Signing of a proclamation designating April 16-22, 1989, as Sexual Assault Awareness Week in Brazos County. 4. Consider and take action on Resolution in regard to the exemption of state and local governments from Section 89 of the Internal Revenue Code. 5. Request from Mr. Jim Mazurkewicz to address Commissioners Court in regard to fire ant program. 6. Consider and take action on the approval of the minutes of the meetings held on March 20, 1989 and March 27, 1989. 7. Consider and take action on the approval of the•March"1989. and lst.Quarter Treasurer's reports. 8. Consider and take action on extension of pay schedule steps of the overall pay schedule for Brazos County. 9. V04.~PAG COMMISSIONERS' COURT SPECIAL MEETING APRIL 17, 1989 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissionbra' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, April 17, 1989, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Carol Palmer Bea Green Rosalie Todaro Rebecca Shults A. H. Asst. to County Judge Secretary to Commissioners Auditor's Office Purchasing Agent County Engineer District Clerk Deputy Treasurer Personnel Extension Agent Tax Assessor/Collector Bryan/College Station Eagle KBTX-TV KBTX-TV WTAW-KTSR Radio Brazos County Rape Crisis Center Brazos County Resident Commissioner Sims gave the invocation and led the pledge of i i allegiance. The County Judge read aloud a Proclamation proclaiming the week of April 16 through 22, 1989 as 'Sexual Assault Awareness Week' with the theme 'Shattering the Myths'. The Court joins (with the local Rape Crisis Center to help eliminate the threat of Isexual violence by providing public education in our schools, J I churches and civic organizations and to have active citizen involvement and support for changing public misconceptions and attitudes which perpetuate sexual violence. On motion by Commissioner Sims, seconded by Commissioner Wilcox the Court moved to proclaim the week of April 16 through 22, 1989 as 'Sexual Assault Awareness Week' with the theme 'Shattering the Myths' throughout Brazos County. The Court next considered a resolution urging the congress • to repeal section 89 of the Internal Revenue code which imposes detailed plan qualification and IRS reporting requirements on a wide range of employee benefit plans, including all health and i life insurance. Said provision also imposes administrative I~ f requirements that are extremely complex, labor intensive and will be cost prohibitive, particularly to Texas counties. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to adopt the resolution and forward a copy of the document to all Texas representatives at the federal level. Jim Mazurkiewicz, Extension Agent, addressed the Court on i • the Fire Ant Program. Reading from a prepared statement, Mr. lazurkiewicz presented the pros and cons of participating in the ?rogram of purchasing fire ant killer at wholesale prices and ;hen making it available to the public at the same reduced rate. .engthy discussion was held on the liability, if any, the county I tight face in distributing a pesticide, competition with local igri-business and possible product endorsement if only one ! iroduct is made available. He further stated it was the feeling if the State Service the county, extension agents stay out of the listribution business and be more of an educational unit. It ras the consensus of the Court to table consideration until such :ime as the Extension Agent could survey local agri-business :oncerns and users on the merits of the proposed program and then report back to the Court his findings. The Court next considered approval of the minutes of the Commissioners' Court meetings held March 20, 1989 and March 27, 1989. On motion by Commissioner Turner, seconded by Commis- sioner Wilcox, the Court voted unanimously to approve the !minutes as submitted. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court received, approved and ordered filed as VOL PAGE ? - - - ,.rte ,-.t„ Commissioners' Court meeting April 17, 1989 submitted the Treasurer's report for March 1989. A copy of which is attached to and made a part of these minutes. The Court next considered extending the current pay scale to twelve steps in order to allow those employees currently classified at step 8 an opportunity for* a merit increase. Commissioner Sims moved to extend the current pay schedule from step 8 to step 12, Commissioner Norton seconded the motion. Commissioner Wilcox asked if this was to be implemented in 1989, ;whereupon Commissioner Sims stated as of today. Commissioner I Wilcox stated that this extension changed the directives of the ti 6 11989 budget that was adopted in September 1988. The County Judge countered that this merely extended the pay steps. Commissioner Wilcox said he would consider the extension only if it is done in j 1990 and if Commissioner Sims would add to his motion that a new study be made of the current salary structure. Commissioner Sims indicated that consideration of a new salary study be added to the agenda of the next Commissioners Court meeting and not made a Ilpart of this motion. The motion carried unanimously The Court next considered a Wavier of Competitive Bidding I ii Requirements as provided in Section 262.024(a)(4) of the Local ;Government Code for the purchase of personal and/or professional 11 services of preparation of topographical survey of the site for 11the proposed minimum security facility from Garrett Engineering. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to approve the Waiver of Competitive Bidding Requirements and authorized the payment of $7,955.00 to • Garrett Engineering for the necessary work. Commissioner Norton informed the Court that he was prepared to begin negotiation for the acquisition of right-of-way along Greens Prairie Road in Precinct 1. He referred the Court's attention to the draft of an agreement he was proposing to use and to a copy of the current traffic count along the road. The Commissioner continued by saying he would be approaching the landowners on behalf of the county for the donation of land for the expansion of the road from where the gravel starts to FM voL_Y4_PAGE--2i-2,-' Commissioners' Court meeting April 17, 1989 2154. The Court next considered the request by Wellborn Water Supply Corporation to install three (3) PVC service drops (water lines) along the right-of-way of Capstone Drive in Precinct 1 and request from Fairview-Smetana Water to install a water pipeline within the right-of-way of old Spanish Trails Road, Lot 1 Block 2. On motion by Commissioner Turner, seconded by Commissioner Wilcox, the Court voted unanimously to approve the request of Pipe Tech Construction, Inc. and authorized the installation with the stipulation that a cut of 4 inches or less would be allowed across a gravel road, anything over that size or an installation across a hard top road would have to be drilled under the road. The County Judge asked if this was County wide or solely for Precinct 4. Commissioner Turner stated for Precinct 4. A copy of the request is attached hereto. Holland Winder asked the Court for continuity. Commissioner Norton asked the Engineer if all requests for installation went through his office. Mr. Winder replied that in this case Wellborn Water had not and when the work in progress was discovered he had shut it down. The Commissioners and the Engineer held lengthy discussion on the subject then on motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Wellborn Water and authorized the installation with the stipulation that the policy of any open cut section of 4 inches or less on a gravel road be back filled and compacted with fresh limestone, a cut of over 4 inches or an installation across a hard top road be drilled under the road surface be adopted county wide. A copy of the request is attached hereto. Commissioner Norton stated he could not remember all of Mr. Turner's motion entailed then moved that any open cut section of 4 inches or less on a gravel road be acceptable and that it be back filled and compacted with fresh limestone, a cut of over 4 inches or an installation across a hard top road be drilled under VOL___Z_PAG ICommissioners• Court meeting April 17, 1989 the road surface be adopted county wide.
