporarily relocating the polling place of voting precinct 15
approximately five blocks southwest of the school in a building
owned by the City of Bryan known as the Bryan Civic Auditorium,
located at 31st Street and Coulter Drive; Now therefore
