A special meeting of the Commissioners' 'Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
(Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
;ia.m. on Monday, August 15, 1988, with the following members of

The first matter for consideration by the Court was a `
,written request submitted by the District Attorney requesting
approval for out of state travel for Assistant District Attorney
'Deena McConnell. Ms. McConnell would be traveling to Reno,
Nevada to attend a 'Trial Advocacy' seminar during the week of
~ISeptember 25 through the 29, 1988. On motion by the County
Judge, seconded by Commissioner Turner, the Court voted
;unanimously to grant the request from the District Attorney and

The Court next considered awarding the following bids:
Bid No. 88=430 - Access Flooring & Air Conditioner for
Computer Room '
Bids were received from Drew Woods and
Unisys. Rebecca Shults, Purchasing Agent,
recommended acceptance of the low bid
submitted by Unisys which includes
installation. On motion by Commissioner
Turner, seconded by Commissioner Beard, the
Court voted unanimously to accept the
recommendation of the Purchasing Agent and
awarded the contract to Unisys. A copy of
the bid tabulation is attached hereto and
made a part of the minutes.

acceptance of the low bid submitted by
Hammond Pest Control. On motion by Commis-
sioner Turner, seconded by Commissioner
Cooley, the Court voted unanimously to accept
the recommendation of the Purchasing Agent
and awarded the contract to Hammond Pest
Control.
The Court next considered the relocation of election polling

places in precinct 10 and in precinct 16. The current location
!of voting precinct 10 is the College Station Police Station.

,The Commissioners' Court has been notified by the City of College
'Station that the conducting of elections within the police
(station posses problems with security. The current location for
,voting precinct 16 is in Bowie Elementary School. The building
Icannot be made to comply with the handicapped regulations. On
motion by Commissioner Cooley, seconded by Commissioner Wilcox,
the Court voted unanimously to adopt the Order permanently
~are locating the precinct 10 polling place in the Public Works
h ouse at 2613 Texas Avenue, College Station and that the
(polling place for voting precinct be permanently located in the
Brazos County Courthouse Annex located at 27th and Washington

Contractual Agreement between the Texas Department of Highways
land Public Transportation and Brazos County for procurement of !
right-of-way on Highway 6 South. Brazos County has requested
that they be relieved of the obligation to acquire the necessary
right-of-way and desires the state to assume the acquisition ,
responsibility. On motion by Commissioner Cooley, seconded by
(Commissioner Beard, the Court voted unanimously to approve the i
1contract and authorized the County Judge to execute the contract

Streets, Bryan, Texas and to adopt the current city limit lines
of the cities of Bryan and College Station as the current
boundary lines of voting precincts which bare that description. i

Commissioners' Court meeting August 15, 1988
Beard, the Court voted unanimously, to approve the Claims as
submitted.
At 10:15 a.m. the County Judge announced the meeting closed
to the public so that the Court could meet in closed executive
session to discuss personnel and land acquisition.
At 10:40 a.m. the County Judge announced the meeting open to
the public.
On motion by Commissioner Turner, seconded by Commissioner
Beard, the Court voted unanimously to approve the change of
status of Assistant District Attorney, Jim Noble to be employed
at a pay group 15 step 3. The County Judge announced that no
action would be taken on the land acquisition. The County Judge
asked the media to make the public aware that Brazos County is
interested in purchasing approximately 50 acres of land on which

AND

ADOPTION OF THE CURRENT CITY LIMIT LINES OF.THE
CITIES OF BRYAN AND COLLEGE STATION
WHEREAS, there exists at the present time two (2)
certain polling places which can no longer be used for the

purpose of conducting elections; and i
WHEREAS, the polling place for voting precinct 10 is
located in the College Station Police Station; and
WHEREAS, the Commissioners Court has been notified by
the City of College Station that the conducting of elections
i
within the police station would present a problem with security;
and
'
WHEREAS, the Commissioners Court is desirous of
permanently relocating the polling place of voting precinct 10 in
the Public Works Warehouse of the City of College Station which {
is approximately one city block east of the College Station j
Police Station; and
WHEREAS, the polling place for voting precinct 16 is
located in Bowie Elementary School; and
WHEREAS, the building cannot be made to comply with the

handicapped regulations; and
WHEREAS, the Commissioners Court is desirous of
permanently relocating the polling place of voting precinct 16
approximately eight blocks east of the school in a building owned
by Brazos County known as the Brazos County Courthouse Annex,
located at 27 and Washington Streets; and
WHEREAS, the city limit lines of the City of College
Station and the City of Bryan form the boundary lines of various
voting precincts; and
WHEREAS, in the event of annexation of certain property

by the City of Bryan and the City of College Station the
Commissioners Court is desirous of adopting the current city
limit lines of the City of Bryan and College Station as the
current boundary lines of the voting precincts which bare that
description; Now therefore
BE IT ORDERED ADJUDGED AND DECREED BY THE COMMISSIONERS
COURT OF BRAZOS COUNTY, TEXAS, that the polling place for voting
precinct 10 be and is, permanently located in the College Station
Public Works Warehouse at 2613 Texas, Avenue, College Station and
that the polling place for voting precinct 16 be and is,
permanently located in the Brazos County Courthouse Annex located
at 27th and Washington Streets, Bryan, Texas, and that the
current City limit lines are hereby adopted as the current
boundary lines of the voting precincts which bare that reference
effective this the 15th day of August, 1988.

Supplemental Contractual Agreement

Right of Way Procurement

This supplemental contractual agreement by and between the State of Texas, acting by and through
the State Department of Highways and Public Transportation, hereinafter called the State.
and Reams County. Texas, acting by and through its duly authorized
officials under Commissioners' Court Order dated the 49,, - day of , 19_J ,
hereinafter called the County, shall be effective on the date of approval and exe ution by and on behalf of
the State.
WHEREAS, the State and County entered into contractual agreements(s) and supplemental contractual
agreement(s) for procurement of right of way on the following project on the date(s) indicated:

and, which are made a part of this instrument by reference; and
WHEREAS, the County has requested that they be relieved of the obligation to acquire the necessary right
of way and desires the State to assume the acquisition responsibility; and
WHEREAS, it is mutually desired by the County and the State to modify said original contract(s) and any
supplemental contract(s) implementing the terms and provisions of the original contract(s);
NOW, THEREFORE, in consideration of the foregoing premises and the mutual benefits to be derived
therefrom, the above-described contract(s) are modified hereby to the extent of the manner, mode and
method of the County's obligation to acquire the necessary right of way and receive 90016 reimbursement of
the cost thereof in that the State hereby assumes the obligation to acquire the necessary right of way and the
County shall accomplish its obligation by contributing 10% of the cost of the right of w9y as hereinafter
described.
The State is to acquire all right of way except that the County shall continue with its present obligations to
acquire the following-described right of way:

The County shall contribute to the State an amount equal to ten percent (1001a) of the cost of the right of
way to be acquired by the State and shall transmit to the State with the return of this agreement, executed by
the County, a warrant or check payable to the State Department of Highways and Public Transportation in
theamountof One Hundred Fifty Thousand and no/100 Dollars
(S 150.000.00 which represents 10% of the estimated cost of the right of way; however, if it is
found that this amount is insufficient to pay the County's obligation, then the County, upon request of the
State, will forthwith supplement this amount in such amount as requested by the State. Upon completion of
the project and in the event the amount as paid is more than 10016 of the cost of the right of way, then any
excess amount will be returned to the County. Cost of the right of way acquired by the State shall mean the
total value of compensation to owners for their property interests either by negotiation or eminent domain.
This supplemental contractual agreement is approved and executed by and on behalf of the State on the
date shown hereinafter.
