Adjourn VO PAGE ~ 36 COMMISSIONERS' COURT SPECIAL MEETING APRIL 6, 1989 V0 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the i Courthouse in Bryan, Brazos County, Texas, beginning at 10:30 a.m. on Thursday, April 6, 1989, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Cary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; i Frank Boriskie, County Clerk. Jones Brazos County Resident The County Judge opened the meeting and informed those in attendance that the Public Hearing on the Petition for the creation of a Rural Fire Prevention District had been held on April 4, 1989. As of yet, the County had not received letters from the cities of Bryan and College Station officially granting !permission to hold the election. The County Judge went on to recommend that the Commissioners Court adopt an Order calling an election to be held May 6, 1989 subject to the receipt of the letter from the two cities. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to la opt an Order calling an election to be held May 6, 1989 for 'the purpose of enabling the voters of such precincts to determine Lhether they desire to have these precincts organized into a Rural Fire Prevention District to be designated the Brazos County Rural Fire Prevention District No. 3 and for the uthorization of the levy of a tax on the taxpayers of such precincts not to exceed three cents ($.03) on one hundred dollar PAGE---?72 1I 'rJ1L e.•- ' rt i•r'1.. i--r ~ n yw•• .A •)•r • •..s • ~r - .I' ^ • ~ .wy - • v ~ • r _ ($100.00) valuation of real property lying within such proposed Rural Fire Prevention District. TEXAS ORDER h ON THIS THE 6th day of April, 1989, came on to be heard by the Commissioners' Court of Brazos County, Texas, after the filing of a Petition for the creation of a Rural Fire Prevention District, filed herein on the 10th day of March, 1989, praying that this court order an election to be held within certain voting precincts of the county for the purpose of enabling the voters thereof, to determine whether they desire to have a Rural Fire Prevention District established therein, and such petition being heard, and it appearing to the court that such petition is in due form and all the necessary prerequisites for the establishment of such district have been satisfied, and that such petition should be granted, IT IS ACCORDINGLY ORDERED that • on May 6, 1989 such date being not less than thirty (30) nor more than sixty (60) days from the date hereof, an election be held in ' conjunction with the Bryan Independent School District, College Station Independent School District Elections throughout voting precincts seven (7) and twenty-seven (27) of Brazos County for the purpose of enabling the voters of such precincts to determine whether they desire to have these precincts organized into a Rural Fire Prevention District to be designated the Brazos County Rural Fire Prevention District No. 3 and for the authorization of the levy of a tax on the taxpayers of such precincts not to exceed three cents ($.03) on one hundred dollar ($100.00) valuation of real property lying within such proposed Rural Fire Prevention District. u r VOL ✓ PAGE 2No L " AIP IT IS FURTHER ORDERED that the City Secretary of the City of Bryan act as the Absentee Voting Clerk for this election and that absentee voting by personal appearance be conducted each weekday beginning on April 17, 1989 and continuing through May 2, 1989 at the City Secretary's Office, Bryan Municipal Building, 300 Texas Avenue, Bryan, Texas. IT IS FURTHER ORDERED, that such election be held and conducted and the returns thereof made in accordance with the state laws regulating elections insofar as the same are applicable and that a public notice of such special election be published by posting a copy of the notice at the County Courthouse Door at twenty (20) days prior to the date of the election and additionally that such notice be published in a newspaper of general circulation in the proposed Rural Fire Prevention District once a week for two (2) consecutive weeks, with the first publication thereof being made at least twenty (20) days prior to the date of the election. En conformidad en el dia 6 de mayo de 1989, cual feccha es no menos de trienta (30) y no mas de sesenta (60) dias de la fecha de aqui, una eleccion sera sostenida en cojunto con la eleccion del distrito escolar independiente de { Bryan y el distrito escolar independiente de College Station por todo los precintos de votacion numeros siete (7) y veinte y siete (27) del condado de Brazos para el proposito de habilitar los votantes de tal precintos organizarse en un Distrito Rural Impeditivo de Fuego nombrado Distritio Rural Impeditivo numero 3 y tambien obtener autorizacion para leventar un impuesto de cual precintos no sera mas de tree ($.03) centavos en valuacion de cads cien ($100) dolares de bienes inmueblas cual esta dentro el distrito Rural Impeditivo de Fuego cual esta al proposito. Tambien se ordena que el secretario de la ciudad de Bryan i sera el secretario de las votaciones de ausencia de esta eleccion i i i . Aqui dentro tambien se ordena, que tal eleccion sera sostenida y administrada y los retornos de la eleccion seran en acuerdo con las leyes del estado de Texas governando eleccions en cuando que las mismas aplican y que un aviso publico de tal eleccion sea publicado por una copia del avisio puesta en la puesta del palacio de justicia veinte (20) Bias antes de la fecha de la eleccion y ademas que tal aviso sea publicado en un periodico de circulacion general en el Distrito Rural Impeditivo de Fuego propuesto una vez a la semana por I dos semanas en sucesivo.
