V0 ~r -10 1• . j i I I 1 3 _ A r Commissioners' Court meeting January 9, 1989 The Court received, considered and approved reports from County and Precinct Officers showing revenues collected and remitted to the County Treasurer. An excerpt from those reports • is attached hereto. The County Judge recognized Chris Kling, who recommended changes to the voting procedure. Mr. Kling explained to the Court that there were a number of problems in the way elections were conducted and suggested that since 1989 was an off year for elections, it would be a good time to implement the changes suggested. He then turned the floor over to Mr. Rodger Lewis, Chairman of the local Republican party, who, reading from a prepared statement, proceeded to list the areas of needed change, those being: 1. Election Judges and Clerks 2. Voter Registration 3. Polling Places and Equipment 4. Absentee Voting 5. Vote Counting • The County Judge thanked Mr. Kling and Mr. Lewis for their recommendations, stating that the court would take them under Iconsideration. C~ The Court next considered approval of the minutes of the Commissioners' Court meetings held December 12, 1988 and December 19, 1988. Commissioner Wilcox moved for approval with the motion being seconded by Commissioner Turner. Commissioners Turner, Wilcox and the County Judge voted 'Aye'. Commissioners Morton and Sims abstained, whereupon the County Judge declared the motion carried for approval the minutes as submitted. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to set the rate for milage reimbursement at $.21 per mile. The Court proceeded to the selection of the Salary Grievance Committee for 1989 in accordance with the law. Klein On motion by Commissioner Sims, seconded by Commissioner Turner, the Court voted unanimously to appoint the legally required elected officials plus the a fore mentioned persons to the Grievance Committee for 1989. Commissioner Turner moved to adopt the same holidays as had been observed in 1988. Commissioner Wilcox, seconded by the motion. Commissioner Sims took exception to the observance of Martin Luther Kings' birthday as a paid holiday, stating that there were a number of other famous people who are not recognized. He further stated that there was a floating holiday that could be used to observe the King's birthday. Commissioner Turner countered saying that it1has been observed for the last two years. In a show of hands, Commissioners Norton, Turner and Wilcox voted "Aye". Commissioner Sims voted "No", whereupon the County Judge declared that the motion carried and the holidays to be observed by Brazos County for 1989 are: January 16, Martin Luther King's Birthday April 21, San Jacinto Day May 29, Memorial Day July 4, independence Day September 4, Labor Day November 23 & 24 Thanksgiving December 25 & 26 Christmas January 1, 1990 New Year One (1) Floating Holiday on motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to acknowledge and approve the assessment of fees by the Second Administrative Judicial Region of Texas in the amount of $3,587.20 and authorized the payment thereof. The Court next considered awarding the following bids: Silver Hill Road Structure and Mumford Road Structure for the 'Road and Bridge Department and the authorization of payment thereof. BIDDERS: 1. Young Brothers, Inc. 5. Lester Rodgers Co. 2. Glenn Fuqua, Inc. 6. Bryan Construction Co. 3. Lilljedahl Bro. Const. 7. Wade Regas Construction 4. DAYCO Construction Co. Holland Winder, County Engineer, recommended Commissioners' Court meeting January 9, 1989 • acceptance of the bid submitted by Young Brothers Inc. in the amount of $71,976 with 90 work days. He further stated that the work on Silver Hill Road would be paid from Road and Bridge General Fund and that work on Mumford Road would be paid from Certificate of Obligation Funds. On motion by Commis- sioner Turner, seconded by Commissioner Sims, the Court voted unanimously to accept the recommendation of the County Engineer and award the contract to Young Brothers, Inc.. A copy of the bid tabulation is attached to and made a part of these minutes. j The Court next considered appointments to the Brazos County 4Historical Commission for the 1989-1990 term. Commissioner Sims jmoved to honor the out going president, Mr. Boone for his Itwenty-two years of service and left the manner of recognition up Ito the discretion of the County Judge. The motion was seconded by Commissioner Wilcox and carried unanimously. Commissioner Sims then moved to appoint the persons whose names were submitted to the Historical Commission. Van Riper Mr. Walter Wilcox The Court next considered a written request from Constable Precinct 2, Johnny Burkhalter for the appointment of two deputy constables for his precinct. Commissioner Turner moved to approve the appointments. Commissioner Sims seconded the motion. Commissioner Norton informed the Court that there was a conflict because the wife of one proposed deputy constable was herself the Justice of the Peace of Precinct 2, that she would have to t disqualify herself from presiding over any case he might bring before the bench. The County Judge asked Commissioners Turner and Sims if they wished to withdraw their motion and second, whereupon they both said yes.- Commissioner Norton then-moved to table consideration until such time as. -the Court could further VnL l r Commissioners' Court meeting January 9, 1989 investigate the request. Homeyer for the reconstruction of Elmo Weedon Road and payment of legal fees incurred in connection with said purchase. On motion by Commissioner Turner, seconded by Commissioner Wilcox, the Court voted unanimously to advertise for bids for a County Depository for the 1989-1990 biennium. The Court next considered adopting a Resolution authorizing application for a grant to support the Brazos County Narcotics Task Force Program that is administered by the District ! Attorney's office. Such grant to be in the total amount of $195,964; $6,375 to be funded by the County, $174,589 to be state funded and $15,000 to be funded from other sources. On motion by the County Judge, seconded by Commissioner Wilcox, the i Court voted unanimously to authorize the County Judge to make application on behalf of Brazos County to the Criminal Justice Division and accept on behalf of Brazos County such grant funds as may be tendered. On motion by Commissioner Wilcox, seconded by Commissioner, , Turner, the Court received, approved and ordered filed as i submitted the Certification of the Juvenile Detention Facility. The County Judge announced that he waived his right to sign pay authorizations for the Road and Bridge Department. On motion by the County Judge, seconded by Commissioner Sims, the Court oted unanimously to approve the waiver. Holland Winder, 11County Engineer, stated that he had reviewed the plat, it appeared to be in order and recommended approval. On motion by :ommissioner Sims, seconded by Commissioner Wilcox, the Court unanimously approved the preliminary plat of Lambert Subdivision Phase I in precinct 3, as presented. The Court proceeded to consider the change of status of the following employees. The County Judge of Brazos County, acting on behalf of Brazos County be authorized to make application to the Criminal Justice Division, Office of the Governor, for grant funds to be used for the apprehension, i detection, and enforcement of the laws pertaining to the Texas Controlled Substances Act and Dangerous Drug Act; and 2. UVVYr;rpp COUNTY OF BRAZOS ern: m --'ar r f A%, • fE !X PTh~u;.T ~A,', We, the undersigned, hereby certify to the Commissioner's Court of Brazos County, Texas, that we have personally inspected the detention faci- lities at the Courthouse located in Bryan, Brazos County, Texas, to deter- mine whether the facility is suitable for the detention of children as pro- vided by Section 51.12(c) of the Texas Family Code. We hereby find that: 1. Children in detention are not detained in or committed to a compartment of a jail in which adults are detained or commit- ted; 2. Children in detention are not permitted contact with adults who are detained or committed to a jail; 3. The detention facility meets the requirements of Article 5115, Revised Civil Statutes of Texas, 1925, as amended, defining "safe and suitable jails"; 4. The detention facility meets the "Standards for Juvenile Detention- Facilities" as required by Section 75.041, Texas Human Resources Code, and as adopted by the Texas Juvenile Probation Commission, effective the 11th day of November, 1986. THEREFORE, the Brazos County Juvenile Detention Center is hereby certified as a suitable facility for children until the next annual onsite inspection due one year from the above personal visit. The Commissioner's Court of Brazos County, Texas, shall be provided copies of said certifica- tion, and the original copy shall be filed with Juvenile Records in the County Clerk's Office.
