Consideration of award of the Relocation of Wixon Water Lines at Elmo Weedon Road in Precinct 3 and authorize the payment thereof. 8. Consider and take action on personnel change of status. 9. Adjourn . j v~ 4 1 y V0 ,N I COMMISSIONERS' COURT REGULAR MEETING AUGUST 8, 1988 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, August 8, 1988, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4, Absent; Frank Boriskie, County Clerk. Group The Court received, approved and ordered filed as submitted lithe following reports for July 1988: 11 Jim Mazurkiewicz, County Extension Agent Carolyn Nobles, County Extension Agent; Betsy Harkey, County Extension Agent; Monty Dozier, County Extension Agent. ' The Court received, considered and approved reports from County and Precinct Officers showing revenues collected and remitted to the County Treasurer. An excerpt from those reports is attached hereto. The Court first considered approval of the minutes of the (Commissioners' Court meetings held June 27, 1988. On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court voted unanimously to Approve the minutes as submitted. On motion by Commissioner Beard,- seconded by Commissioner Wilcox, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered approval of the plat of the resubdivision of 10.54 acres of reserve tract 1, as it appears on the original plat of Pelican's Point Cove Nantucket Phase One. Holland Winder, County Engineer, stated that it had appeared as open space on the original plat. On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court unanimously approved the plat of the resubdivision of reserve tract 1 of the plat.of Pelican's Point Cove Nantucket Phase One. The Court next considered action on a court order from the District Judges regarding the salary of the County Auditor. The County Judge moved to acknowledge the Order and to increase ithe salary of the County Auditor to $36,422.00 annually. The ;motion was seconded by Commissioner Cooley, with Commissioners IiBeard, Cooley and Turner voting "Aye". Commissioner Wilcox ,Ilvoting "No" whereupon the County Treasurer was instructed to I!issue the payroll checks of the County Auditor in accordance to !the Order of the District Court. A copy the Order is attached i. hereto. j Consideration of amendments to the health insurance policy i Iwas postponed until Wednesday August 10, 1988 at 10:00 a.m.. I The County Judge laid before the Court letters from the iBrazos Valley Development Council as notification of the 1 expiration of the terms of office of Helen Chavarria and Anderson Jones as members of the Board of Directors of the Brazos Valley Development Council. The County Judge recommended that Helen Chavarria and Anderson Jones be reappointed to the Board. WEDNESDAY, AUGUST 10, 1988 10:00 A.M. The County Judge reconvened the meeting at 10:00 a.m. on Wednesday August 10, 1988 with Commissioners Beard and Turner absent. The Court proceeded to consider amendments to the group health insurance plan. I. Exclusion of all treatment of mental illness during hospital confinement in a psychiatric day treatment facility. FAIRCHILD X TEXAS (85TH, 272ND, AND BRAZOS COUNTY AUDITOR X 361ST JUDICIAL DISTRICTS) ORDER TO COMMISSIONERS COURT OF BRAZOS COUNTY TEXAS On this the S*vk- day of 1988, the District Courts of Brazos County, Texas (the District Courts) considered the matter of compensation of Sharon L. Fairchild, Brazos County Auditor (the Auditor). On the 19th day of May, 1988, the District Courts issued an order pursuant to Section 152.031, Texas Local Government Code, setting the annual salary of the Auditor at the sum of $36,422.00, effective May 23, 1988, to be paid monthly in equal installments as provided by law. It was and is the intent of the District Courts that beginning May 23, 1988 the Auditor was to be paid on each and every regular pay day for the remainder of 1988 an amount equal to the annual salary stated above, divided by the number of pay periods (26) set for employees of Brazos County. Said order was submitted to the Commissioners Court of Brazos County (the Commissioners Court) in the manner provided by law. On June 27, 1988, the Commissioners Court considered the matter of the above-described order. County Judge Richard Holmgreen and County Commissioner Bill Cooley attempted to obey the District Courts' lawful order by voting in favor of approving said order and authorizing the County Treasurer to disburse the necessary funds for the payment of the ordered salary. County Commissioners Walter Wilcox, Milton Turner, and Billy Beard willfully disobeyed the District Courts' lawful order by voting against approving said order and against authorizing the County Treasurer to act in accordance with it. The 'District Courts find that there is no alternative to cause the implementation of the District Courts' lawful order other than to issue the following additional order: IT IS THEREFORE ORDERED that the Commissioners Court of Brazos Co Commissioner Bill Cooley, 8~'s~B8 I Texas, and in particular County Judge Richard Holmgreen,/ Commissioner W y, r 1_'T/& Wilcox, Commissioner Milton Turner, and Commissioner Billy Beard, order or direct through a Commissioners Court order or directive filed in the minutes of the Commissioners Court, that the Treasurer of Brazos County (1) promptly issue a check to the Auditor in an amount equal to the payments that should 1 have been made to the Auditor pursuant to the District Court's May 19, 1988 order, beginning May 23, 1988, less the amounts that have in fact been paid to the Auditor from that date, and (2) thereafter issue regular payroll checks to the Auditor in accordance with the District Courts' order of May 1 19, 1988, until further order of the District Courts. 1 1 IT IS FURTHER ORDERED that the above named County Judge and County , Commissioners of Brazos County, Texas, comply with this order forthwith but I in no event later than Monday, August 15, 1988. ; Signed this 'ILA day of August, 1988.
