S. Appointment of Presiding Election Judge's in the following
precincts:

6. Consideration of award of bid for furniture for the Brazos
County Courthouse and authorize the payment thereof.
7. Consider extending contract with Young Brothers past Decem-
ber 31, 1988 to allow for job completion.
8. Consider and take action on generator bids.
9. Consider and take action on Supplemental Contractual Agree-
ment between Texas Department of Highways and Public Trans-
portation and Brazos County for right-of-way procurement
for Phase III of Highway 6 expansion.

SPECIAL MEETING
October 17, 1988
A special meeting of the Commissioners' Court of Brazos
:ounty, Texas was held in the Commissioners' Courtroom in the
:ourthouse in Bryan, Brazos County, Texas, beginning at 10:00
t.m. on Monday, October 17, 1988, wif.h the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
-Bill J. Cooley, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Billy E. Beard, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.

The Court next considered approval of the minutes of the

Commissioners' Court meetings held August 22, 1988, August 30,
1988 and September b, 1988. On motion by Commissioner Turner,
seconded by Commissioner Wilcox, the Court voted unanimously to

approve the minutes as submitted.

I The Court next considered Budget Amendment #19, which would

reallocate funds budgeted for the Extension Office, Commissioners
:I
Court and Juvenile Services. On motion by Commissioner Cooley,
seconded by Commissioner Beard, the Court voted unanimously to
approve the budget amendment as submitted, a copy of which is
attached hereto.
II The next matter for consideration by the Court was a written

I equest submitted by County Extension Agent Monty Dozier,
iequesting approval for out of state travel to Columbus, Ohio to

Commissioners' Court meeting October 17, 1988
supervise the four member Brazos County team at the 4-H Horse
Judging Contest during the National Quarterhorse Congress from
(October 27, 1988 to October 30, 1988 and travel to Minneapolis,
;Minnesota to attend a conference on professidnal improvement and
II personal development in the area of youth educational programming
during the week of November 5 through the 11, 1988. On motion by
Commissioner Wilcox., seconded by Commissioner Beard, the Court
voted unanimously to grant the request from the County Extension
;Agent and approved payment of out of state travel expense for Monty
;Dozier.
~I The Court next considered a written request from the 85th
District Court Judge requesting approval for out of state travel
for the bailiff, Victor A. Dittfurth, to attend a seminar on Court
(Security Management November 9, 1988 through November 11, 1988 in
~iDenver, Colorado. On motion by Commissioner Cooley, seconded by
';Commissioner Beard, the Court voted unanimously to grant the
(Ilrequest from the 85th District Court Judge and approved payment of

out of state travel expense for Victor A. Dittfurth.
On motion by Commissioner Beard, seconded by Commissioner
Turner, the Court received, approved and ordered filed as submitted
~Ithe Treasurer's report for September 1988 and the third quarter
~ireport for 1988. A copy of each is attached to and made a part of
;these minutes.
On motion by Commissioner Beard, seconded by Commissioner;

I~Wilcox, the Court voted unanimously to appoint the following people
(Election Judges in their respective voting precincts:

Rebecca Shults, Purchasing Agent, recommended
acceptance of the low bid submitted by Hodges
Business Interiors. On motion by Commis-
sioner Beard, seconded by Commissioner Wilcox,
the Court voted unanimously to accept the
recommendation of the Purchasing Agent and j
II award the contract to Hodges Business
I~ Interiors.
On motion by Commissioner Turner, seconded by Commissioner
,Cooley, the Court voted unanimously to extend the contract with
;Young Brothers past the December 31, 1988 contract period to allow,
for completion of jobs currently under construction.
On motion by Commissioner Turner, seconded by Commissioner,
;Wilcox, the Court voted unanimously to secure the services of a~
(consultant to rewrite the specifications for a backup generator for
the Data Processing Department and rebid the item.
The Court next considered entering into agreement with they
State Department of Highways and Public Transportation for the
purchase of right-of-way from Loop 507 at College Station, South to
the Navasota River. The County's proportion is $564,077.00 which)

Irepresents 108 of the estimated cost of the right-of-way to be

cquired by the State. The State is to acquire all right-of-wa
xcept parcel 84 between highway station 1103+50 and statio
104+80. On motion by Commissioner Turner, seconded b
mmissioner Wilcox, the Court voted unanimously to enter int
agreement with the State Department of Highways and Public

Transportation for the purchase of right-of-way and authorized the
County Judge to execute the Agreement on behalf of Brazos County.
A copy of the Agreement to Contribute Funds is attached hereto.

Beard, the Court voted unanimously to approve the Claims as
A resident of Precinct 3, a Mrs. Herman, asked that the Court
consider her petition signed by one hundred two residents for a;
~dumpster in Precinct 3. She also said that she would like,
1completion of Democrat and Oak Lake Roads which had not been
completed by the promised date of October 1, 1988.
There being no further business to come before the Court, the,
,meeting was adjourned.

BUDGET AMENDMENT(S) FOR THE 1988 BUDGET YEAR
NO. 19
On this the 17th day of October 1988 at a special meeting of the
Commissioners' Court, the following members were present:
R. J. Holmgreen, County Judge, Presiding
Bill J. Cooley, Commissioner, Precinct 11
Walter Wilcox, Commissioner, Precinct 2;
Billy E. Beard, Commissioner, Precinct 3;
Milton Turner, Commissioner, Precinct 4;

The following proceedings were held;
THAT WHEREAS, on October 17, 1988, the Court heard and
approved a budget amendment for the 1988 budget year for Brazos
County, Texas.
WHEREAS, an emergency expenditure is necessary due to grave
public necessity to meet unusual and unforeseen conditions which
could not be reasonably included in the original budget adopted
October 20, 1987, the following amendment(s) to the original are
hereby authorized, as described on the attached 1 page(s).
ADOPTED AND APPROVED this the 17th day of October 1988

This supplemental contractual agreement by and between the State of Texas, acting by and through
the State Department of Highways and Public Transportation, hereinafter called the State,
and Rrazes County, Texas, acting by and through its duly authorized
officials under Commissioners' Court Order dated the day of , 19 ,
hereinafter called the County, shall be effective on the date of approval and execution by and on behalf of
the Slate.
WHEREAS, the State and County entered into contractual agreements(s) and supplemental contractual
agreement(s) for procurement of right of way on the following project on the date(s) indicated:

and, which are made a part of this instrument by reference; and
WHEREAS, the County has requested that they be relieved of the obligation to acquire the necessary right
of way and desires the State to assume the acquisition responsibility; and
WHEREAS, it is mutually desired by the County and the State to modify said original contract(s) and any
supplemental contract(s) implementing the terms and provisions of the original contract(s);
NOW, THEREFORE, in consideration of the foregoing premises and the mutual benefits to be derived
therefrom, the above-described contract(s) are modified hereby to the extent of the manner, mode and
method of the County's obligation to acquire the necessary right of way and receive 9007o reimbursement of
the cost thereof in that the State hereby assumes the obligation to acquire the necessary right of way and the
County shall accomplish its obligation by contributing 10% of the cost of the right of way as hereinafter
described.
The State is to acquire all right of way except that the County shall continue with its present obligations to
acquire the following-described right of way:
Parcels: Parcel 84 between highway station 1103+50 and station 1104+80.

The County shall contribute to the State an amount equal to ten percent (10%) of the cost of the right of
way to be acquit ed by the State and shall transmit to the State with the return of this agreement, executed by
the County, a warrant or check payable to the State Department of Highways and Public Transportation in
the amount of Fi ve Hundred Sixty Four Thousand Seventy Seven and no/100 Dollars
(S 564,077.00 which represents 10% of the estimated cost of the right of way; however, if it is
found that this amount is insufficient to pay the County's obligation, then the County, upon request of the
State, will forthwith supplement this amount in such amount as requested by the State. Upon completion of
the project and in the event the amount as paid is more than 1007o of the cost of the right of way, then any
excess amount will be returned to the County. Cost of the right of way acquired by the State shall mean the
total value of compensation to owners for their property interests either by negotiation or eminent domain.
This supplemental contractual agreement is approved and executed by and on behalf of the State on the
date shown herei,iafter.
