Adjourn f to • F VOL 7- PAGE b"OKq Jam. ~ COMMISSIONERS- COURT REGULAR MEETING AUGUST 10, 1987 V0 A regular meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A.M. on Monday, August 10, 1987, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Absent Frank Boriskie, County Clerk. An excerpt from those reports is attached hereto. The first matter to come before the Court was a request by Mr. Tom Urbanik to address the Commissioners- Court on the subject of Greens Prairie Road. Mr. Urbanik showed a slide presentation of the condition of Greens Prairie Road after over weight trucks were allowed to use the road. Greens Prairie had just been seal coated when the over weight permits were issued. Normally the weight limit on this particular road is 58,420 pounds for three to five axel trucks but twenty-two permits were issued for thirty (30) days each on this occasion. Commissioner Cooley said everything had been done exactly as the Highway Department. Mr. Urbanik disagreed stating that the Highway Department only issues over weight permits on the one trip basis and certainly not for thirty days. Mr. Urbanik requested prompt action to stop the destruction of the road and requested a response from the Court. The County Judge spoke on behalf of the Court saying that he appreciated Mr. Urbanik-s comments and that the Court must look very closley at the problem. He went on to say that under extreme or unusual cases vehicles must travel certain roads. Mr. Urbanik agained disagreed, stating that this destruction was unnecessary because other routes were available. Commissioner Wilcox informed the Court that the user had agreed to repair the road at his cost and that the road would be restored to its original condition. The next item on the agenda was to canvass the results of the Special Election held August 8, 1987 on the proposition of adoption of a one-half percent (1/28) County Sales and Use Tax to be used to reduce the county property tax rate. The County Judge read aloud the cumulative county-wide totals prepared by the central counting station. The totals are as follows: For 1,416 Against 1,018 Over Votes 1 Under Votes 0 TOTAL VOTES CAST 2,345 VO L PAG Commissioners' Court meeting August 10, 1987 VOL z 14 The County Judge announced the proposition passed. On motion byl Commissioner Beard, seconded by Commissioner Cooley, the Court voted unanimously to accept as true the cumulative county-wide totals and ordered the results be certified to the State Comptroller and recorded in the Official Election Records of Brazos County. The Court next considered approval of the minutes of Commissioners' Court meeting of June 15, 1987. On motion by Commissioner Wilcox, seconded by Commissioner Beard, the minutes were approved as submitted. The next matter to be considered by the Court was a Health Maintenance Plan to be offered to the County Employees. The County had been approached by representatives from two companies, Scott and White Clinic and Texas Health Plan. After thoroughly reviewing both plans, the insurance committee recommended offering plans to the employees allowing them to choose the plan that best suited their particular needs. The representatives of each plan will hold group meetings to present their plan so employees can select the plan of their choice. The meeting would be scheduled timely to allow employees to make their selection by September 1, 1987 which is the anniversary date of the current health inusrance. Commissioner Cooley made the motion to offer both plans to the employees of Brazos County. It was seconded by the County Judge. Commissioners Cooley, Wilcox and the County Judge voted "Aye". Commissioner Beard abstained whereupon the County Judge announced the motion had carried. The Court next considered awarding the following bids: Bid No. 87-375 - Pest Control for the Courthouse Orkin Pest Control was the low bidder but the bid had not been recommended because of the number of hours dedicated to Brazos County. Quality Pest Control, the second lowest bidder was recommended because they stipulated more hours of service to the Courthouse. Commissioner Cooley moved that the bid be awarded to Orkin with the stipulation that maintenance personnel go through the Courthouse with the Orkin represenative for the first few times to observe service. If the service was not up to maintenance standards, Mr. Dobbins would report his findings to the Court and the Contract would be terminated. The motion was seconded by Commissioner Beard and carried unanimously. A full copy of the bid tabulation is attached hereto. Bid No. 87-379 - Annual Decking Contract for the Road and Bridge Department County Engineer, Holalnd Winder recommended the bid be tabled for further evaluation. The next matter to be considered by the Court was to decide whether or not to charge fees for using the landfill. Commissioner Cooley again stated he feared roadside dumping and trash burning would occur if the County began charging fees. The County Judge felt it was necessary to charge for the use and felt uncertain about letting an independent concern operate the landfill. He said that the Court needed to explore all is alternatives. After considerable discussion Commissioner Beard moved to set the fees at a $2.00 minimum up to $7.50 for large loads; hours of operation be 12:00 p.m. until 6:00 p.m. daily; that there be a 12 ton daily dumping limit; no vacuum trucks be allowed to use the landfill, and only waste from Brazos County to be put in the landfill. These conditions become effective when the new landfill opens. The motion was seconded by the County Judge. Commissioner Wilcox suggested that measurement be by the cubic yard, that the minimum charge be $2.75 to $5.00 per cubic yard of waste and that one garbage bag of waste be dumped at no charge. The County Judge asked Commissioner Beard if he would amend his motion, to which Commissioner Beard agreed. Commissioners Beard, Wilcox and the County Judge voted "Aye", Commissioner Cooley voted "No" whereupon the County Judge E declared the motion carried. Under other business, the Court heard from Kenny Mallard of Mallard Insurance Agency, the liability insurance carrier foi Brazos County. Mr. Mallard presented a detailed outline of the insurance renewal premiums for the next plan year for the Court's consideration. Mr. Mallard explained each item in detail and after considerable discussion Commissioner Beard moved to accept the following: 1. Alternate - Fire, EC, Vandalism, All Risk $1,000 Deductible $13,722.00 2. Automobile Coverage - Hartford A&I $500,000 CSL BI/PD - $250 Deductible on Comprehensive $1,000 Deductible on Collision on Specific Trucks $32,326.00 3. General Liability - $1,000,000 CSL $72,955.82 4. Law Enforcement Coverage - $1,000 with $500 Deductible $49,654.84 5. New Landfill (Excludes Old Landfill) $ 1,557.75 The motion was seconded by Commissioner Wilcox and carried VOL 7-, unanimously. Commissioners Beard and Wilcox withdrew their motion and the second. The County Judge informed the Court that the abandonment of the road in the Foxfire Subdivision would not be as easy as at first assumed. Legal counsel had informed the Judge that the road would have to be appraised and sold at fair market value. The County Judge inquired about the contracts between the County and the Cities of Bryan and College Station for ,maintenance of roads that had been incorporated into the cities. Commissioner Beard informed the Court that he would be receiving a letter of agreement from the City of Bryan. There being no further business to come before the Court, the meeting was recessed until 4:00 p.m. at which time the Court would consider the proposal for liability insurance. . The meeting was reconvened at 4:00 p.m. to consider liability insurance coverage for the County. Commissioner Beard moved to accept the following amounts quoted by Mallard Insurance Agency: 1. J. Holmgreen County Judge Bill J. Cooley Commissioner, Precinct 1 Walter Wilcox Commissioner, Precinct 2 Billy E. Beard Commissioner, Precinct 3 Milton Turner Commissioner, Precinct 4 Frank Boriskie County Clerk and the following members absent, to wits Milton Turner, when among other business, the following was transacteds The County Judge introduced a RESOLUTION CANVASSING RETURNS AND DELCARING RESULTS OF SPECIAL COUNTY ELECTION. Commissioner Beard made a motion that the Resolution be adopted. Commissioner Cooley seconded the motion for adoption of the Resolution. The motion carrying with it the adoption of the Resolution, prevailed by the following votes AYES: Commissioners Cooley, Wilcox and Beard. NOES: None. The County Judge thereupon announced that the motion had duly and lawfully carried and that the Resolution had been duly and lawfully adopted. All bidders shall contact Mr. Ed Dobbins, Maintenance Department, 361-4460 to inspect the sites and thoroughly acquaint themselves with the areas to be treated and all other factors that shall affect their performance. The successful bidder will be held responsible for the inspection of the following sites- Courthouse Main, Courthouse Annex, Tax Office, Jail, and the Old Sheriff's Building (206 N. Washington). 4. The sucessful contractor will be contacted by the Brazos County Maintenance Department to set up a schedule for treatments. 5. The Contractor shall act as independent contractor and shall in no sense act as agent or servant of the County. 6. The County will not be held responsible for any loss or damage to- tools, equipment, wearing apparel or anything left on the premises by the Contractor unattended before, during, and after this job is performed. 7. The successful bidder shall furnish all labor, tools, equipment, transportation, and insurance and any other incidentals necessary to perform a professional quality job. 8. Prices to remain firm for the duration of this contract. The County does not guarantee to purchase any minimum quantities. Patent Franchises etc.: Upon acceptance of a purchase order for any commodity purchased by Brazos County, the upp er agrees to protect the County from any claim involving patent right infringements, copyrights or sales franchises.
