J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. He presented his proposal for a state prison and solid waste treatment facility to be located in Burleson County i 'in the Somerville area. He thanked the Court for the support i I given his project. ! jl The Court next considered approval of the minutes of the Commissioners' Court meeting held July 24, 1989. On motion by j 1Commissioner Sims, seconded by Commissioner Norton, the Court j ,voted unanimously to approve the minutes as submitted. On motion by Com- ;i missioner Sims, seconded by Commissioner Norton the Court voted unanimously to award the contract to Lee Welding. The Court next considered an agreement between Brazos I I,County and the Wellborn Community Center that in exchange for 1. ,giving the Road and Bridge Department permission to park various ,pieces of heavy equipment and stock pile materials on the .,community center's premises, Brazos County will maintain the driveway and keep the premises mowed for the duration of time !I necessary for the completion of work in the area. On motion by !Commissioner Turner, seconded by Commissioner Norton, the Court ,voted unanimously to authorize the County Judge to execute the fi ;agreement with the Wellborn Community Center. A copy of the 1i agreement is attached hereto. The Court next considered a lease agreement between Brazos 'I ounty and Robert Henry Moore for rental of space for the AGE S36 _ a V I Commissioners' Court meeting August 7, 1989 location of a Citizens' Collection Station for non-hazardous ' waste material in accordance with Section 325.21-325.24, Texas I l f 1 3 i d 1 si Department of Health, Municipal Solid waste management !Regulations. The site is located approximately 300 feet in an easterly direction along the southwest right of way line of FM (2038 from the most southerly right of way line of Dilly Shaw Tap ;Road. Brazos County agrees to pay the sum of Four Hundred Fifty !Dollars ($450.00) annually. On motion by Commissioner Sims, !seconded by Commissioner Wilcox, the Court voted unanimously to i ;enter into the lease agreement between Brazos County and Robert !(Henry Moore. A copy of the lease agreement is attached. The next matter for consideration was a proposal from Buchanan/Soil Mechanics, Incorporated to do a geo-technical !,investigation of a tract land on Highway 60, west of FM 2118 I! iwhich is proposed for purchase by the County for the widening of ~iHighway 60. On motion by Commissioner Sims, seconded by I~Commissioner Norton, the Court voted unanimously to accept the ,I proposal of Buchanan/Soil Mechanics for soil testing on the tract (iof land along the Highway 60 expansion project and to pay by linvoice. That for and in consideration of the covenants, agreements and stipulations herein contained, Lessor does hereby lease unto Lessee and Lessee does hereby take, rend and buy form Lessor for the term and upon the terms and conditions hereinafter set out, location for Citizens' Collection Station for non-hazardous waste material in accordance with Section 325.21-325.24, Texas Department of Health, Municipal Solid Waste Management Regulations, Exhibit "A" (attached). Site is located approximately 300 feet in an easterly direction along the southwest right-of-way line of FM 2038 from the most southerly right-of-way line of Dilly Shaw Tap Road and is lying and situated in the E. Seale Survey, Abstract No. 224, Tract No. 8 and being approximately one (1) acre tract of land. Lessee agrees to pay to Lessor upon receipt of statement and without deduction for setoff whatsoever, the sum of four hundred fifty dollars ($450.00) annually in advance. It is agreed and understood that this lease may be terminated by either party by the giving to either party written notice of intention to do so, in which event the term of this lease shall end. Municipal Solid Waste Storage. • is • ( 325.21 Applicability. This subchapter shall be applicable to all public and private storage systems. Additional requirements for storage of hazardous wastes are contained in 325.271 - 325.350 of this title (relating to Hazardous Waste Management). { 325.22 Storage Requirements. All solid waste shall be stored in such a manner that it does not constitute a fire, safety, or health hazard or provide food or harborage for animals and vectors, and shall be contained or bundled so as not to result in litter. It shall be the responsibility of the occupant of a residence or the owner or manager of an establishment to utilize storage containers of an adequate size and strength, and in sufficient numbers, to contain all solid waste that the residence or other establishment generates in the period of time between collections. ` ( 325.23 Approved Containers. All solid waste containing food wastes shall be stored in covered or closed containers which are leakproof, durable, and designed for safe handling and easy cleaning. (1) Nonreusable Containers. Nonreusable containers shall be of suitable strength to minimize animal scavenging or rupture during collection operations. (2) Reusable Containers. Reusable containers shall be maintained in a clean condition so that they do not constitute a nuisance and to retard the harborage, feeding, and propagation of vectors. (A) All containers to be emptied manually shall be capable of being serviced without the collector coming into physical contact with the solid waste. (B) Containers to be mechanically handled shall be designed to prevent spillage or leakage during storage, handling, or transport. ( 325.24 Citizens' Collection Stations. Citizens' collection stations should be provided with the type and quantity of containers compatible with the areas to be served. Rules should be posted governing the use of the facility to include who may use it, what may or may not be deposited. etc. The responsible county or municipal government shall provide for the collection of deposited waste on a scheduled basis and supervise the facility in order to maintain it in a sanitary condition. MM131T A I J , BR.AZOS COUNTY BRYAN. TEXAS AGREEMENT WHEREAS the Board of Directors of the Wellborn Community Center have granted to Brazos County Road and Bridge Department permission to park various pieces of heavy equipment and stock pile materials (short period of time) to be used by the County in the precinct on the Wellborn Community Center's premises. It is hereby agreed to by both parties, Wellborn Community Center and Brazos County that in exchange for the above stated privileges, Brazos County will maintain the driveway of said Community Center and keep mowed the premises on an "as needed basis." This agreement to be in effect for the duration of time necessary for the completion of work in the area or by mutual agreement of both parties to terminate said agreement.
