COMMISSIONERS' COURT
PUBLIC HEARING
APRIL 4, 1989
The Commissioners' Court of Brazos County, Texas held a
Public Hearing on a Petition submitted to the County judge for
the creation of Rural Fire Prevention District #3 in the
Commissioners' Courtroom in the Courthouse in Bryan, Brazos
County, Texas, beginning at 10:00 a.m. on Tuesday, March 4, 1989,
with the following members of the Court present:
R. J. Holmgreen, County Judge, Absent;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Presiding;
Milton Turner, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.
The following citizens and officials were in attendance:

The purpose of the Public Hearing was to hear commentary for
hand against the proposed creation of the Brazos County Rural Fire
(;Prevention District No. 3 in Commissioner- Precinct 3.

;!Commissioner Randy Sims stated in his opening comments that the
,!petition submitted by the residents in Precinct -3 had been

checked and certified and that proper notice of the hearing had
been given according to law. He outlined the procedures for the

hearing and asked those in attendance for any comments on the
!subject.

maintain and improve the old equipment. He asked that the Court
vote to hold an election for the creation of the Precinct 3 Rural j
Fire Prevention District.
C. B. Jones - Asked the Court if it was bound to hold an 1
election, whereupon Commissioner Sims answered 'No'. He then
asked why there was a public hearing and why do we need another
taxing authority. Commissioner Sims explained that Brazos County f
had funding limitations and that the Court was doing what it !
could to be equitable with everyone but it could not afford more
i
expenses to upgrade equipment. Dr. Jones asked, "Brazos County
doesn't have the money but Precinct 3 does?'
Commissioner Norton - Explained the need of an additional taxing i
authority.

Weldon Wright - Read from a pamphlet published by the Governor's
i
Advisory Committee referencing Rural Fire Protection. It cited

inadequate funding by the individual counties as the leading
(problem. It went on to say that the creation of a Rural Fire
(Prevention District plus the continuation of funding from the
Counties was a good step in helping alleviate the funding ,
problems currently facing the Volunteer Departments. He went on
to ask if the district were indeed created, would the county ;
continue funding. Commissioner Sims answered 'Yes'. I
L. G. Crum - A resident of the Harvey Community stated the

Commissioners Court had the authority to fund the budget and they

make the decision who gets what. He went on to say he believed i
the Commissioners Court should fund rural fire districts. He
then asked how many people in Precinct 3 had appeared to say
"Raise my taxes." He also stated he was not willing to pay more
tax dollars to the fire district. i
C. B. Jones - Informed the court that he was against the
establishment of another taxing authority and felt that the
Commissioners Court should handle this.
Rick Lemmons - Informed the Court that limited assistance in
suppression is furnished by the city fire departments due to the
cities' carriers having a limited water capacity. He continued
`by saying that response time by the volunteer department will

equal that of the cities once they can upgrade.
Weldon Wright - stated that previously fire protection had not
been adequate for fighting fires in the rural areas but that
things were now better. He said the cost to Brazos County to pay
for fire protection from the cities for the rural areas would be
excessive. Now the cities were calling the rural fire fighters
to help them within the city limits.
Clyde Brothers - stated he was against a new taxing district and
that the Commissioners Court should have the taxing authority to
increase taxes for fire protection.
Commissioner Sims asked if there were any more comments from
the audience, there were none.
Commissioner Sims then asked for comments from the members
of the Court. Commissioner Wilcox explained to the Court how
Precinct 2 had handled the matter saying that if any such area
(rural or extra territorial jurisdiction of Bryan or Wixon
Valley) had defeated the proposition, they would not been a part
of the district.
There being no further comments from the Court, Commissioner
Sims closed the Public Hearing and announced that a Commis-
sioners' Court meeting would be held on Thursday, March 6, 1989
at 10:30 a.m. in the Commissioners' Courtroom to vote on whether
to call the election.
There being no further business to come before the Court,
the meeting was adjourned.

creacion de un Distrito Rural Impeditivo de Fuego que sea creado
y governado bajo las condiciones de Articulo III, Seccion 48-d de
la Constitucion del Estado de Texas.

Los limites del distrito propuesto seran como la descripcion
que sigue:
SECCION 1 EMPEZANDO al punto donde la Linea central de la
interseccion del rio Navasota y la linea•central de la carretera
21 oeste;
De alli hacia el sur meandro con la lina central del rio Navsota
(que forma los limites de los condados de Brazos y Madison y los
lfmites del los condados de Brazos y Grimes) hacia la

interseccion con la linea central de Carter's Creek;
De a l l i hac i a el nord'este meandro con la l rnea central de
Carter's Creek ha la interseccion con los lfmites de la ciudad de
College Station;
De alli hacia noroeste ha to largo de la Linea de los L(mites de
la ciudad de Bryan hacia la interseccion con la li•nea central de
la carretera 211

De alli noroeste ha to largo de la Linea central de la carretera
21 hacia la interseccion con los limites de la ciudad de Wixon
valley;
De alli sudest ha to largo de los jimites de la cuudad de Wixon
valley otra vez hacia la interseccion con la carretera 21 oeste,
asi de este modo excluiendo la area incorporada de Wixon Valley;
De alli noroeste ha to largo de la Linea rental de la carretera
21 este hacia la Ifnea central del rio Navasota asi de este modo
regresando al punto de origin.
