1. Report from Extension Service on Judging Contest at the
National Quarterhorse Congress.
2. Approval of the minutes of the meetings held on September 19,
1988, September 22, 1988 and September 26, 1988.
3. Signing of a Proclamation designating November 13-19, 1988
as Brazos Arts Week.
4. Consider and take action on order appointing James A. Amis,
Jr. to sit as Special Judge for County Court at Law No.l.

A special meeting of the Commissioners' Court of Brazos

;County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Monday, November 7, 1988, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Bill J. Cooley, Commissioner of Precinct 1;
I The Court first considered approval of the minutes of the
Commissioners' Court meetings held September 19, 1988, September

The County Judge read aloud a Proclamation proclaiming the
week of November 13 through 19, 1988 as "Brazos Art Weeks. The
(Court joins with the local Arts Council in the effort to make our j
'community aware of the role the arts play in our county. On
imotion by Commissioner Beard, seconded by Commissioner Turner
iIthe Court moved to proclaim the week of November 13 through 19,
111988 as 'Brazos Art Week' throughout Brazos County. The County

Hjudge then presented the signed Proclamation to Ms Waneta Swank,
Irepresenting the local Arts Council.

'I The Court next considered an order appointing James A. Amis,
;I Jr. to sit as Special Judge in County Court at Law I from December
i

1112, 1988 through December 30, 1988 to allow Judge Davis to take
I,
11vacation time. On motion by Commissioner Cooley, seconded by
IllCommissioner Beard, the Court voted unanimously to approve the
I
Order naming James A. Amis, Jr. as Special Judge for County Court
'!at Law I for the dates of December 12, 1988 through December 30,
11980. A full copy of the order is attached to and made a part of
'these minutes.
The Court next considered awarding the following bid:
Bid No 88-456 - Annual Road Sign and Sign Post Contract for j
the Road and Bridge Department
Bidders:
1. Mid-Ohio Markings
2. Champs, Inc.
3. Highway Signs & Paint
4. Price Barracade
5. Roadrunner Traffic Supply
6. SAegent Sowell
7. Texas Department of Corrections
Rebecca Shults, Purchasing Agent, recommended
acceptance of the overall bid submitted by
Mid-Ohio Markings. Items 64, 65, 66 & 71 to
Roadrunner Traffic Supply and item 72 to
SAegent Sowell. On motion by Commissioner
Turner, seconded by Commissioner Beard, the
Court voted unanimously to accept the
recommendation of the Purchasing Agent and
award the overall contract to Mid-Ohio
Markings, items 64, 65, 66 & 71 to Roadrunner
Traffic Supply and item 72 to SAegent Sowell.
A copy of the bid tabulation is attached
hereto.
The Court next considered a Wavier of Competitive Biddin
Requirements as provided in Article 2368a.5, section 4(a)(1) o
Vernon's Annotated Civil Statutes for the hauling of gravel fo
Castenson Road and Edge Schoolhouse Road for the Road and Bridg

Department. This was necessitated due to the unforseen damage to

11 public property. on motion by Commissioner Beard, seconded by
IiCommissioner Turner, the Court voted unanimously to approve the
Waiver of Competitive Bidding Requirements and authorized the
I
payment of $15,934.50 to J. & H. Trucking for the necessary
(material.

On motion by Commissioner Beard, seconded by Commissioner
(Cooley, the Court voted unanimously to table a request by AT&T to
{(place a buried Fiber Optic Cable within the right-of-way of
Democrat Road, Opersteny Road, Andert Road, Carraba Road and Old
Reliance Road in Precinct 3 until such time as the members of the
Court can speak with the contractor.
The Court next considered approval of the final plat of

lCountry Meadow Subdivision located in Precinct 1. The preliminary
(plat had previously been submitted under the name of Hopes Meadow
A
land was approved in Commissioners' Court on October 31, 1988 with
lithe stipulations that the name be changed and that it be stated on

;the plat that all roads were private. Holland Winder, County
Engineer, stated that he had reviewed the plat and it appeared to
be in order. on motion by Commissioner Cooley, seconded by
,Commissioner Beard, the Court unanimously approved the final plat
I
of the Country Meadow Subdivision located in Precinct 1.

The Court next heard from Extension Agent, Jim Mazurkiewicz,
ion the efforts of the Brazos County Horse Judging Team partici
11pating in the Judging Contest at the National Quarterhorse
I
Ii Congress in Columbus, Ohio. The team is made up of Amy Beth
i
((Simpson, Amy Tucker, Matt C. Wood and Aaron Russell. The team
'I placed first in Performance Judging and Reserve Champion Overall
IITeam. The Extension Agent introduced the team coach, Dr. Mike
11IMartin to the Court. Miss Amy Tucker spoke on behalf of the team
•
(thanking the Court for all its support of the 4-H program through
I
the extension offices. She presented the championship trophy to the
Court and the championship plaque that the team won at the American
(Junior Paint Horse Association's national show in Albuquerque, -New
I
(Mexico. Speaking on behalf of the entire Court, the County Judg1
I'llthanked the team for the plaque and trophy and praised the

and their coach.

Court of Brazos County, Texas, convened in Regular Session at the
term of the Court, at the Brazos County Courthouse, in the City
of Bryan, Texas, with the following members present, to-wit:

Among other proceedings had, the following proposed order was
submitted:
"WHEREAS, The Honorable Claude D. Davis, Judge of the County Court
at Law No. 1 of Brazos County, Texas, having made known to the Commissioners
Court of Brazos County, Texas, that on December 12, 13, 14, 15, 16, 190 20,
21, 22, 23, 26, 27, 28, 29, and 30, 1988, he will be absent from the bench
because of vacation leave.
WHEREAS, he has requested the appointment of James A. Amis, Jr. to
sit as Special Judge of the County Court at Law No. 1 of Brazos County,
Texas on the above mentioned dates in all matters that are, or may be,
docketed on the Court's dockets for those days, and to have and exercise all
powers of a Special Judge in relation to matters involved, it is, therefore,
ORDERED, ADJUDGED AND DECREED, Pursuant to authority of Article
30.03, Section 2, Code of Criminal Procedure, that James A. Amis, Jr., a
former Judge of the County Court at Law of Brazos County, Texas, to sit and
hear all matters that are, or may be, docketed on any of the Court's dockets
on the above-mentioned days and shall have and exercise all powers of such
Special Judge in relation to the matters involved;
WHEREAS, the Court having considered the proposed order and deeming
that it should be approved; it is; therefore,
ORDERED, ADJUDGED AND DECREED by the Commissioners Court of Brazos

RE: EXEMPTION FROM COMPETITIVE BIDDING REQU REMM OF
LOCAL GOVERNMENT CODE, SECTION 262.024(x)(1)
Please be advised that on this 7th day of November 1988, at
a Regular Session of Commissioners Court on which the
following members were present:

The Commissioners Court has determined that th a was a need for an
emergency purchase for the hauling of gravel for Castenson Road and Edge
Schoolhouse Road, and hereby grants an exemption from the competitive
bidding requirement for the following invoice: M0027; from the following
vendor: J & H Trucking as an item that must be purchased promptly to
preserve the property of the County, as provided in the Local Government
Code, Section 262.024(x)(1). The court hereby approves payment for said
transportation costs in amount not to exceed $15,934.50.

It has been called to our attention that there has been. an overrun of i
expenses with the referenced hauling company. For your information and use,,
this overrun is due to the fact that when this material was excavated aad
stockpiled at the gravel pit, our operator at the gravel pit inadvertently
excavated through a strata of material that had an excessive amount of clay,
thus producing a plasticity index that was totally unacceptable fdr'
placement on the road bed.
When the material was placed and we commenced setting it up, we realized
that the plasticity index was too great for the safety of the public. We
then had to obtain a predominantly sandy material in order to reduce .;h#
plasticity index to an acceptable number.
