David Pierce Commissioner Sims gave the invocation and lead the pledge of allegiance. i The Court next considered approval of the minutes of the Commissioners' Court meetings held February 8, 1989, February 13, 1989, February 14, 1989 and February 17, 1989. On motion by ;Commissioner Turner, seconded by Commissioner Wilcox. the Court animously to approve the minutes as submitted for the I VOL ✓ PACE (1 Y~ f x~ ,r f 11 Commissioners Court meeting March 27, 1989 ,dates of February 8, 13, and 14, 1989. Commissioner Sims i'abstained from voting for approval of the minutes of February 17, '1989 due to his not being present for the proceedings. The Court next considered continuation of the lease ;:agreement between Brazos County and the Brazos Valley Museum for the rental of a portion of the Brazos Center for a term ,beginning March 1, 1989 and ending February 28, 1990. The Brazos Valley Museum agrees to pay to Brazos County the sum of $104.00 monthly rental for use of such space. On motion by Commis- sioner Sims, seconded by Commissioner Turner, the Court voted unanimously to enter into agreement with the Brazos Valley i Museum for the rental of a portion of the Brazos Center under i the conditions stated above. A copy of the lease is attached hereto. f Ernie Wentrcek, Director of Juvenile Services, approached the Court with a report detailing the status of the budget of the I Juvenile Services Department. Mr. Wentrcek explained that during i the first three months of this year he had nearly expended all funds budgeted for Juvenile Expenses for the entire year. He explained that the department currently had five (5) children in contract placement in various facilities outside of Brazos County i and that it was costing from $10.00 per day per child to $105.00 per day per child. The difference in prices he explained, was ~'due to amount of supervision and treatment required by the child. These five (5) children were costing the department approximately j $7,000.00 per month. Mr. Wentrcek went on to say that the department has eleven (11) more children scheduled to go into !contract placement. He further stated that he was not requesting ~i 'funds at this time but merely informing the Court of future need. I, He said that it would require $226,000.00 in additional monies to ,see the department through the current budget year, $116,000.00 in additional funds to cover the known cases requiring placement sand an additional $110,000.00 to cover expenses for the placement Lf, as of yet, unknown number of children. Mr. Wentrcek went on V0 ACE 20a- . ,~1 • • I Commissioners Court meeting March 27, 1989 i to say that he would be approaching the Court in the near future ff i • 1with a budget request of and additiolal $177,710.00. 1 County Attorney Jim Kuboviak, asked the Court for funding !for the Family Violence Unit administered through his department. I. :Mr. Kuboviak gave each of the Commissioners a folder of material explaining the services provided by the Family Violence Unit plus letters of support from state and local elected officials and law Ilenforcement official from the cities of Bryan and College Station !having dealings with the unit through the courts. He continued ,by saying Brazos County is one of five counties in the state with , a family violence unit and the only one of its size with a unit. Mr. Kuboviak explained that the original source of federal funds ,,used to fund the unit would no longer be available as of May 31, 1989 and that he was seeking funding from the Court to continue ,the unit until such time as new grant funds could be located. He ',asked that the salary of the unit administrator be funded at a ,group 9 step 3 level plus fringes for the balance of the year. Mr. Kuboviak was asked if funds budgeted for his department could ,be reallocated. He answered no. After considerable discussion i in which the Court heard appeals from Kim Tate, a battered !,housewife, who had been helped by the unit, Sarah Ryan, President of the local Bar Association and administrator of Legal Aid and ,;Corkey Sandel, of the College Station Police Department, the i !,Court on motion by Commissioner Wilcox, seconded by Commissioner ! !Sims, voted unanimously to table consideration of funding until a J ater date. { ! The Court next considered an appeal from County Extension i , ;Agent Jim Mazurkiewicz for additional funding to upgrade the out moded computer system to allow the system used by the County Agents to interphase with the computer on the A&M campus. Mr. 1 Mazurkiewicz went on to explain that the cost to the county would The $1,040.00 plus $315.00 for the maintenance contract. The 'motion was made by Commissioner Wilcox and seconded by Commis- ji t sioner Turner to approve the funding request of the County I! !Extension Agent. The next matter for consideration by the Court was a written request submitted by the Anti DWI Coordinator seeking approval for out of state travel for herself. Ms. Matthews would be traveling to Cincinnati, Ohio to attend a 'Lifesavers/7' !conference during the week of April 9 through the 12, 1989. On emotion by the County Judge, seconded by Commissioner Turner, the Court voted unanimously to grant the request from the Anti DWI Coordinator and approved payment of out of state travel expense for Ms. Kristi Matthews. The Court next considered a written request submitted by the County Extension Agent requesting approval for out of state travel for the County Extension Agents for 4-H, Monty Dozier and Betsy Harkey. The agents would be traveling to Chevy Chase, Maryland and Washington D.C. to supervise the 4-H'ers in the National Citizenship project work during the week of July 1 through the 8, 1989. On motion by the County Judge, seconded by Commissioner Turner, the Court voted unanimously to grant the request from the County Extension Agent and approved payment of out of state travel expense for Monty Dozier and Betsy Harkey. The Court next heard from the Sheriff who gave them an update on the recently authorized expansion of the jail. He informed the Commissioners that the Jail Standards Board had reduced the number of beds to ten and recommended the area be constructed for maximum security use. This, the Sheriff said, would increase the cost of expansion from approximately $9,000.00 to $16,956.00. After some discussion, Commissioner Wilcox moved to authorize the increased expenditure. The County Engineer concurred with Commissioner Wilcox and also recommended acceptance due to turn around time and that no stock piling of f materials would be necessary. The motion was seconded by Commissioner Turner and carried unanimously to award the contract to Farm & Ranch. i Bid No. 89-497 - Annual Cold Mix Limestone Rock Asphalt j Pavement Contract for the Road and Bridge Department Consideration was tabled until the next meeting The next item for consideration was the renaming of two roads in Precinct 4. Commissioner Turner and the County Engineer ',informed the Court that an extension off Goodsen Bend Road needed to be included in the name. Another road in the precinct had j never been named and they proposed naming it Allen Road. On motion by Commissioner Turner, seconded by Commissioner Wilcox, I 1 the Court voted unanimously to authorize the naming of the two roads in Precinct 4. The Court acknowledged receipt of the Extension Service reports for February 1989. The Court acknowledged receipt of reports from County and Precinct offices showing revenues collected and remitted to the County Treasurer. LEASE AGREEMENT This agreement between BRAZOS COUNTY, TEXAS, hereinafter called Lessor, and BRAZOS VALLEY MUSEUM, hereinafter called Lessee, is as follows: Lessor, the Owner of the Brazos Center, a multi-use building and the adjacent grounds has agreed and does hereby agree to lease and demise unto Lessee a portion of the Brazos Center, hereinafter described upon the following terms and conditions: 1. Lessee shall be entitled to the space allocated to it by the Director of the Center for a term beginning March 1, 1989 and ending February 28, 1990. The space allocated is described in Attachment "A" hereto, which has been signed by the Director of the Center and the Judge of the Brazos County Commissioners' Court. Lessor agrees to provide space designated in Attachment "A" for Lessee's use during the term of this agreement. 2. A. In consideration therefore, Lessee agrees to pay to Lessor on or before the first day of each month during the term hereof, the sum of $104.00 representing the agreed monthly rental for the use of such space as herein set forth; • lei B. and two dollars ($2) per camper per week for day camp sessions. 3. Lessor shall furnish all utilities, including gas, water and electricity. 4. Lessee will pay the regular User fees for space used by it, other than space allocated to it under this agreement. 5. Lessor does not provide and will not provide furnishings, custodial care or maintenance of the space allocated to it under this agreement. 6. Lessee will be responsible for having an individual and/or an automatic answering device to answer the telephone during the announced business or visiting hours. 7. Lessee agrees that it will be open on Saturdays and Sundays at hours agreed to by the Center Director and Lessee, and if specifically re- quested, will serve as the Center authority on those days. 8. Lessee shall take good care of the space allocated to it, reasonable wear and tear only excepted, and shall surrender the premises at the termination of this agreement if Lessee fails to meet obligations delineated in this contract. 9. Lessee agrees that no improvements to or alterations to the space shall be made without the consent of Lessor in writing. 10. Risk of loss of all property owned by the Lessee shall remain with Lessee, it being understood that Lessor will maintain no insurance on such property. Any insurance desired by the Lessee on Lessee's property shall be purchased by Lessee at its expense. :y 1 r `r i t t Y . 11. Lessor shall not be liable to Lessee or its agents or employees for any damage to person or property caused by the negligent act of any Lessor, its agents, servants, or employees or due to the act of any other tenant in the building, or due to any defect or want of repair in any part of the building of which the allocated space forms a part. 12. Lessee agrees to hold Lessor harmless from any and all claims, damages and expenses, including attorney's fees, growing out of or arising from any negligent act on the part of Lessee, its agents, servants, or employees. 13. No sign shall be placed at, on, or about the premises by Lessee except with the approval of the Center Director in writing. 14. Lessee agrees to abide by the rules determining types, housing, maintaining and reporting inventory of wild animals in th(, Brazos Center entitled Attachment "B" which is incorporated in the Lease Agreement between BRAZOS COUNTY, TEXAS and the BRAZOS VALLEY MUSEUM and duly signed by the Museum Director and Board President. 15. Lessee agrees to have a minimum of four different exhibits annually displayed in the Brazos Center showcase allotted to the Museum. 16. Lessee is granted permission to sell merchandise on the premises provided that merchandise is secondary to the principal objective of Lessee's occupancy of the premises. 17. Lessee may, when available, use space entitled Classroom AB for temporary purposes, after clearing dates with the Center scheduler. All other space used other than that herein defined will require fees normally charged. Use of such space is on a first-received request basis. 18. Sub-leasing of Museum space is prohibited. Use of any Museum space, including Classroom AB, an outside organization must be scheduled for approval by the Museum and the Brazos Center. Approved meetings must be scheduled during normal office hours or hours when the Brazos Center is open for another scheduled event. ANIMALS - GENERAL RULES 1.1 No venomous animals. 1.2 All snakes should be housed in locked cages. 1.3 Birds must not be maintained on a permanent basis; no birds will be free-flying; any cages being used will be cleaned daily. f 1.4 No large animals will be allowed. "Large" is defined as those re- quiring more than 10 cubic feet of space in order to be properly maintained. 4 1.5 All live animals will be used for educational purposes only. No exotic animals will be permitted. II. CONTAINMENT AND MAINTENANCE 2.1 All animals will be kept in maximum sanitary conditions. 2.2 A rigid cleaning schedule will be maintained. 2.3 Feeding schedule will be followed. 2.4 All foods must be stored in tightly covered containers. 2.5 Numbers of animals kept shall be permitted as space allows. 2.6 Animals will be checked regularly (at least once per month) and on schedule, for parasites and diseases. 2.7 Any diseased animal will be treated, released or sacrificed. III. INVENTORY An inventory of animals including a description of each will be kept up to date and on file at the Brazos Center office. 3.1 No more than 30 vertebrate animals (excluding fish and mice) may be kept on the premises at one time. 3.2 Animals allowed include: Fish (in aquariums) Snakes under 5 feet in length (see 1.1 and 1.2 above) Lizards Frogs Mice (no more than 15 adults) Flying squirrels Small turtles under 6' in shell length 3.3 Animals prohibited include: Rabbits Rats Squirrels Racoons Armadillos Opossum All other animals may be kept only by agreement between the Museum Director and the Center Director. _ 1.
