COMMISSIONERS' COURT SPECIAL MEETING MARCH 8, 1988 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday, March 8, 1988, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The following citizens and officials were in attendance: Carol Snedeker Admin. Winder County Engineer Sandie Walker Treasurer Julia Stevenson Deputy Treasurer Travis Nelson District Clerk Mary Ann Ward County Clerk's Office Henry Windham Brazos County Resident Ramiro Quintero Brazos County Resident Phillis Golden Nelson BV Contract Procurement Office The Court first considered approval of the minutes of the ommissioners' Court meetings held February 15, 1988, February ~2, 1988 and February 29, 1988. On motion by Commissioner urner, seconded by Commissioner Cooley, the Court voted nanimously to approve the minutes as submitted. The Court next considered Budget Amendment #5, which would eallocate funds budgeted for the Treasurer's Office. On motion y Commissioner Beard, seconded by Commissioner Wilcox, the Court voted unanimously to approve the budget amendment as submitted, a opy of which is attached hereto. The Court next considered soliciting bids for the demoli- ion and cleanup of the old Road and Bridge facility on Martin uther King Street. Commissioner Wilcox opposed this move iting the need to finish the site plan for the new facility. Commissioner Cooley argued that the excess materials could e moved to the new facility and cleanup operations begun on the ld facility. He went on to say that this had been delayed long nough. Commissioner Beard moved to proceed with the advertise- ent for bids. Commissioner Cooley seconded the motion. In a how of hands Commissioners Beard, Turner and Cooley voted 'Aye'. ommissioner Wilcox and the County Judge voted 'No", where upon he County Judge declared the motion carried., The next matter to be considered by the Court was author- zation to proceed with the remodeling of the new Road and Bridge acility on Highway 21 West. Holland Winder, County Engineer, nformed the Court that an in-house estimate had established the :ost to be $35,000.00 based on 3156 square feet of space. The ;ngineer went on to say that they had cut some footage out of the ,stimate and pared the cost down to approximately $32,000.00. ;ommissioner Beard moved to proceed to advertise for outside bids .or the remodeling. Commissioner Cooley seconded the motion. In i show of hands Commissioners Beard, Cooley and Turner voted 'Aye'. Commissioner Wilcox voted •Now, whereupon the County Judge declared the motion carried. The Court next considered the request from Brushy Water Supply Corporation to install a waterline across the right-of- ,ray of River Road in two separate locations in Precinct 4. On notion by Commissioner Turner, seconded by Commissioner Beard, the Court voted unanimously to approve the request from Brushy Water Supply Corporation and authorized the installation. A copy of the request is attached hereto. The Court next considered entering into an Interlocal kgreement pursuant to the Interlocal Cooperation Act (Article 4413(32c)V.T.C.S.) with the Houston-Galveston Area Council for the purpose of appointing the Council as its true and lawful purchasing agent for the purchase of certain vehicles through the Council's Cooperative Purchasing Program. A copy is attached hereto. The Court proceeded to consider the change of status of the following employees. Task Force--Claims 101109 thru 101111 On line checks - 38523 pn motion by Commissioner Beard, seconded by Commissioner Cooley, the Court voted unanimously to approve the Claims as submitted. Under other business, Commissioner Cooley reminded the Court if the dangerous "Double S" curve on Dowling Road. He informed the ourt that he had been negotiating for additional right-of-way and as now down to a price for the purchase the land needed to straighten out the curve. He said that he did not want to raise he purchase price by asking for an appraisal because of the ~imited acreage involved in the transaction. The County Judge `sked Commissioner Cooley if he had established a basis of worth or the land. Commissioner Cooley replied that he had; by esearching the cost per acre of the adjoining rural subdivisions e had established a fair cost of $12,000.00 per acre. The first piece of property was a .551 acre tract that would cost the county VO L a _PAG ~ S i 1 •V AP V, i Commissioners' Court meeting March 8, 1988 approximately $6,000.00 plus a fence. This property was developed by the landowner and has a home on it. The second piece of property is just over two acres of raw, undeveloped land. As of yet the Commissioner has not contacted that landowner. The County, Judge stated he did not object with the way the Commissioner was) proceeding, that he thought this was a fair and equitable price butj did want to make sure there was adequate justification of expend -I itures. It was the consensus of the Court that Commissioner) Cooley proceed without an appraisal and to keep the Court informed of his progress. Commissioner Turner inquired who would be handling the solicitation of bids on the demolition and clean up of the old Road and Bridge facility. The County Judge informed him that Rebecca, Shults, Purchasing Agent, would do so. Travis Nelson, District Clerk, informed the Court of two legal I opinions recently handed down concerning funds placed in trust with County. The County Judge told Mr. Nelson that the Court would place the matter on the agenda for the next Commissioners' Court I meeting. There being no further business to come before the Court, the f eeting was adjourned. ~ a . Fy • i f i 1 L INTERLOCAL AGREEMENT ; STATE OF TEXAS ( ) CUUN1'Y OF BRAZOS ( ) L PHIS INTERLOCAL AGREEHENT ("Agreement's), made and entered into pursuant to the laterlocal Cooperation Act (Article 4413(32c)V.T.C.S.) by and between County of Brazos , Texas, hereinafter called the "County", and the Houston-Galveston Area Council, a council of governments of the " State of Texas, thereinafter called the "Council." WITNE9SETH The - County of Brazos constitutes and appoints the Floustou-Galveston Area Council, its true and lawful purchasing agent for the purchase of certain vehicles through the Council's Cooperative Purchasing Program. Said Vehicles will be specified by the County to the Council through submission _ of purchase orders duly signed by an appropriate County otficial. The County agrees that the Council shall be the exclusive purchasing agent for the vehicles, and agrees that the bidding shall be conducted by the Council according to the regulations contained in Section IV of the Council's Financial and Accounting Procedures Policy Handbook. WHEREAS, the County desires to purchase certain vehicles and WHEREAS, the Council is willing to procure the vehicles for the County. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESLNTS: THAT in consideration of the mutual covenants, agreements, and benefits to both parties, it is hereby agreed as follows: 1. ; Within 90 days after the date if execution hereof, the Council will x procure the vehicles described in the order form'for vehicles F (Lxhibit "A") attached hereto. The vehicles shall be procured in accordance with the regulations governing competitive bidding procedures of the Council; the terms hereof; and the quantities, { qualities, and 'at the unit prices and administrative surcharge as indicated on Exhibit "A". 11. All of the vehicles purchased hereunder shall -be'of Caw manufacture and undamaged and shall meet the specifl~atious as af2termined by • the Council staff in response to requests from the County. The vehicles shall carry the manufacturer's full warranty to the County. Provided, however, that it is understood and agreed that the Council has acted only as an agent for the County in its purchase and make no warranty, either implied or expressed, ,..regarding the fitness or merchantability of the vehicles. t , - III. AIV. The ,County agrees to present an authorized representative at the appropriate contracted vendor(s) for the respective ordered • { I vehicles, for the express purpose of "check out" and acceptance of the' vehicles within five (5) days after notification that said } vehicles are ready for delivery. Further, the County shall verify acceptance of the vehicles in writing to the Council within five (5) days after acceptance of the same. V.. The County agrees that Manufacturer's Statement of Origin (title) U will be endorsed by the vendor directly to the County at the time of receipt and acceptance of the vehicles. Further the County accepts responsibility for the registration and transfer. ,This agreement, (inclusive of the attached Exhibit "A") constitutes the entire agreement between the parties hereto relating to the rights herein grented and the obligations herein assumed.
