Commissioner Sims gave the invocation and led the pledge of
',allegiance.
i~ The first matter before the Court was a request by the

!!Brazos County 4-H Ambassadors to address the Court. Jim
'1Mazurkiewicz, County Extension Agent, introduced the Ambassadors
to the Court. They named six matters of concern that were
i.
'addressed at the Texas 4-H Congress meeting in San Antonio, in
fj
~IJuly of this year along with a brief outline of recommended
Jisolutions. Those concerns are illiteracy, teen pregnancy,
djuvenile crime, substance abuse, school drop outs and youth
!unemployment. The County Judge congratulated the ambassadors on

their presentation and the fine example they are setting for
their peers.
The Court next considered adopting a Resolution designating
the cafeteria/auditorium of Southwood-Valley Elementary School as
the official courtroom for the purpose of conducting a
naturalization ceremony on October 6, 1989. Judge W. T. McDonald
told the Court that from time to time the Naturalization Ceremony
had been conducted at places other than the Courthouse and that
this request was for the children to see the ceremony. He then
invited the members of the Court to attend. On motion by
Commissioner Wilcox, seconded by Commissioner Sims, the Court
voted unanimously to adopt a Resolution designating the
cafeteria/auditorium of Southwood Valley Elementary School as the
official courtroom for the purpose of conducting a naturalization
ceremony on October 6, 1989.
The Court next considered awarding the following bid:

Prices quoted per linear foot (dollars)
Brazos County will furnish all materials for a cost of
approximately $0.46 per linear foot.
Holland Winder, County Engineer, recommended acceptance
of the bid submitted by Mike Earp Construction for
labor only. On motion by Commissioner Wilcox, seconded
by Commissioner Wilcox, the Court voted unanimously to
award the contract to Mike Earp Construction for labor
only.
On motion by Commissioner Sims, seconded by Commissioner
•
Wilcox, the Court voted unanimously to authorize work outside
county rights-of-ways for the enhancement of county road
projects. Said work to be done on Dilly Shaw Tap Road, Elmo
Weedon Road and on the north side of Dilly shaw Tap Road.
The Court next considered a Wavier of Competitive Bidding
Requirements as provided in the Local Government Code, Section
262.024(a)(2) of Vernon's Annotated Civil Statutes for the

purchase of welding services for the repair of Mathis Creek and
Wickson Creek bridges. This was necessitated to preserve and
protect the public health of residents of the County. On motion
by Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to approve the Waiver of Competitive Bidding
Requirements and authorized the payment of $8,028.00 to Bryan
Welding and Blacksmith for the necessary services. This is a
change in the original amount of $7,511.50.
On motion by Commissioner Norton, seconded by Commissioner
Sims, the Court voted unanimously to enter into contract with
Alliance Health Providers of Brazos Valley, Inc.. Alliance will
administer the Utilization/Review services component of the
Brazos County group health insurance plan presently in effect
with Northwestern Life Insurance Company. The services rendered
will be pre-admission certification of medical necessity for
hospital admission, and concurrent review of all hospital
admissions. The agreement shall be in effect for a period of
one year commencing on September 1, 1989 and continue until
August 31, 1990.

BRAZOS COUNTY COMISSIONERS COURT
RESOLUTION

I
WHEREAS, the 85th District Court-of Brazos County exercises
naturalization jurisdiction as authorized by the United States Department of
Justice, Immigration and Naturalization Service; and
WHEREAS, a Naturalization Ceremony is scheduled to be conducted on
October 6, 1989 at 2:00 p.m.; and
WHEREAS, so the student body of Southwood Valley Elementary School
can participate in the ceremony and honor and welcome the new citizens of
these United States;
THEREFORE, BE IT RESOLVED, that the Brazos County Commissioners
unanimously designate the Cafeteria/Auditorium of Southwood Valley
Elementary School as the official courtroom for the purpose of conducting a
naturalization ceremony on October 6, 1989.

Please be advised that on this 18th day of September, 1989, at a
Regular Session of Commissioners' Court on which the following members
were present:

The Commissioners' Court has determined that there was a need to purchase
welding services from Bryan Welding and Blacksmith for the repair of Mathis
Creek and Wickson Creek bridges and hereby grants an exemption from the
competitive bidding requirement as an item made necessary to preserve and
protect the public health of the residents of the County, as provided in
the Local Government Code, Section 262.024(a)(2). The court hereby

ALLIANCE HEALTH PROVIDERS OF BRAZOS VALLEY, INC.
UTILIZATION/REVIEW SERVICES
PARTICIPATING AGREEMENT
•
This participating agreement is by or between Alliance
Health Providers of Brazos Valley,Inc. (hereinafter
"Alliance") a Texas corporation, and Brazos County, Texas
(hereinafter "Brazos County").
I.
General
1.1 Brazos County and Alliance agree that patients
shall not be third party beneficiaries of the rights and
obligations assumed by either party hereto.
1.2 Neither party shall disclose the terms of this
agreement to a third party without the consent of the other.
II.
Alliance Performance Provisions
•
2.1 Alliance will administer the Utilization/Review
services component of the Brazos County group health
insurance plan presently in effect with Northwestern Life
Insurance Company ("Northwestern") as insurer. The services
to be rendered will be preadmission certification of medical
necessity for hospital admission, and concurrent review of
all hospital admissions.
2.2 Alliance will work effectively and cohesively with
the Brazos County traditional health insurance carrier to
make sure the Utilization/Review program is executed in a
professional manner with proper reporting and notification
procedures being followed.
2.3 Alliance will publish periodic reports to Brazos
County which will summarize the utilization/review activity
which will include but not be limited to: total number of
patient encounters, total number of days anticipated, total
number of days approved, total number of days denied,
average length of stay, and actual length of stay. .
2.4 Alliance will be responsible for educating the
participants in the insurance program on the necessary
procedures to comply with utilization/review program.

2.5 Alliance will provide or make arrangements to have
the phone number printed on the identification cards.
Alliance will accept collect calls for out of area
precertifications.
2.6 Alliance agrees to comply with all state and
federal laws, rules and regulations covering the subject of
this agreement, as well as the terms of the group health
insurance plan.
III.
Brazos County Performance Provisions
3.1 All employees and dependents covered under the
Brazos County insurance program will be required to adhere
to the utilization/review services guidelines which are as
follows:
The employee or covered dependent and/or doctor will be
required to contact Alliance a reasonable time before
admission, except as herein provided for emergency and
obstetrical admissions. The following information will be
needed for all inpatient hospital admissions:
Employee name and address
Employer name, mailing address and plan number
Patient name, date of birth, and Social Security #
Admitting diagnosis, procedure date of admission and
expected length of stay, hospital name and telephone
number
Physician name, address, and telephone number.
For emergency and normal obstetrical admissions, the
patient, doctor, or hospital must call Alliance within 48
hours or the first working day after admission.
Failure to get the required certification will reduce
benefit payments as written in the insurance contract with
the insurance carrier.
IV.
Independent Relationship
4.1 No provision of this agreement is intended to
create nor shall be deemed or construed to create any
relationship between Alliance and Brazos County other than
that of independent entities contracting with each other
hereunder solely for the purpose of effecting the provisions
of this Agreement. Neither of the parties hereto, nor any
of their respective participants shall be construed to be
the joint venturer, partner, agent, employee, or
representative of the other.
V.
Term of Agreement
•
5.1 This agreement shall be in full, force and effect
for a period of one year commencing on the effective date
stated below and shall continue in effect under identical
terms for one year thereafter unless terminated in
accordance with the provisions of this Article V.
5.2 This Agreement shall terminate automatically on the
same date the underlying group health insurance plan between
Northwestern and Brazos County terminates.
5.3 Either party shall have the option of terminating
this Agreement, without cause, upon providing at least sixty
(60) days prior written notice to the other party.
5.4 In the event of a breach of this agreement, the
non-breaching party shall have the right to terminate this
agreement upon providing thirty (30) days prior written
notice to the other party. The party claiming the right to
terminate hereunder shall set forth in the notice the facts
underlying its claim that the other party is in breach of
this Agreement. Remedy of such breach within twenty (20)
days of the receipt of such notice shall revive the
Agreement in effect for the remaining term, subject to any
other rights of termination contained in this paragraph or
in any other provision of this Agreement.
5.5 As of the date of termination of this Agreement,
this Agreement shall be considered of no further force or
effect whatsoever and each of the parties shall be relieved
and discharged herefrom, except that:
a. Termination shall have no effect upon the
rights and obligations of the parties arising out of any
transactions occurring prior to the effective date of such
termination.
b. Brazos County and Alliance shall remain liable
for any obligations or liabilities arising from activities
carried on by such party or its agents, servants, or
employees during the period this Agreement shall have been
in effect.

VI.
optional Provisions
6.1 Brazos County shall pay Alliance a fee for
Alliance's services. The fee for the Utilization/Review
services described in Article II will be $1.50 per contract
per month. Contract is defined as one employee membership
whether it be a single or family. Brazos County agrees to
pay the utilization/review fee to Alliance within thirty
(30) days following receipt of a monthly billing.
This Agreement is effective for Utilization/Review Services
.reTidered on or after September 1, 1989.
