SPECIAL MEETING
APRIL 4, 1988
A special meeting of the Commissioners' Court of Brazos
ounty, Texas was held in the Commissioners' Courtroom in the
ourthouse in Bryan, Brazos County, Texas, beginning at 10:00
.m. on Monday, April 4, 1988, with the following members of the
Court present:
R. J. Holmgreen, County Judge, Presidingi
Bill J. Cooley, Commissioner of Precinct 11
Walter Wilcox, Commissioner of Precinct 21
Billy E. Beard, Commissioner of Precinct 31
Milton Turner, Commissioner of Precinct 41

Mr. Jim Mazurkiewicz, County Extension Agent did not appear
before the Court due to an unscheduled conflict.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held March 21, 1988 and March 24,
988. On motion by Commissioner Beard, seconded by Commissioner
burner, the Court voted unanimously to approve the minutes as
~ubmitted.
The Court next considered Budget Amendment #7, which would
orrect a clerical error on Budget Amendment #1 for funds
udgeted for the District Attorney's Department. On motion by
ommissioner Turner, seconded by Commissioner Beard, the Court
voted unanimously to approve the budget amendment as submitted, a
opy of which is attached hereto.
The Court next considered entering into agreement with the
tate Department of Highways and Public Transportation for the
urchase of right-of-way on State Highway 21 West from the Little

Rebecca Shults, Purchasing Agent informed the
Court that Central Texas Word Processing was
the low bidder on the IBM PS/2. She went on
to say that she had discussed this with Mr.
Bob Odstracil, of the State Department of
Highways and Public Transportation and that
it was his recommendation to award the
contract to CTWP. On motion by Commissioner
Turner, seconded by Commissioner Beard, the
Court voted unanimously to follow the
recommendations of the Purchasing Agent and
Mr. Odstracil and award the contract to CTWP.
The Court next considered awarding the following bids:

both the washer and dryer. All though they

interchangeable with the models currently in
use. On motion by Commissioner Beard,
seconded by Commissioner Turner, the Court
voted unanimously to accept the recommend-
ation of the Purchasing Agent and award the

motion by Commissioner Turner, seconded by
Commissioner Beard, the Court voted unani-
mously to accept the recommendation of the
Purchasing Agent and award the contract to

items #1, 31 4, 5, 6, & 7.

THAT WHEREAS, on April 4, 1988, the Court heard and approved

could not be reasonably included in the original budget adopted

This Agreement by and between the State of Texas, acting by and through the State Department of Highways
and Public Transportation, hereinafter called the State, and Brazos
County, Texas, acting by and through its duly authorized officials under Commissioners' Court Order dated
the 4th day of April , 19 88 , hereinafter called the County, shall be effective on the
date of approval and execution by and on behalf of the State.
WHEREAS, the State had requested the County to enter into a contractual agreement and acquire right of
way on the following project:

WHEREAS, the County has now requested that the State assume responsibility for acquisition of all
necessary right of way; and
WHEREAS, the County desires to voluntarily contribute to the State funds, equal to ten percent (10%) of the
cost of the right of way, for the proper development and construction of the State Highway System;
NOW, THEREFORE, in consideration of the foregoing premises and the mutual benefits to be derived
therefrom, the County shall contribute to the State an amount equal to ten percent (10%) of the cost of the
right of way to be acquired by the State and shall transmit to the State with the return of this agreement,
executed by the County, a warrant or check payable to the State Department of Highways and Public
Transportation in the amount of Twenty Thousand and no/100 Dollars
20.000.00 which represents 10% of the estimated cost of the right of way; however, if it is
found that this amount is insufficient to pay the County's obligation, then the County, upon request of the
State, will forthwith supplement this amount in such amount as requested by the State. Upon completion of
the project and in the event the amount as paid is more than 10% of the cost of the right of way, then any
excess amount will be returned to the County. Cost of the right of way acquired by the State shall mean the
total value of compensation to owners for their property Interests either by negotiation or eminent domain.
This agreement is approved and executed by and on behalf of the State on the date shown hereinafter.
