Adjourn • S 't t i s V ®L 4/ __._PAG 9 I V® 46 f COMMISSIONERS' COURT SPECIAL MEETING MARCH 28, 1988 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, March 28, 1988, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3,; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The first matter before the Court was consideration of approval of the minutes of the Commissioners' Court meeting held arch 14, 1988. On motion by Commissioner Turner, seconded by 4 ommissioner Wilcox, the Court voted unanimously to approve the inutes as submitted. The Court next considered Budget Amendment #6 , which would eallocate funds budgeted for the office of Constable Precinct 7. n motion by Commissioner Beard, seconded by Commissioner Cooley, he Court voted unanimously to approve the budget amendment as ubmitted, a copy of which is attached hereto. On motion by Commissioner Turner, seconded by Commissioner ooley, the Court voted unanimously to reappoint Don Ladewig and A a, i I r i t 1 4• I' t 5 u ~J yt I Tom Sistrunk, for a two year term to the Brazos County Recrea- tional Facilities Advisory Committee. The Court next heard from County Attorney, Jim Kuboviak and Lecn Bawcom, representing the Mental Health Mental Retardation Organization. Mr. Kuboviak stated he was seeking assistance in the implementation of a new program for the handling of mentally disturbed persons in Brazos County. He presented an overview of the current procedure for handling patients which includes transportation, by Sheriff's Deputies, back and forth from the Austin State Hospital or Rusk State Hospital for hearings, screening etc. In the new program, the Mental Health Mental Retardation Organization would enter into contract with Greenleaf Hospital for the local control and treatment of non-violent mental health patients. This would include processing, screening, transportation, treatment and follow up of nonviolent mental health patients. In addition, the new plan by the Mental Health Mental Retardation organization would include not only Brazos County patients but those of the seven county region currently being serviced by the local MHMR. All hearings could be held at Greenleaf Hospital instead of the Courthouse. This would necessitate the appointment of a Justice of the Peace to act as referee, thus alleviating the overcrowding of the Brazos County Courts at Law. Mr. Kuboviak requested authorization to hire a Mental Health Clerk for an annual salary of approximately ($12,000.00. Monies to be funded from Court Administration/Court Costs Mental Cases. It was suggested that the other counties to be serviced by this program would be billed a legal fee of $200 to $250.00 per case with the funds being deposited in a special account for supplementing the salaries of the assistant County Attorneys that handled the cases. Commissioner Wilcox moved for approval to proceed pending contract acceptance from the other six counties that would be participating in the plan. I C s II III i i { VC Commissioners' Court meeting March, 28, 1988 The Court next considered adopting a Resolution authorizing application to the State Criminal Justice Division for a grant to support the Brazos County Rape Crisis Center. Such grant to be in the total amount of $57,052; with $14,915 being funded by the State and $42,137 to be funded from other grants. No County funds support this grant. On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court voted unanimously to authorize the County Judge to make application on behalf of Brazos County to the Criminal Justice Division and accept on behalf of Brazos County such grant funds as may be tendered. A copy of the resolution is attached hereto. The Court next considered a proposed increase in fees for certain public health services, in particular those collected for the inspection of septic tank/leaching field sites and percolation tests. The increase is necessary to cover the complete cost of the performance and administration of the tests. Brazos County currently charges the following rates: CURRENT PROPOSED License Residential $25.00 $ 75.00 Commercial $25.00 $100.00 Percolation Test (optional) $25.00 $ 50.00 Relicensing (every 5 years) $25.00 $ 25.00 Reinspection (used in Loan approval etc.) $10.00 $ 25.00 Commissioner Beard moved to adopt the proposed fee schedule, the motion was seconded by Commissioner Turner. Commissioners Beard, Cooley and Turner voted 'Aye'. Commissioner Wilcox voted 'No', whereupon the County Judge declared the motion carried. The Court next considered adopting a Resolution authorizing application for a grant to support Community Crime Prevention existing within the Brazos County Sheriff's Department. Such grant to be in the total amount of $38,007; fifty percent (508) or $19,006.00 to be funded by the County, fifty percent (508) or $19,001.00 to be state funded. On motion by Commissioner Beard, seconded by ommissioner Turner, the Court voted unanimously to properly sign nd stripe the parking lot so that illegally parked cars could be owed away. Commissioner Cooley asked the status of the new ,arking lot. The County Engineer informed the Court that they rere in. the process of trying to close an alley and design the ,ot to show cars exiting on to 27th street. He went on to say :hat they had encountered some opposition from Richard Smith to :he closing of the alley but that they were negotiating the latter. Commissioner Turner moved to select Emmett Trant and kssociates as Architects for the new minimum security facility to )e located on the property on Highway 21 West. The motion was seconded by Commissioner Wilcox. Commissioners Turner, Wilcox and Cooley voted 'Aye'. Commissioner Beard voted "No", whereupon the County Judge declared the motion carried. W ..i A Y. ri A RESOLUTION AUTHORIZING APPLICATION FOR GRANT TO SUPPORT BRAZOS COUNTY RAPE CRISIS CENTER WHEREAS, the Criminal Justice Division, Office of the Governor, has indicated, that metropolitan areas of population over 50,000 should have a rape crisis center and has thereby supported such; and WHEREAS, among the several programs included in the 1989 Criminal Juatice•Plan for Texas is one which provides crisis intervention, refer- rals and support services to adult and juvenile crime victims, which in- cludes sexual assault victims; and - WHEREAS, improved reporting of sexual assaults in recent years has been attributed to increased public awareness of the seriousness of the crime and to the assistance offered -to rape victims in Brazos County; and WHEREAS, unlike the victims of other crimes, rape victims may be re- luctant to report the offense to the police because of embarrassment, the fear of social stigma and anxiety over the rigors of a lengthy investiga- v1111G _ ~ ~yny. t~}...t► tion and trial, and the Brazos County Rape Crisis Center offers suppori ,U:;;,,,services to these victims; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONS S' CO T OF BRAZOS •lr•• COUNTY, TEXAS, at its meeting on the. day of . 1988, thats - - 1.
