'.'•Cf•'j..,p _T lw^~n.-11.t.~Tt sir .r COMMISSIONERS' COURT • SPECIAL MEETING MARCH 6, 1989 U A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, March 6, 1989, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. Youth Livestock Assoc. Leon County Commissioner Sims gave the invocation and lead the pledge of allegiance. The Court next heard a proposal from J. D. Langley, Judge of County Court at Law II for the creation of the Fifteenth Court of Appeals in Brazos County. Judge Langley explained that the intent was to expedite the intermediate appellate process, as well as place the courts closer to the litigants and relieve the currently overburdened courts of appeal in the region. Judge ngley went on to say that the cost of creating the new court of I appeals could be shared by the host county and city, those being, ,facilities, equipment, library and supplies and the state bear the operating costs such as salaries. After considerable discussion, on motion by Commissioner Sims, seconded by V L pt M I ~r ' I I Commissioner Norton, the Court voted unanimously to extend its i support for the creation of the Fifteenth Court of Appeals. I I I The next matter before the Court was reconsideration of a I request submitted by the County Extension Agent ih Home Economics requesting approval for out of state travel to Honolulu, Hawaii. The Court had tabled consideration of the request during a I previous meeting to allow the members of the Court time to gather information on expenses. Having done that, on motion by I !Commissioner Turner, seconded by Commissioner Norton, the Court I Ilvoted unanimously to grant the request from the County Extension I I IiAgent and approved payment of out of state travel expense for Ms. (,Carolyn Nobles to attend the National Association of Extension Home Economist Annual Meeting in Honolulu, Hawaii during the I (dates of September 17-22, 1989. The County Judge, deviating from the agenda, recognized Mr. I IlHank Bird, President of the local livestock group and asked him 11to inform those in attendance of the up coming schedule of events i surrounding the Youth Livestock Show beginning on Saturday. Mr. (,Bird informed the Court that the show would run from March 11- 14, 1989, with events such as a petting zoo, animal judging and I (sales. He went on to invite everyone out to the Dick Freeman `(Arena to enjoy the show. Commissioner Sims thanked Mr. Bird for Icoming and informing the Court of the events. I The Court next considered approval of the final plat of Plantation Meadow Subdivision in Precinct 1. Holland Winder, County Engineer, stated that he had reviewed the plat finding it Ito be in order, recommended acceptance by the Court. On motion I!by Commissioner Wilcox, seconded by Commissioner Sims, the Court i I Iunanimously approved the final plat of plantation Meadow Ii Subdivision in Precinct 1. The court next considered approval of the final plat of Plantation Wood Subdivision in Precinct 1. Holland Winder, County Engineer, stated that he had reviewed the plat and it appeared to be in order. I • ' On motion by Commissioner Sims, seconded by Commissioner Turner, the Court voted unanimously to pay and remit its 2/3 consideration for easement for utility relocation along the i north line of FM 60. The County Judge brought to the attention of the Court Senate Bill 365 (by Leedom) currently in the Senate Committee on Finance which proposes to levy a fee of $.50 per member on all Ipublic retirement systems in Texas. The monies collected would become a source of financing for the Pension Review Board and Icost the Texas County and District Retirement System alone in Iexcess of $40,000.00. If the bill becomes law, it is feared ,that other state agencies will levy fees against public , I~retirement systems thus reducing the ability of the system to I~pay benefits. On motion by Commissioner Norton, seconded by IjCommissioner Sims, the Court voted unanimously to forward a I~letter to members of the Senate Finance Committee voicing the Ii Courts' opposition to the proposed legislation. I The County Judge brought to the attention of the Court House Bill 971 (by Patterson) seeking to impose $10.00 fees on persons convicted of misdemeanors or felonies for the purpose of festablishin9 county jail funds. The monies collected would be Ideposited into a special county jail fund in each county for the purpose of acquiring, constructing, maintaining or operating a county jail facility. On motion by Commissioner Turner, seconded !Resolution by Commissioner Sims the Court voted unanimously to forward a in favor of said bill to the State Senator, Repre- sentative and the Governor of the State of Texas. 1it'~L 1/ PACE /7/ .-A The Court proceeded to consider the change of status of the following employees. On motion by Commissioner Turner, seconded by the I . !j County Judge, the Court voted unanimously to approve the request 11of the District Clerk and authorize the promotion of one employee from a group 7 step 1 to a group 7 step 2 and hire a new employee at a group 4 step 2. There being no further business to come before the Court, i the meeting was adjourned.
