Pool to make presentation to all present elected office holders of Brazos County. 4. Consider and take action on the appointments of two members to the Board of pirectors for the following corporations: (a) Brazos County Industrial Development Corporation (b) Brazos County Health Facilities Development Corporation 5• 'Consider and take action on the appointments to the Mural Fire Prevention District #2. • 6. B. Jones Brazos County Resident Linda Jackman Durst, Wood and Milberger Willie Pruitt Citizen Commissioner Sims gave the invocation and led the pledge of allegiance. Mr. Fletcher Pool appeared before the Court to present a sketch to the Court and to all elected officials of Brazos County. The sketch was of the old Stagecoach Inn in Millican I( PAn V01. J! !1 Commissioners' Court meeting June 26, 1989 that burned in 1912. The Inn, built by Dr. Elliot Millican, founding father of the town, was a stagecoach stop along the old ~ I Spanish 'Camino Real.' During the Civil War it was a training camp for Confederate soldiers. Mr. Pool dedicated his sketch to all present day office holders and charged them to carry out their commission by faithfully serving the people of Brazos County, Texas. The County Judge recognized Raymond,Day, Constable Precinct 1 and congradulated him on his forty years of public service. J The County Judge announced that the members of the local 4-H ,I club were winners.of the National Keep America Beautiful Award. i He went on to say they will be traveling to Washington D.C. to accept their award from President Bush. The Court next considered appointments to the Boards of • Directors of the Brazos County Industrial Development Corporation and the Brazos County Health Facilities Development Corporation. On motion by Commissioner Turner, seconded by Commissioner 'ilcox, the Court voted unanimously to appoint Commissioners orton and Sims to sit on the Boards of the two corporations. On motion by Commissioner Turner, seconded by Commissioner 'ilcox, the Court voted unanimously to reappoint the following ,eople as Fire Commissioners to the Rural Fire Prevention istrict #2 Board: Vincent Marino James Rossier Hawley West Raymond McCallum Howard Johan i i Oil, The Court next considered Budget Amendment #28, which would eallocate funds budgeted within the various departments. This ,as necessary to balance the department budgets for 1988 and with Ino increase to the budget. On motion by Commissioner Turner, 'seconded by Commissioner Wilcox, the Court voted unanimously to lapprove the budget amendment as submitted, a copy of which is attached hereto. Next to be considered by the Court was a request submitted by the Director of Juvenile Services for approval for out of Istate travel for the Educational Coordinator, Jill Taylor. Ms. VO PAG 3 Commissioners' Court meeting June 26, 1989 {iMs. Taylor would be traveling to Colorado Springs, Colorado to ;!attend a 'Correctional Education Conference" during the week of ; tjJuly 9 through July 12, 1989. On motion by Commissioner Sims, 11seconded by Commissioner Norton, the Court voted unanimously to I • 1:grant the request of the Director of Juvenile Services and {approved payment of out of state travel expense for Ms. Taylor. The Court next considered awarding the following bids: i~ Bid No. 89-515 - Annual Decking Timber Contract I( Bidders: I{if; 1. Lufkin Creosoting 2. Farm and Ranch {I 3. Conroe Creosoting 4. Kennedy Saw Mills 5. Colfax Creosoting Rebecca Shults, Purchasing Agent, recommended acceptance of the bid submitted by Farm and Ranch. Although not the low bid, it met the delivery time and manner of purchasing of the County. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court •i voted unanimously to accept the recom- mendation of the Purchasing Agent and award the contract to Farm and Ranch. Attached is j~ copy of the bid tabulation. I ~ Bid No. 89-516 - Annual Culvert Contract { Bidders: 1. Farm and Ranch 2. Metal Culverts i 3. Caldwell Culvert j~ 4. Young Equipment 5. Contech Construction 6. Le Roy Schroeder Rebecca Shults, Purchasing Agent, recommended acceptance of the bid submitted by Farm and { Ranch for galvanized corrigated culverts. Although not the low bid, it met the delivery l time and manner of purchasing single item {l culverts of the County, She went on to I recommend acceptance of the low bid submitted by Gifford-Hill for Reinforced Concrete Culverts. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to accept the 1 recommendation of the Purchasing Agent and ! award the contract to Farm and Ranch for galvanized corrigated culverts and to Gifford-Hill for reinforced concrete culverts. Attached is copy of the bid tabulation. On motion by Commissioner Turner, seconded by Commissioner Wilcox, the Court voted unanimously to enter into contract with 11 he Central Texas Correctional Corporation for the placement of Ij 1 • • • a committee to solicit proposals and notify the H.M.O.'s of County's process. Commissioner Sims indicated that since the ty had to allow Texas Health Plans to present their H.M.O. then he felt that Scott & white should be allowed to make Commissioners' Court meeting June 26, 1989 three (3) parole violators in the private facility known as the Central Texas Parole Violator Facility in Bexas County. The Board of Pardons and Paroles made available to Brazos County three (3) beds in the Bexar County* Correctional facility. In order to use the beds, Brazos County must transport the prisoners who are parole violators to Houston and the Board of Pardons and !Paroles will transport the prisoners to San Antonio. Sheriff 'Miller welcomed the opportunity to relieve some over crowding in the jail. A copy of the Prisoner Custody Agreement is attached !hereto. The Court next considered a request from the Sheriff to !update the Teletype Machine used by his department so it would be `;compatible with the State's equipment. The state recently :upgraded its equipment. The cost to upgrade the current equipment is $3,500.00. Rebecca Shults, Purchasing Agent, Ilinformed the Court that an application has to be submitted to the Department of Public Safety by September 1, 1989 in order to be I; on line as of January 1, 1990. The cost to convert the equipment ~;in the Sheriff's office along with the equipment in the County 4Attorney's office is approximately $7,100.00. On motion by the County Judge, seconded by Commissioner Sims, the Court voted !,unanimously to proceed with the expenditure of $7,100.00 to 1 I purchase equipment for the upgrading of the two departments. The I (purchase of the equipment is to be delayed as long as possible pending final decision of the Brazos County Emergency Communication District (9-1-1) being designated a central Idispatch. If this decision is made soon there would be no need it to upgrade the equipment. The next matter before the Court was consideration of health i+ benefits for the employees of Brazos County. The County Judge ~Liting time constraints, appointed Commissioner Gary Norton to iI II I i ~l ~ICommissioners' Court meeting June 26, 1989 it !specifications for H.M.O's should be drawn up for the H.M.O.'s as ;iwell and allow both H.M.O.'s to bid according the specifications. 1,He continued by saying that he felt the County needed a con- ~,sultant to review and sit in on the presentations of the ,:H.M.O.'s to the employees. The County Judge moved to appoint h ,'Gary Norton to investigate the need for a consultant for the County insurance and solicit quotes for consideration. Commissioner Sims seconded the motion and it carried unanimously. The Court received, aknowledged and ordered filed as submitted the Treasurer's report for May 1989. A copy of which is attached to and made a part of these minutes. PA2 ~d li I f• 01 Commissioners' Court meeting June 26, 1989 i On motion by Commissioner Turner, seconded by Commissioner Wilcox, the Court voted unanimously to approve the Claims as submitted. At 10:41 A.m. the County Judge announced the meeting closed to the public so that the Court could meet in closed executive session to discuss personnel. At 11:21 a.m. the County Judge announced the meeting open to the public. -The County Judge moved to create an additional I I Juvenile Probation Officer I slot for Jobs Coordinator in j a Juvenile Probation and to hire E. A. Hendrick for the position. Commissioner Turner seconded the motion. The County Judge and i Commissioner Turner voted "Aye." Commissioner Sims voted "No." ~I Commissioners Wilcox and Norton abstained. The County Judge declared the motion carried. On motion by Commissioner Norton, seconded by Commisioner I Sims, the Court voted unanimously to approve the request of the Data Processing Manager and keep Pam Crossman on the payroll on a temporary basis and appproved funding the position. There being no further business to come before the Court, Ithe meeting was adjourned. R E C I T A L S tr WHEREAS, Corporation is the recipient of a grant from the Criminal Justice Division of the Office of the Governor of the State of Texas for the purpose of operating the Central Texas Parole Violator Facility, which is located in a building in San Antonio that formerly housed the Bexar County Jail (the "Facility"), as a correctional center for certain persons described herein who are under the jurisdiction of the Texas Board of Pardons and Paroles ("BPP") and in the custody of County authorities, and who have violated the terms of•their parole; WHEREAS, Corporation has entered into a lease with Bexar County pursuant to which Corporation has the right to use the Facility for the purpose of incarcerating prisoners; WHEREAS, Corporation has entered into an operation and Management Services Agreement with Wackenhut Services, Incorporated ("Wackenhut") to operate, maintain and manage the Facility; 'WHEREAS, Corporation and County desire to enter into this Agreement pursuant to which Corporation (or its designee) will assume responsibility for the custody and care of certain prisoners previously incarcerated by County; Therefore, in consideration of the mutual promises and covenants contained herein, and subject to the conditions hereinafter set forth, Corporation and County agree as follows: 1. Assumption of Custody. In accordance with and subject to the terms of this Agreement, Corporation shall assume custody, care and control of certain Blue Warrant Prisoners (as hereinafter defined) previously incarcerated by County. Except as otherwise set forth herein, Corporation or its designee shall bear all expenses associated with such custody, care and control of Blue Warrant Prisoners, including all medical care. 2. Eligibility Requirements. Prisoners eligible for transfer to the Facility shall be limited to technical parole V Al .1i/- violators incarcerated by County who are under the jurisdiction of BPP, by virtue of having had issued against them a Blue Warrant, which shall remain in effect, and who (a) have no pending felonies or misdemeanors, (b) are classified as "low risk" (or the equivalent thereof), (c) are in reasonably good health, with no current medical problem that could cause hospitalization, and (d) have had a specified time of confinement authorized by BPP as a condition of the continuance of their parole. Such persons are referred to herein as "Blue Warrant Prisoners". Corporation or its designee shall be authorized to refuse to accept for incarceration, or after incarceration shall be authorized to return to County at County's expense, any prisoner who does not meet the eligibility requirements for incarceration at the Facility as set forth in this paragraph 2. 3. Maximum Prisoners. County may initially transfer to Corporation for incarceration at the Facility, beginning on the date specified by Corporation or BPP, notice of which shall be given by Corporation' or BPP to County at-least seven (7) days in advance, a maximum of three (3) Blue Warrant Prisoners. Such maximum number of prisoners will be subject.to increase or decrease by the Criminal Justice Policy Council (the "CJPC") upon ten (10) days notice (a) as additional floors within the Facility are opened for the incarceration of Blue Warrant Prisoners, (b) quarterly as the CJPC, with the advice and assistance of the Criminal Justice Corrections Advisory Committee (the "Advisory Committee"), applies the formula developed by the CJPC for setting the quota of prisoners incarcerated in county jails that may be sent to the Facility or to certain trustee camps operated by the Texas Department of Corrections, and (c) in the event of an emergency or other compelling need, as determined by the CJPC with the advice and assistance of the Advisory Committee. 4. Jail Standards. Corporation shall cause the Facility to be operated and maintained in accordance with minimum jail standards of the Texas Commission on Jail Standards (the "Commission"), including such variances from such jail standards as may be approved by the Commission ("Jail Standards"). If the Commission, at any time, determines that the Facility does not meet Jail Standards, either party may terminate this Agreement without ' penalty, at which time all Blue Warrant Prisoners shall be returned to the custody of County. 5. Transpo'rtatiea. Upon County's request, Corporation or ! its designee shall pzbvide, at Corporation's or its designee's expense, transportation of all eligible Blue Warrant Prisoners from a transportation site for the County, to be designated by Corporation or its designee (the "Transportation Site"), to the Facility and back to the Transportation Site. i 6. Release of Prisoners. Corporation will release a Blue I` Warrant Prisoner only, upon the order of BPP. Blue Warrant G Prisoners who are to be released will be returned to County at the Transportation Site for release by County. 7. Term. This Agreement is effective as of the date first above written and shall continue until August 31, 1989, at which time it may be extended for additional one year periods upon the mutual agreement of Corporation and County. Either party may cancel this Agreement upon seven (7) days writte.i notice to the other party, at which time Corporation will return to County each of its Blue Warrant Prisoners. 8. Notice. All notices required to be given hereunder shall be effective upon receipt by the party to which notice is given. Notice shall be given, if to County, to: Sheriff Ron Miler 300 East 26th Street, Suite 105 Bryan, Texas 77803 and if to Corporation, to: 9. Assignment of Obligations to Wackenhut. County acknowledges that it is aware that Corporation has contracted with Wackenhut to provide for the care, custody and control of prisoners at the Facility, and hereby consents to Corporation's assignment to Wackenhut of all of its obligations hereunder with respect to the custody, care and control of County Blue Warrant Prisoners. 10. Termination and Return of Prisoners. In the event that (a) Corporation's contract with Wackenhut for the care and custody of prisoners at the Facility is terminated for any reason, or (b) Corporation is for any reason prevented from using the Facility to house Blue Warrant Prisoners, then this Agreement shall terminate immediately and Corporation or its designee shall return to County at the Transportation--Site, and County shall accept into its custody any Blue Warrant Prisoners incarcerated at the Facility who were previously incarcerated by County.
