J. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to enter into an Agreement with Ed Slovacek, P.C. for administration of the Cafeteria Plan for the Brazos County employees. Effective date of the agreement: •I will commence with the Plan year beginning September 1, 1989. The Court next considered setting the following fees to be charged by the Sheriff and Constables of Brazos County. 1. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to adopt a Resolution authorizing Sharon Fairchild and Rosalie Todaro to sign and deliver all necessary requests and other documents in connection with Brazos County's annual contracts with the State Purchasing and General Services Commission for Contract Class No. 015, 060, 205, 395, 600, 608, 645 and 683. At 10:10 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in closed executive session to discuss personnel. At 10:53 a.m. the County Judge announced the meeting open to I I the public. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to authorize I ' I payment of accrued vacation, time to the widow of John Yeager, former Brazos County Sheriff's' Deputy. On motion by ;Commissioner Sims, seconded by Commissioner Norton, the Court iIvoted unanimously to authorize the District Attorney to hire an ,'employee at a group 15 step 4. Commissioner Norton moved to :create the position of Justice of the Peace Clerk at a group 7 ;istep 1. Commissioner Sims seconded the motion. The County Judge and Commissioners Norton, Sims and Wilcox voted "Aye" I~ '.Commissioner Turner voted "No" whereupon the County Judge declared the motion carried. There being no further business to come before the Court, the meeting was adjourned. The effective date of this agreement will commence with the Plan year beginning September 1, 1989. Administrator The County shall be the Plan Administrator and Ed slovacek, PC, hereinafter referred to as the "Administrative Firm" shall be engaged, as a subcontractor in the performance of administrative services for the plan. Administrative services to be provided be Administrative Firm$ 1. Prepare and conduct one seminar to explain the Cafeteria Plan to the employees. 2. Provide participant election forms to be used during the enrollment process. 3. Process initial enrollment forms and revocation forms to initiate the administration function. • 4. Prepare confirmation letters to employees to verify elections. 5. Provide each participant with a Reimbursement Claim Booklet and instructions for filing claims. 6. Provide reimbursement checks to employees on a bi-weekly basis. t 7. Provide a check register for all checks printed on a bi- weekly basis. a. Provide each participant a Statement of Account on a bi- weekly basis. 9. Provide discrimination reports and a written interpretation on a quarterly basis. 10. Provide annual County statements of participation by plan by participant. 13. Provide annual preparation of Form 5500. 14. Provide participant election forms at the end of each year for use in making elections for the following years. Communication services to be provided by Administrative Firm 1. Present informational seminar to the employee group. 2. Heet with each department's employees to discuss their savings and personal needs. Responsibilities of the County 1. Secure legal review of the Cafeteria Plan Document and Summary Plan Description from County's legal counsel. 2. Report participant terminations and changes of family status to Administrative Firm to be effective 2 weeks after receipt. 3. Reconciliation of payroll amount redirected to the Cafeteria Plan based on reports provided each month by Administrative Firm. 4. Distribution of checks and participant statements of account to County employees. 5. Provide Administrative Firm with blank check stock for use in preparing reimbursement checks. 6. Actual signing of reimbursement checks. 7. Initiate any action required in the event plan(s) become discriminatory. Fees and Terms of Payment At each reimbursement period we will prepare a check from your "Flex" account for the amount of our fee for that period. The County will remit that check to the Administrative Firm upon receipt. The fee schedule is attached as Exhibit A. The Administrative Firm has the right to change the fee schedule by giving at least 60 days notice to the County. 11. Provide forms to the County for use by the County in i Reports and Data All reports. and data remain the property of the County. Administrative Firm will provide the County all data, upon request, in the electronic or printed format used by Administrative Firm in its administration procedures. Software In the event the County wishes to self-administer the Cafeteria Plan, Ed Slovacek, PC, a CPA/CFP firm in Bryan, Texas will sell to the County the-software written to administer the Cafeteria Plan at the price in effect at that time. Any time required to train company personnel will be charged at our normal per diem rates. Terms of this Agreement This agreement will be affective from the date both parties execute this agreement until it is terminated. Either party can terminate this agreement with 60 days written notice.
