COMMISSIONERS' COURT
REGULAR MEETING
MAY 8, 1989
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, May 8, 1989, with the following members of the
Court present:

Commissioner Sims gave the invocation and led the pledge of
allegiance.
Commissioner Norton read aloud a Resolution commending the
Texas Agricultural Extension Service for its 75 years of service
in helping rural and urban citizens of this county to become
more knowledgeable about issues and thereby improve their overall
quality of life. He then turned the floor over to Jim
Mazurkiewicz, County Extension Agent, who gave a brief history of
the extension service. He explained that the first County Agent
position was established November 1, 1911 and that the first Home
Economist Agent position was established January 1, 1913. He
continued by saying that the United States Congress established

Commissioners' Court meeting May 8, 1989
the Cooperative Extension Service in 1914 with the passage of the
Smith-Lever Act to help farmers and ranchers, rural communities
and families with a multitude of problems. Then the Texas
Legislature created the Texas Agricultural Extension Service the
following year and assigned it to be the educational agency of
Texas A&M University. On motion by Commissioner Sims, seconded
by Commissioner Norton, the Court voted unanimously to adopt the
Resolution proclaiming May 8, 1989 as National 75th Anniversary
of Cooperative Extension System Day in Brazos County.
The next item on the agenda was to canvas the results of the
Special Election held May 6, 1989 to vote on the creation of a
Rural Fire District in Precinct 3. The totals are as follows:

Against: 142 Against: 75
On motion by Commissioner Turner, seconded by Commissioner Sims,
the Court voted unanimously to accept as true the totals as
calculated by the automatic tabulating equipment and ordered the
results be certified to the Secretary of State and recorded in
the Official Election Records of Brazos County. A copy of the
summary is attached hereto.
Ron Mayworm, Assistant Fire Chief of Precinct 3, thanked the
Court for their guidance through the process and stated they
ould try to hang on long enough to try again.
The Court next considered approval of the minutes of the
ommissioners' Court meeting held April 10, 1989. On motion by
ommissioner Turner, seconded by Commissioner Sims, the Court
oted unanimously to approve the minutes as submitted.
The Court next considered extension of a current lease
greement between Brazos County and the Junior League of Bryan-
ollege Station for rental of space at the Brazos Center from May
, 1989 to and ending on May 31, 1989. The purpose of this
greement is to adjust time periods of Lease Agreements between

Station, to coincide with the fiscal year of the League. The
Court also considered a lease agreement between Brazos County and
the Junior League of Bryan-College Station for the rental of
space at the Brazos Center for the period bf June 1, 1989 and
lending May 31, 1990. On motion by Commissioner Sims, seconded by
Commissioner Wilcox, the Court voted unanimously to extend the

Ilcurrent contract for one month to allow the time periods to
coincide with the fiscal year of the Junior League and to renew
the lease agreement between the two for the period of June 1,
1989 and ending May 31, 1990. A copy of each lease agreement is
attached.
The Court next considered adopting a Resolution authorizing
application for a grant to support the Brazos County Rape Crisis
Center, Inc. that is administered by the District Attorney's
office. Such grant to be in the total amount of $61,146.00;
eighty percent (808) or $49,018.00 to be funded by other sources, I t
twenty percent (208) or $12,128.00 to be state funded. On motion f
by Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to authorize the County Judge to make appli-
cation on behalf of Brazos County to the Criminal Justice
Division and accept on behalf of Brazos County such grant funds
as may be tendered. A copy of the resolution is attached hereto.
On motion by Commissioner Turner, seconded by Commissioner

Wilcox, the Court voted unanimously to accept for maintenance the
road and drainage improvements in the Rustic Oaks Subdivision.

The Court next considered a plat of Re-Subdivision of
Country Meadow Subdivision tract 8. Jay Dickens briefed the
Court that tract 8 had not been plated on the original plat
because they had wanted to explore the options of how to divide
the property. Due to interest in the tract, he had subdivided it r--~
into three tracts with one common 70 foot wide access to Dowling
Road. He explained that one common access to the three tracts '
running down the middle of tract 8 would prevent triplication of
time and materials and would provide mutual easement between the
parties. Commissioner Wilcox asked the county Engineer if the

vacating of a tract and the subsequent re-subdivision would it
not constitute a new subdivision. The Engineer answered it
would. The members of the Court voiced concern because of the
Veteran's Land Board or lending agencies requirements that each
parcel have access to a County maintained road. Mr. Dickens
stated it was his understanding that the parcels have access to a
70 foot easement extending to a County maintained road. It was
the consensus of the Court that the plat did not meet current
subdivision regulations. Commissioner Norton asked Mr. Dickens
to consider dedicating the easement to the County. In return the
County would maintain the road but not seal coat it due to the
limited amount of traffic traveling it on a daily basis. Mr.
Dickens said he would take the suggestion under consideration and
lsee if it was economically feasible. It was the consensus of the
Court to table consideration of the plat until a later date.
On motion by Commissioner Wilcox, seconded by Commissioner
Norton, the Court voted unanimously to authorize the application
made by Ernie Wentrcek for military service credit with the Texas
County & District Retirement System and approved the payment of
($465.00 in matching funds.
The next matter for consideration by the Court was a
written request Submitted by the Director of Juvenile Services
requesting approval for out of state travel for Associate
,Director Dan German. Mr. German would be traveling to Richmond,
Kentucky to attend a `National Juvenile Services Training
I
Institute' seminar during the week of May 21 through the 25,
1989. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to grant the
request from the Director of Juvenile Services and approved
payment of out of state travel expense for Mr. Dan German.
The Court acknowledged receipt of the Extension Service
reports for April 1989.
The Court acknowledged receipt of reports from County and

On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to approve the Claims as
submitted.
At 10:33 a.m. Commissioner Wilcox announced the meeting
closed to the public so that the Court could meet in closed
executive session to discuss personnel.
At 10:40 a.m. Commissioner Wilcox announced the meeting open
to the public.. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to approve the

request of the County Attorney to hire an employee at a group 6 `
step 2 with no six month step increase. On motion by
Commissioner Sims, seconded by Commissioner Wilcox, the Court
voted unanimously to approve the request of the District Attorney i
to make a part time temporary position into a part time permanent
position.
There being no further business to come before the Court,
the meeting was adjourned.

LEASE AGREEMENT
i
This agreement, hereinafter called Agreement II, between BRAZOS
COUNTY, TEXAS, and the JUNIOR LEAGUE OF BRYAN-COLLEGE STATION, extends
the duly executed agreement, hereinafter called Agreement I, of the
period between May 1, 1988 to and ending on April 30, 1989.
Agreement II extends Agreement I from May 1, 1989 to and ending on
May 31, 1989. All articles in the agreements, except the term dates,
remain the same. All fees for space remain the same.
The purpose of Agreement II is to adjust time periods of Lease
Agreements between BRAZOS COUNTY, TEXAS, and the JUNIOR LEAGUE OF
BRYAN-COLLEGE STATION, to coincide with the fiscal year of the League.
A new agreement for the period beginning June 1, 1989 will be made.
The parties to this agreement have hereunto set their hands in
duplicate on the day and the year written below.

LEASE AGREEMENT
This agreement between BRAZOS COUNTY, TEXAS, hereinafter called Lessor,
and JUNIOR LEAGUE OF BRYAN-COLLEGE STATION, hereinafter called Lessee, is made
as follows:
Lessor, the Owner of the Brazos Center, a multi-use building and the
adjacent grounds has agreed and does hereby agree, to lease and demise unto
Lessee, a portion of the Brazos Center, hereinafter described, upon the following
terms and conditions.
1. Lessee shall be entitled to the space exclusively allocated
to it by the Director of the Center for a term beginning
June 1, 1989 and ending May 31, 1990. The space allocated
to Lessee is described in Attachment "A" hereto, which has
been signed by the Director of the Center.
2. In addition, fees for temporary use of space required for
provisional, membership and board of directors meetings are
included in this contract as well as space for the League
Placement Fair. Such meetings should be scheduled as far in
advance as possible on a space available basis.
3. Fees for meetings involving small spaces for puppet show practice
as well as for committee meetings are also covered in this contract
provided the following conditions prevail:
a. Meetings in small rooms are to be held only during normal
business hours or after 5 p.m. when another activity is
scheduled requiring a Brazos Center attendant to be on the
premises;
b. If the space used for the meeting has been previously set-up
for a meeting scheduled at a later time by another group, the
committee chairman will be responsible for determining that
the room is in the exact state as when the room was entered;
c. The committee chairman should give the Brazos Center office
a notice of intention to meet no less than one week in advance;
d. The League member in charge of the meeting will sign a sheet
kept in the Brazos Center office noting the date, name of the
committee meeting, the entry time and the departing time.
4. In consideration therefore, Lessee agrees to pay the Lessor, on the
first day of each calendar month during the term hereof, in advance,
the sum of $225.00 (two hundred and twenty-five dollars) for rental
of exclusively occupied space as well as for fees assessed for space
for temporary uses described above. In addition Lessee has permission
for free use of Assembly I for two six-hour periods as scheduled in
advance with the Brazos Center.

5. Additional charges may be made for activities other than those
specified in this contract. Lessee will pay the regular User
fees for space used by it, other than space allocated to it under
this agreement.
6. A. Lessor shall furnish all utilities, including gas, water and
electricity.
B. Lessee shall furnish telephone and answering service for itself.
7. Lessor does not provide and will not provide furnishings, custodial
care, or maintenance of the space allocated to Lessee under this
agreement.
8. Lessee shall take good care of the space allocated to it, reasonable
wear and tear only excepted, and shall surrender the premises at the
termination of this agreement.
9. Lessee agrees that no improvements to or alterations to the space
shall be made without the consent of Lessor in writing.
10. Risk or loss of all property owned by Lessee shall-remain with Lessee,
it being understood that Lessor will maintain no insurance on such
property. Any insurance desired by Lessee on Lessee's property shall
be purchased by Lessee at its expense.
11. Lessor shall not be liable to Lessee or the Lessee's employees for
any damage to person or property caused by the negligent act of Lessor,
its agent, servants, or employees or due to the act of any other tenant
in the building, or due to any defect or want of repair in any part of
the building of which the allocated space forms a part.
12. Lessee agrees to hold Lessor harmless from any and all claims, damages,
expenses, including attorney's fees, growing out of or arising from
any negligent act on the part of Lessee, its agents, servants or
employees.
13. No sign shall be placed at, or on or about the premises by Lessee except
with the approval of the Center Director in writing.
14. Lessee president, as designated below right, shall be issued only one
key to the office allocated space. By accepting the key, Lessee
president agrees on behalf of all Lessee associates to (a) use the
allotted space only when the Brazos Center is open for business or in
use and (b) allow no copies or duplicates of the key to be made. Lessor
agrees to keep two duplicate keys on file in its office which will be
available for use to those deemed qualified by Lessee.
IN TESTIMONY WHEREOF, the parties to this agreement have hereunto set their
hands in duplicate, the day and year written below.

WHEREAS, the Criminal Justice Division, Office of the Governor,
has indicated, that metropolitan areas of population over 50,000
should have a rape crisis center and has thereby supported such;
and
WHEREAS, among the several programs included in the 1990 Criminal
Justice Plan for Texas is one which provides crisis intervention,
referrals and support services to adult and juvenile crime
victims, which includes sexual assault victims; and
WHEREAS, improved reporting of sexual assaults in recent years has
been attributed to increased public awareness of the seriousness
of the crime and to the assistance offered to sexual assault
victims in Brazos County; and
WHEREAS, unlike the victims of other crimes, sexual assault
victims may be reluctant to report the offense to the police
because of embarrassment, the fear of social stigma and anxiety
over the rigors of a lengthy investigation and trial, and the
Brazos County Rape Crisis Center offers support services to these
victims;
NOW, TWWORE, BE IT RESOLVED BY THE COMMISSIONERS' COURT OP
BRAZOS COUNTY, TEXAS, at its meeting on the ? day of
1989, that:
1. The t Judge is authorized to make application on behalf
of Brazos County to the Criminal Justice Division for grant
funds for the continuation of Brazos County Rape Crisis
Center, Inc.;
2. That the County Judge is authorized to accept on behalf of
Brazos County such grant funds as may be tendered by the
Criminal Justice Division; and
3. This Resolution becomes effective upon adoption and its
recording in the Minutes of the Commissioners' Court is
ordered.

Application for Current Service Credit for Military Service should be completed and submitted only if the follow-
ing requirements are met:
(a) The applicant was relieved from active military service under conditions other than dishonorable.
(b) The applicant is not and will not receive military retirement benefits provided by any federal law or reg-
ulation or federal retirement Act for at least twenty (20) years active duty.
(c) The applicant is not and will not be granted credit by any other retirement system or program estab-
lished or governed by the laws of this State for the same military service for which credit is being sought
with the Texas County and District Retirement System.
(d) The applicant's military service was active military service during the period from April 6, 1917 to
November 11, 1919, or from October 16, 1940 to October 31, 1974.
(e) The applicant must be a member of the Texas County & District Retirement System. If applying for mil-
itary service credit of three (3) years or less, the applicant must have been employed at least ten (10)
years by the participating subdivision and have at least ten (10) years retirement credit as an employee.
If applying for military service credit of more than three (3) years but not more than five (5) years, the
applicant must have heen employed at least fifteen (15) years by the participating subdivision and have
at least fifteen (15) years retirement credit as an employee.
(f) The application must be accompanied by the applicants contribution and the subdivision's matching
contribution (as calculated below).
