A special meeting of the Commissioners' Court of Brazos
County,•Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
a.m. on Tuesday, September 6, 1988, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Bill J. Cooley, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Billy E. Beard, Commissioner of Precinct 3, Absent;
Milton Turner, Commissioner of Precinct 4;

The Court next considered approval of the minutes of the
lCommissioners' Court meetings held July 11, 1988 July 18, 1988,
land July 25, 1988. On motion by Commissioner Turner, seconded by
(Commissioner Cooley, the Court voted unanimously to approve the
minutes as submitted.
The Court next considered Budget Amendment 118, which would
increase the budget of the Building Maintenance department by
$24,000.00, the Auditor's Department by $1,215.00 and thus
increase the General Fund Budget by $25,215.00: On motion by
Commissioner Turner, seconded by Commissioner Cooley, the Court
voted unanimously to approve the budget'amendment as submitted, a
copy of which is attached hereto. 1 +

The next matter for consideration by the Court was a

submission to the Justice Department concerning alternate '
absentee voting locations in Brazos County. The Court had
received letters indicating a need and desire to establish branch
absentee polling places for the upcoming election. It was
stressed in these letters that the location of the Courthouse
posed problems for many of the residents of the county and each
offered alternate sites for consideration. Mr. Rodqer Lewis.
Chairman of the local Republican Party, addressed the Court
concerning the placement of a branch absentee box at Post Oak
Mall and one at Texas A&M University. Mr. Carey Cauley,

representative of the NAACP, voiced his desire to see branch `

locations placed at the Santa Teresa Church, the Earl Graham VFW
Post and in Edge Community. Commissioner Turner moved to not
establish another polling place anywhere in the county. The 1
motion died for lack of a second. Mr. Cauley stressed that if
the polling places were placed where they could dilute the
minority vote, then the NAACP would protest it. Mr. Jesse
Flores, representative of the Mexican American Democrats stated
that a polling place on campus would convenience only the
students. He went on to say that his group would protest any
submission to the Justice Department for additional absentee
polling places. Mr. Lewis, wishing to clarify his position,
stated that he was not requesting a location that would serve
only a select group of voters, but one that would serve the needs
of the voters who work for the single largest employer in the
county. Mr. Ron Gay, Chairman of the local Democratic Party,
reminded the Court that the state legislature had removed the
impediments to voting absentee. He went on to suggest that the
Brazos Center, with its central location and ample parking would
be an ideal location for absentee voting. He further noted that
fit might not be cost effective to maintain several branch loca-
tions. Commissioner Cooley voiced strong approval for the

recommendation and then moved to submit to the Justice Depart-
ment a submittal to move the absentee polling place to the
Brazos Center. The motion was seconded by Commissioner Wilcox.

Commissioners Court meeting September 6, 1988
Commissioners Cooley and Wilcox voted "Aye". Commissioner
Turner voted "No" whereupon the County Judge declared the motion
carried. A copy of the 'order Relocating the Place for Absentee
Voting by Personal Appearance" is attached.
The Court next considered the request by Wixon Water Supply
to install a water line within the right-of-way of Linda Lane in
Precinct 3. On motion by Commissioner Cooley, seconded by
Commissioner Wilcox, the Court voted unanimously to approve the
request of Wixon Water Supply and authorized the installation
subject to the approval of the County Engineer. A copy of the
request is attached hereto.
The next matter for consideration by the Court was a pro-
posal submitted by the Purchasing Agent for the purchase of new
copiers for the Justice of the Peace Offices. The Purchasing
Agent cited high maintenance agreement costs, high repair cost
that are not covered by the agreement and the poor quality of the
copies. On motion by the County Judge, seconded by Commissioner
Cooley, the Court voted unanimously to approve the proposal of
the Purchasing Agent and purchase four copiers for the Justice of
the Peace offices of Precinct 7-1, Precinct 2, Precinct 3 and
Precinct 5 at a total cost of $8,896.00.
The Court next considered a resolution approving the 1988-
1989 budget for the Brazos County Emergency Communications
District 911 and providing an effective date. On motion by the
County Judge, seconded by Commissioner Turner, the Court unani-
mously approved the 1988-1989 budget for the Brazos County
Emergency Communications District 911 and set the effective date
for October 1, 1988. A copy of the Resolution is attached
hereto.

Cooley, the Court voted unanimously to approve the Claims as

At 10:20 a.m. the County Judge announced the meeting closed
o the public so that the Court could meet in closed executive
isession to discuss land acquisition.
At 10:40 a.m. the County Judge announced the meeting open to
the public.
On motion by Commissioner Cooley, seconded by Commissioner
(Turner, the Court voted unanimously to pay $2,600.00 to Adele
Keith Smith for her property for right of way acquisition along
Elmo Weedon Road.

the meeting was adjourned.

The following proceedings were held:
THAT WHEREAS, on September 6, 1988, the Court heard and
approved a budget amendment for the 1988 budget year for Brazos
County, Texas.
WHEREAS, an emergency expenditure is necessary due to grave
public necessity to meet unusual and unforeseen conditions which
could not be reasonably included in the original budget adopted
October 20, 1987, the following amendment(s) to the original are
hereby authorized, as described on the attached 1 page(s).

ORDER RELOCATING THE PLACE FOR ABSENTEE VOTING IN PERSON
FOR BRAEOS COUNTY, TEXAS
WHEREAS, the Commissioners Court of Brazos County,
Texas has been petitioned to establish branch absentee polling
places in various locations in Brazos County; and
WHEREAS, the Republican Party of Brazos County has
requested that a branch absentee polling place be established on
the Texas A&M Campus and a branch absentee polling place be
established in the Post Oak Mall on the Highway 6 By-pass in
College Station; and
WHEREAS, Fleeta A. Fannett, a citizen has requested
that a branch absentee polling place be established in the
Cawthorn Community in south Brazos County; and
WHEREAS, Carey Cauley, President of the N.A.A.C.P. has
requested that branch absentee polling places be established at
St. Theresa's Church on Lucky Street in Bryan, at Earl Graham
American Legion Post on East Highway 21, and in the Edge
Community in north Brazos County; and
WHEREAS, Jesse Flores, representing the Mexican
Americans stated that he would protest the establishment of
branch polling places that would dilute the minority vote; and
WHEREAS, Ron Gay, Chairman of the Democratic Party of
Brazos County recommended that the absentee polling place be
moved from the Brazos County Courthouse to the Brazos Center at
3232 Briarcrest Drive in Bryan in lieu of establishing several
branch locations due to the cos! of manning more than one
location; and
WHEREAS, the Commissioners Court is desirous of
treating all voters of Brazos County equally; and

WHEREAS, the Commissioners Court is desirous in
increasing voter participation and in the convenience to all
voters who wish to vote absentee; Now therefore
BE IT ORDERED ADJUDGED AND DECREED BY THE COMMISSIONERS
COURT OF BRA20S COUNTY, TEXAS, that submission be made to the
Assistant Attorney General, Civil Rights Division, Voting
Section, Department of Justice, Washington, D. C. for
authorization to establish a branch absentee polling at the
Brazos Center, 3232 Briarcrest Drive, Bryan, Texas, pursuant to
Section 5 of the Voting Rights Act; and
BE IT FURTHER ORDERED that upon authorization by the
Justice Department to establish an absentee polling place in the
Brazos Center at 3232 Briarcrest Drive, Bryan, Texas that this
document becomes the final order for the establishment of the
branch absentee polling place

NOTICE OF PROPOSED INSTALLATION IN COUNTY RIGHT-OF-WAY
To The Commissioners' Court of Brazos County, Texas

Formal notice is hereby given that Wixon Water Supply Corp.I Applicant,
proposes to place a water line within the ght-of-way
of Linda Lane n Brazos County, Texas as follows:

_.X. Installation parlleling the roadway a distance of 330 feet.
The location or description of the proposed installation is more fully
shown by 2 copies of the drawings attached to this notice.
I understand and agree that:
1. The Commissioner of the Precinct in which the right-of-way lies must
be notified prior to the beginning of construction in order that
the Commissioner might be on hand to designate the actual location
of the installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the Commissioner
in which the roadway or right-of-way lies.
3. That BRAZOS COUNTY reserves the right to require Applicant to re-
locate or lower any such line at no cost to BRAZOS COUNTY, should
same become necessary due to widening or lowering, or other alter-
ation of the roadway or right-of-way.
4. That BRAZOS COUNTY is in no way responsible for any damage that migh
occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right
of-way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (21) below
the center of the roadway.
7. That all roads be bored to forty feet (401) on either side of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barricaded during construction period.
9. That•the normal charge established by the Commissioners' Court is
$500 per crossing and/or $25 minimum per rod when paralleling the
roadway.
Construction of this line will begin on or after the 29thday of
August , 1988 .

A RESOLUTION APPROVING THE BUDGET FOR THE BRAZOS COUNTY EMERGENCY
COMMUNICATIONS DISTRICT 911 (THE "DISTRICT")i AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Laws of the State of Texas provide for
interlocal governmental agreements and'actions to benefit the
citizensi and .
WHEREAS, -the voters of Brazos County have approved the
establishment of the Brazos County Emergency Communications
District in accordance with Article 14329 of the laws of the
State of,Texas by election held November 3, 19871 and

WHEREAS, the Board of Managers of the District in lawful
meeting held August 249 1988 approved and adopted the budget for
the District for the fiscal year 1988-89; and
WHEREAS. Article 143e (e) (7) (b)"requires the approval of r
the District budget by a majority of the participating
i jurisdictions in the District as well as by the County
Commissioner's Court in the District) and
WHEREASt the undersigned jurisdictions have in public
meeting approved the annual budget for the District; NOW,

BE IT RESOLVED BY THE BRAZOS COUNTY COMMISSIONERS COURT, THE
CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS. THE CITY
COUNCIL OF THE CITY OF WIXON VALLEYS TEXAS, AND THE CITY COUNCIL
OF THE CITY OF BRYAN, TEXAS THAT.
1.
The respective county and cities individually and jointly
hereby approve the annual budget of the Brazos County Emergency
Communications District 9-1-1 as provided for by State law.
2.
This resolution shall be effective for all purposes October
1, 1988 for the governmental units adopting and passing it as
reflected below. '
