A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners'' Courtroom in the

The Court next considered approval of the minutes of the
II;Commissioners' Court meetings held July 10, 1989 and July 17,
;;1989. On motion by Commissioner Norton, seconded by Commissioner
I
:Turner, the Court voted unanimously to approve the minutes as
I,submitted.
The Court next considered Budget Amendment #8, which would
;:reallocate funds budgeted for Community Support, Juvenile
I
;Probation, Data Processing and Personnel and increase the general
'fund budget by $58,600.00. The General Fund Revenue budget was
:increased due to the receipt of $20,854.00 in grant funds and the
,.Capital Projects fund merely had a reallocation of funds. On
Iemotion by Commissioner Turner, seconded by Commissioner Sims, the
Court voted unanimously to approve the budget amendment as
I'
!submitted, a copy of which is attached hereto.
i' The Court next considered and order appointing James A.

'Amis, Jr. to sit as Special Judge in County Court at Law II from

'August 7, 1989 through August 11, 1989 to allow Judge Langley to

;take vacation time and August 14, 1989 through August 18, 1989 to
!!allow Judge Langley to attend the Advanced Family Law Conference.
1,. On motion by Commissioner Sims, seconded by Commissioner Norton,
`the Court voted unanimously to approve the Order naming James A.
Imis, Jr. as Special Judge for County Court at Law II for the

1989 through August 18, 1989. A full copy of the Order is

attached to and made a part of these minutes.
The Court next considered approval of the preliminary plat
I
the Quarter Horse Ranch Addition in Precinct 1. Holland Winder,
1I~County Engineer, stated that he had reviewed the plat and
t
suggested downstream drainage easement be 401wide and 501in
' I
!!length across the applicable lots as needed, he also asked that
J
!,the building set lines be shown on the plat or addressed in the j
;general notes and that all easements pipeline and utility be `
!,shown on the plat prior to coming back for final approval.
,Commissioner Norton commented that the two 150 culverts under any
county road were too small and recommended removing and replacing
them with 18' pipes. On motion by Commissioner Norton, seconded
by Commissioner Sims, the Court unanimously approved the
preliminary plat of the Quarter Horse Ranch Addition in Precinct
1 subject to the inclusion of recommendations previously stated
on the plat.
The Court next considered a Wavier of Competitive Bidding
Requirements as provided in the Local Government Code Section
262.024 (a)(6) for the purchase of right of way executed by the
Texas Department of Highways for the expansion of Highway 6
South. This was necessitated due to the need to provide
additional funds. On motion by Commissioner Turner, seconded by
Commissioner Sims, the Court voted unanimously to approve the
Waiver of Competitive Bidding Requirements and authorized the

payment of $400,000.00 to the Department of Highways and Public
` Transportation. A copy of the Waiver is attached.

to the public so that the Court could meet in closed executive

THAT WHEREAS, on July 31, 1989, the Court heard and approved
a budget amendment for the 1989 budget year for Brazos County,
Texas.
WHEREAS, an emergency expenditure is necessary due to grave
public necessity to meet unusual and unforeseen conditions which
could not be reasonably included in the original budget adopted
September 29, 1988, the following amendment(s) to the original
are hereby authorized, as described on the attached 3 page(s).

On this the Sit day of , 1989, the Commissioners Court of
Brazos County, Texas, convened in Regular Session at the Special term of the
Court, at the Brazos County Courthouse, in the City of Bryan, Texas, with
the following members present, to-wit:
R. J. Holmgreen, County Judge
Gary Norton, County Commissioner, Precinct No. 1
Walter Wilcox, County Commissioner, Precinct No. 2
Randy Sims, County Commissioner, Precinct No. 3
Milton Turner, County Commissioner, Precinct No. 4
Among other proceedings had, the following proposed order was
submitted:
WHEREAS, the Honorable J. D. Langley, Judge of the County Court at Law
No. 2 of Brazos County, Texas, having made known to the Commissioners Court
of Brazos County, Texas, that August 7 - 11, 1989, he will be absent from
the bench for vacation and August 14 - 18, 1989, he will be absent from the
bench to attend the Advanced Family Law Conference.
WHEREAS, he has requested the appointment of James A. Amis, Jr. to sit
as Special Judge of the County Court at Law No. 2 of Brazos County, Texas on-
the above mentioned dates in all matters that are, or may be, docketed on
the Court's dockets for those days, and to have and exercise all powers of a
Special Judge in relation to matters involved, it is, therefore:
ORDERED, ADJUDGED AND DECREED, pursuant to authority of Article 30.03,
Section 2, Code of Criminal Procedure, that James A. Amis, Jr., a former
Judge of the County Court at Law of Brazos County, Texas, sit and hear all
matters that are, or may be, docketed on any of the Court's dockets on the
above-mentioned days and shall have and exercise all powers of such Special
Judge in relation to the matters involved;
WHEREAS, the Court having considered the proposed order and deeming
that it should be approved; it is therefore:
ORDERED, ADJUDGED AND DECREED by the Commissioners Court of Brazos
County, Texas, that the order as submitted having been read, it was moved
and seconded that same should be approved. Thereupon, the question being

Please be advised that on this 31st day of July , 1989, at a Regular
Session of Commissioners' Court on which the following members were

The Commissioners' Court has determined that there is a need to provide
additional funds for the purchase of right of way executed by The Texas
Department of Highways for the expansion of Highway 6 South and hereby
grants an exemption from the competitive bidding requirement as provided in
the Local Government Code, Section 262.024(a)(6). The court hereby
approves payment in an amount not to exceed $400,000.00.
