I i i COMMISSIONERS' COURT SPECIAL MEETING JANUARY 17, 1989 A special meeting of the Commissioners' Court of Brazos I !County, Texas was held in the Commissioners' Courtroom in the I ;iCourthouse in Bryan, Brazos County, Texas, beginning at 10:00 'a.m. on Tuesday, January 17, 1989, with the following members of I ' 1the Court present: ii R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; it Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; II Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. Davila Visitor The County Judge recognized Jim Kuboviak, County Attorney, Ilwho informed the court that he had researched the cost of !rebuilding the motor of the vehicle transferred to the County ii I 'Attorney's office from the Sheriff's Department and had come to ':the conclusion that the installation of a long block with a -twelve month 12,000 mile warranty at a cost of $2,371.90 would be ;!the better choice ultimately rather than the short block motor; this being the low bid submitted by Manry's Auto Repair. The ,CCounty Judge moved to accept the proposal submitted by Manry and 1ladjust the County Attorney's budget for the additional expense. ,The motion was seconded by Commissioner Sims and carried 'unanimously. Mrs. Frances Catalena presented a petition in protest of the ,proposed site of the minimum security jail. The petition, signed V® -PA-CE y a c~ r k~ 1 • I I 1 !Commissioners' Court meeting January 17, 1989 Iby fifty three residents and property owners along Sandy Point ';Road, expressed their concerns over property values and.the I '.threat to their safety and security.' Mrs. Catalena suggested the (Court consider the old City Hall, the old Greenleaf Hospital or .add another story to the existing jail as alternatives to the proposed site. Judge Holmgre,en informed Mrs. Catalena that MHMR I ;had purchased the old Greenleaf Hospital, the renovation of old City hall was too costly and that it would only hold a minimum number of prisoners. Bill Catalena stated that it appeared that (the residents of Sandy Point Road had to bear a number of I adverse conditions in that the City of Bryan landfill was situated on sandy Point Road and now a new prison was proposed ''for the area. Judge Holmgreen presented the position of the Court by stating that not only would the new jail be located at the site, but the Court was also researching the possibility of moving the Rodeo Arena and Pavilion to the location. Mrs. • • .Matajeka, another resident of the area voiced concern that there : was no guarantee that the jail would be minimum security and she ,noted that nothing that would increase property values had ever been placed on Sandy Point Road, hence the low property values. !She further stated that most of the residents of the area were I f'disabled people. The County Judge thanked the resident of Sandy :Point Road for the petition and assured them that their concerns I !would be taken under consideration. f~ The Court next considered approval of the minutes of the ,Commissioners' Court meetings held December 28, 1988. Commis- j sionsr Turner moved for approval whereupon the motion was iseconded by Commissioner Wilcox. The County Judge, Commissioners i 1 I 'iTurner and Wilcox voted "Aye". Commissioners Norton and Sims ' ,!abstained, whereupon the County Judge declare the motion carried I~ ~ jito approve the minutes as submitted. The Court next considered Budget Amendment #26, which would reallocate funds budgeted for the office of Constable of Precinct 7 and Budget Amendment #2 for the 1989 budget, which would increase the budget of Community Support by $23,000.00. On motion by Commissioner Wilcox, seconded by I iCommissioner Sims, the Court voted unanimously to approve the budget amendments as submitted, a copies of which are attached !hereto. On motion by Commissioner Turner, seconded by Commissioner I ' (Wilcox, the Court voted unanimously to approve the purchase of ';right-of-way from Floy S. Reed for the reconstruction of Elmo jWeedon Road and Richard A. Smith for the reconstruction of lMumford Road and payment of legal fees incurred in connection 11with said purchases. 1i The Court continued with consideration of the extension of the rental agreement for office space for the Justice of the ;!Peace Precinct 1. On motion by Commissioner Wilcox, seconded by !Commissioner Norton, the Court voted unanimously to extend the lcurrent lease another two months until a new lease can be ~I prepared. jj The next matter for consideration was a request from i Gifford-Hill & Company, Inc. to allow their customers to haul lleighty thousand pound truck loads of material and for permission I Ito provide the maintenance on a portion of Jones Road from the IlGifford -Hill plantsite entrance thereon north to Leonard Road i ,until the Texas Department of Highways and Public Transportation completes construction of the proposed highway connecting iHighways 21 and 60 or, Gifford-Hill ceases operations at the I I (Jones Road Plant. Commissioner Turner moved to grant the request I and that Gifford Hill be instructed to apply something to the road to keep the dust down. The motion was seconded by lCommissioner Norton. Commissioner Sims asked that authorization be given for one year during which time the County would monitor IGifford-Hill's performance. Commissioner Turner agreed to withdraw his motion. Commissioner Norton withdrew his second. Commissioner Turner moved to waive the load limit regulations and allow Gifford-Hill, Inc. to maintain the above referenced road for a period of one year at which time the agreement could ri%a[-: a r a Ii I l J' u Commissioners' Court meeting January 17, 1989 be extended by the Commissioners' Court if Gifford-Hill performs as agreed. The motion was seconded by Commissioner Norton and carried unanimously. The Court proceeded to consider the change of status of the following employees. At 10:42 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in closed executive session to discuss personnel.
