'a I . , , i ~ l ' 1 ' L S r COMMISSIONERS' COURT REGULAR MEETING DECEMBER 14, 1987 r } 1 S r s t I V0 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Monday, December 14, 1987, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. Pct. 3 Ramiro Quintero Brazos County Resident Reba Ragsdale Brazos County Resident Lonnie Williams State Dept. of Highways The Court received, approved and ordered filed as submitted the following reports for November 1987: Jim Mazurkiewicz, County Extension Agent; Carolyn Nobles, County Extension Agent; Betsy Harkey, County Extension Agent; Monty Dozier, County Extension Agent; The Court received, considered and approved reports from County and Precinct officers showing revenues collected and remitted to the County Treasurer. An excerpt from those reports is attached hereto. The Court next considered approval of the minutes of the Commissioners' Court meeting held on September 28, 1987, September 30, 1987 and October 5, 1987. on motion by Commis- sioner Cooley, seconded by Commissioner Turner, the Court voted Commissioners' Court meeting December 14, 1987 • unanimously to approve the minutes as submitted. The County Judge read a Proclamation to the Court pro- claiming the week of December 13-19, 1987 as NATIONAL DRUNK AND DRUGGED DRIVING AWARENESS WEEK. The County Judge cited the need to make the public more aware of the dangers of driving while under the influence of alcohol or drugs. On motion by Commissioner Wilcox, seconded by Commissioner Beard, the Court voted unanimously to join in the effort to make the public more aware of this problem. Mr. Lonnie Williams, representing the State Department of • • Highways and Public Transportation, informed the Court of the intention of the State to widen Highway 21 and reminded the Court of the Public Hearing to be held on December 15, 1987. He went on to explain that he was not here to asked for money but merely informing the Court of the intentions of the Department. On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court voted unanimously to draft a letter of support for the project and forward it to the State Department of Highways and Public Transportation. The Court next considered Budget Amendment X26, which would reallocate funds budgeted for the Anti-DWI Department. On motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. On motion by Commissioner Beard, seconded by Commissioner Wilcox, the Court voted unanimously to waive the motor vehicle identification requirements for the Sheriff's Office and the County Attorney's office, as stated in Vernon's Civil Statutes 6701m-2. A copy of both orders are attached. The County Judge informed the Court that Brazos County was eligible to add certain types of benefits to it's retirement system without increasing the required monthly deposits being made by the employees and the county. He explained the county had two options to choose from and that he personally favored the second one and recommended the Court adopt it. On motion by the County Judge, -4 - - - . - ft... . Commissioners' Court meeting December 14, 1987 seconded by Commissioner Cooley, the Court voted unanimously to adopt the attached Order increasing retirement benefits. On motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to approve, as submitted, the guidelines for merit raises for County Employees. A copy of which is attached hereto. The Court recognized Sheriff Ron Miller who informed the Court of the need for a minimum security jail. The current County facility reaches maximum occupancy on weekends and because certain classification standards must be met, bed space shrinks. The Sheriff stated that he was here to make an official request for the facility. The County Judge said he was aware of the problem and that he was now ready to investigate the options. The Court next considered an order appointing James A. Amis, Jr. to sit as Special Judge in County Court at Law I from December 21, 1987 through December 30, 1987 to allow Judge Davis to take vacation time. On motion by Commissioner Beard, seconded by Commissioner Wilcox, the Court voted unanimously to approve the Order naming James A. Amis, Jr. as Special Judge for County Court at Law I for the dates of December 21, 1987 through December 30, 1987. A full copy of the Order is attached to and made a part of these minutes. The Court next considered changes in the Overweight permitting policies for the Road and Bridge Department. Commissioner Cooley recommended that be transferred to the Road and Bridge Department from the Tax Office. On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court voted unanimously to follow the recommendation of Commissioner Cooley and-transfer the permitting to the Road and Bridge Department. The next matter for consideration by the Court was approval of the final plat of the Viking property on Highway 21 West. This final plat reduces the total acreage from 19.1 acres to 18.84 acres. This is due to the dedication of a 50' right-of-way on Louis Street. Commissioner Turner moved to approve the final plat and to purchase the property for $1,000,000.00. Commissioners Beard, Turner and Wilcox voted "Aye". Commissioner Cooley voted "No", whereupon the County Judge declared the motion carried. Commissioner Cooley asked that the minutes reflect that he approved the plat but not the purchase of real estate. The County Judge said the closing would be sometime between Christmas and New Years Day. The Court proceeded to consider the change of status of the following employees. Garrison, William Co. Atty. Under other business, Commissioner Cooley asked what the procedure was for acquiring property for widening or lengthening a County Road. He referred specifically to Dowling Road in Precinct 1. He said he hoped to straighten a double "S" curve just past Wicks Lumber Company. It was the consensus of the Court to seek advice from legal counsel. The County Judge stated he felt that Commissioner Cooley should have the authority to negotiate for acquisition of the necessary property for right-of-way. County Judge to, , Commissioner, Precinct #1 Commissioner, Precinct #2 Commissioners Precinct #3 Commissioner, Precinct #4 County Clerks and at such session, among other Proceedings, the following order was passed: WHEREAS, by virtue of an order of the Commissioners Court of Brazos County, Texas, adopted on the 14th day of December , 1987 said County became a participating subdivision in the Texas County and District Retirement System (hereinafter called "TCDRS'% and WHEREAS, the Actuary for TCDRS has determined and certified that the increases in benefits, credits and additional coverages hereinbelow selected, can be amortized by the County within the time and under the terms prescribed by Subtitle F of Title 110B, of the Revised Civil Statutes of Texas, 1925, as amended (hereinafter called the "TCDRS Act"); it is accordingly, ORDERED BY THE COMMISSIONERS COURT OF BRAZOS , COUNTY, TEXAS: "1. Effective January 1, 1988: "(a) Allocated (special) prior service credits heretofore allowed by this County and now in effect shall be increased from the present 90 % of the maximum (special) prior service credit of each member affected to 120 % of said amount. "(b) TCDRS members having current service credit with this County shall be allowed "multiple matching credit" calculated at a percentage rate which, when added to the rate employed in determining the "current service credit" allowable to the member under Sec. 53.403 of the TCDRS Act, will total 320 % of the accumulated contributions of the member. "(c) Monthly payments as to annuities in effect December 31, 1987 and which arose out of prior service credits allowed by this County shall be increased as to payments for January, 1988 and each month thereafter by 33.337• of the monthly benefit paid to the annuitant for the month of December 1987 (excluding any amounts paid as distributive benefits). "(d) Monthly payments as to annuities in effect December 31, 1987 and which arose out of current service credits and multiple matching credits allowed by this County shall be increased as to payments for January 1988 page 2 (TCDRS-C County) lrv.G~~o and each month t hereafter by 39i of the monthly benefit paid to the annuitant ' for the month of December 1987 (excluding any amounts paid as distributive benefits). "2. Effect ive January 1, 19881 "(a) Any person who on or after January 1, 1988 is a TCDRS member who shall have accumulated ten (10) or more years of credited service with this County and other subdivisions that have adopted ten (10) year service retirement eligibility under Section 54.207 of the TCDRS Act and has attained the age of sixty (60) shall have the right to retire and receive a service retirement annuity. "(b) Any person who on or after January 1, 1988 is a TCDRS member who shall have accumulated sufficient years of credited service with this County and other subdivisions which have adopted the provisions of Section 54.207 of the TCDRS Act such that, when the years of such credited service is added to the member's years of attained age produces a sum equal to or in excess of eighty (80), shall have the right to retire and receive a service retirement annuity. "(c) Any person who on or after January 1, 1988 is a TCDRS member who shall have accumulated ten (10) or more years of credited service with this County and other subdivisions which have adopted the provisions of Section 54.207 of the TCDRS Act, and who is not eligible for service retirement, may retire and receive a disability retirement annuity if the member , is certified as disabled in accordance with Section 54.303 (b)(2) of the TCDRS Act. "(d) Any person who on or after January 1, 1988 is a TCDRS member who shall have accumulated twenty (20) or more years of credited service with this County and other subdivisions that have adopted twenty (20) year deferred service eligibility or who shall have accumulated ten (10) or more years of credited service with this County and other subdivisions that have adopted ten (10) year deferred service eligibility and has attained the age of sixty (60) shall have the right of "deferred service retirement" under the terms and conditions prescribed in Sections 54.203 and 54.207 of the TCDRS Act. NO Any person who on or after January 1, 1988 is a TCDRS member and who shall have accumulated at least ten (10) years of credited service with this and other participating subdivisions which have adopted ten (10) year vesting, shall have the right, despite withdrawal from service prior to attainment of age sixty (60), to remain a member and to retire at or after age sixty (60), conditioned that he lives to date of retirement and that he shall not have withdrawn his accumulated deposits with the System. "3. Prior service credit (not exceeding 36 months total) shall be, and is hereby allowed (effective January 1, 1988) for active service in the armed VOA 2 0 • page 3 (TCDRS-C County) forces of the United States performed by a TCDRS member of this County under the following conditions, viz.: "(a) Such service was performed prior to date of the County's participation in Texas County and District Retirement System. "(b) Such service was performed during a time that the United States was involved in organized conflict with foreign forces, whether in a formal state of war or police actionf "(c) Such person was an employee of this County immediately prior to the beginning of such service in the armed forces, entered such military service without intervening employment, and returned to employment of this County within one hundred eighty (180) days following his discharge or release from active duty with the armed forces{ and "(d) Such person has not heretofore been allowed credit for any• part of such military service. "4. Any person who on or after January 1, 1988 is a TCDRS member of this County and who was a member of the military service of the United States during the period from April 6, 1917 to November 11, 1919, or from October 16, 1940 to October 31, 1974, and who otherwise qualifies under the requirements of Section 53.601 of the TCDRS Act, shall be granted current service credit and multiple matching credit for each month of such military service (not exceeding the. limits prescribed in said Act) for which such member makes application and makes deposits in the manner prescribed by said Act. We hereby acknowledge that we have been advised that the retirement benefit increases, which we are adopting effective January 1, 19BB-, will increase the unfunded liability of our TCDRS retirement program but not above an amount that can be funded within the next 30 years. Two fundamental assumptions underlying the determination of the benefit increases are theset a) The method of funding the retirement benefits which will accrue to our employees as a result of adoption of the benefit increases assumes the continued existence of Name of Subdivision indefinitely into the future. b) The method of funding the retirement benefits assumes that all eligible employees will participate in TCDRS, as required by the TCDRS Act, and that the number of employees participating in TCDRS either will stay at the current level or will increase. 2. We hereby acknowledge that we have been advised that the termination of BRAZOS COUNTY, TEXAS or a reduction in the number of employees (Name of Subdivision) participating in TCDRS may reduce the retirement benefits that can be paid to our employees. TEXAS GUIDELINES FOR MERIT RAISES • Any merit raise given must conform to the pay schedule. (one step increase) An employee can only be increased one step at a time. A department head cannot raise their own salary. The total of the merit increases cannot exceed the amount budgeted for that department. Any balance remaining is returned to General Fund and cannot be carried over by the Department. Any variance from this will be decided by the Commissioners' Court on a case by case basis. • Departments with only one employee other than the department head can give a particular employee a merit raise every other year. An employee must be in 4 position one year to get a merit raise. Permanent part-time employees in single employee departments may be given merit raises under the same rules as permanent full time employees. Merit raises may be given at any time during the year, however the raise is to be figured on an annual basis. Any moneys remaining covering the unpaid months cannot be used in the form of a merit raise for another employee in that year. Any employee receiving a merit raise during a given fiscal year will not be entitled to receive a merit raise during the following fiscal year.
