A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Wednesday, February 8, 1989, with the following members
of the Court present:

Commissioner Sims gave the invocation and lead the pledge of
allegiance,
The Court first 'considered approval of the minutes of the
missioners' Court meeting held January 9, 1989. On motion by
missioner Sims, seconded by Commissioner Turner, the Court
Ivoted unanimously to approve the minutes as submitted.
I The Court next considered a request by Constable Precinct 5,
IFrankie Nemec, for the appointment of Wallace Groff, E. W.
Sayers, Johnny Hoelscher and Chester Price as Deputy Constables
of Precinct 5. Having found all in order and on motion by

'Commissioner Sims, seconded by Commissioner Norton, the Court

,,voted unanimously to approve the appointments of those whose
I;names appear above as Deputy Constables of Precinct 5.
The Court next considered a request by Sheriff Ronny Miller,
''for the appointment of Rebecca Zan Lawrence, James Franklin
IMuillins, Sr., Jeffrey Haislet, Stephen John Larson and Emil E.
Ogden as Reserve Deputy Sheriff's. Having found all in order and
,on motion by Commissioner Turner, seconded by Commissioner Sims,
;the Court voted unanimously to approve the appointments of those
'whose names appear above as Reserve Deputy Sheriffs.
The Court next considered a request by Constable Precinct 2,
Johnny Burkhalter, for the appointment of Merl Smith as Deputy
'Constable of Precinct 2. Having found all in order and on
motion by Commissioner Norton, seconded by Commissioner Wilcox,
the Court voted unanimously to approve the appointment of Merl
Smith as Deputy Constable of Precinct 2.

Commissioner Sims proposed then moved to reduce the salaries
of the County Commissioners to $25,000 and, if the motion did not
pass, consider the proposal at budget time. Commissioner Sims
stated he felt that due to the addition of a County Engineer, the

job of County Commissioner was no longer a full time job. The
motion died for lack of a second.

The Court recognized County Attorney, Jim Kuboviak, who
requested approval for out of state travel for Administrative i
Assistant, Ginny Hamm. Mrs. Hamm would be traveling to Orlando,
Florida to attend an 'Office Administration' seminar during the
week of April 9 through the 13, 1989. Commissioner Sims
!questioned the reason for attending the conference and asked if
i
any like conference was held in this state. Mr. Kuboviak replied
I
that this was the only class offered this year for non attorneys.
,Commissioner Turner moved to approve the request. The motion was
lpeconded by Commissioner Wilcox. Commissioners Norton, Turner
find Wilcox vote 'Aye'. Commissioner Sims voted 'No', whereupon
ommissioner Wilcox declared the motion carried to grant the
Commissioners' Court meeting February 8, 1989
request of the County Attorney and approved payment of out of
state travel expense for Mrs. Ginny Hamm.

The County Attorney retained the floor and with, the help of
'Assistant County Attorney, Sandra Dent, presented an overview of
Ila proposed Work Release and School Release Program which allows
qualified misdemeanor defendants to work and/or go to school
while serving time in the County Jail and make partial
!restitution to the County with a sliding scale fee based on 20%
l(of the defendant's total weekly gross earnings. This sliding
Itale fee would help offset expenses incurred during
1-incarceration such as medical and housing costs, court appointed

!!attorney's and administrative fees. Mr. Kuboviak interjected
liwith a request that the Court take action on the sliding scale as
',presented to allow the departments to proceed. He informed the
~J
Ilmembers of the Court that Judge Langley of County Court at Law
III, who would be testing the program in his Courtroom, was
'present to answer any questions they might have. Judge Langley
'addressed the Commissioners and stated that the other judges were
!in agreement and were willing to utilize the program once the
'procedural problems were resolved. After further questioning
!from Commissioner Norton, it was established that the Judiciary
;would be responsible for the decision as to whom would be
eligible for the program and that implementation was scheduled
Ifor April 1, 1989. On motion by Commissioner Sims, seconded by
Commissioner Norton the Court voted unanimously to approve the
sliding scale and to initiate the program. A copy of the scale
is attached hereto.
The Court next considered approval of the final plat of
;Lambert Subdivision Phase I in Precinct 3. Commissioner Wilcox
•
(questioned the private road Holland Winder, County Engineer,
stated that he had reviewed the plat and it appeared to be in
order. On motion by Commissioner Sims, seconded by Commissioner
Turner, the Court unanimously approved the final plat of Lambert
Subdivision Phase I.

Commissioner Sims, seconded by Commissioner
j Norton, the Court voted unanimously to accept
the recommendation of the Purchasing Agent
and award the contract to Dealers Electric.
The next matter for consideration was a written request from
'Ed Dobbins, of the Maintenance Department, for permission to
replace the badly worn carpet in the Tax office that had become a
(safety hazard. Mr. Dobbins submitted four cost estimates and

recommended acceptance of the estimate submitted by Lamar Carpet
lin the amount of $4,877.00. On motion by Commissioner Sims,
seconded by Commissioner Turner the Court voted unanimously to
accept the recommendation of Mr. Dobbins and authorize the
~urchase of carpeting and tiles from Lamar Carpet.
The Court next considered another request from Mr. Dobbins
'dealing with the deteriorating condition of the cedar and oak
Itrees on the courthouse square and treatment for said condition.
F n motion by Commissioner Sims, seconded by Commissioner Norton,
the Court voted unanimously to table consideration for further
investigation into cost of treatment.

Wilcox, the Court voted unanimously to forward a letter to the
Governor of the State of Texas stating the position of the Court
that a local resident of Brazos County be appointed to the Board
of Regents of Texas A&M University.
The Court proceeded to consider the change of status of the

On motion by Commissioner Norton, seconded by Commissioner
Wilcox, the Court voted unanimously to approve the Claims as
submitted.
At 10:55 a.m. the County Judge announced the meeting closed
to the public so that the Court could meet in closed executive
session to discuss personnel, land acquisition and litigation.
At 12:00 p.m. the County Judge announced the meeting open to
•
the public.
On motion by Commissioner Sims, seconded by Commissioner
Wilcox, the Court voted unanimously to approve the request of the
Data Processing Manager to re-organize that department and create
an additional full time programmer position.

361st District Judge to hire a bailiff with' peace officer .
.certification at a pay group 8 step 5 level with the stipulation

`that there be no six month step increase. The additional funds

jl;for this position would be taken from part time bailiffs'

'salaries.
;I Commissioner Sims moved to enlist the aid of William R. `

(Vance and the County Engineer to contact the owners of Rainbow
lIIAcres Phase II to bring the subdivision into compliance with the
subdivision regulations and once that is accomplished consider !
