1. Request by Mr. Pete Palasota to address Commissioners' Court.
2. Request by Mr. Jim Ruboviak, County Attorney, to address

3. Appointment of Election Judges and Alternate Judges for 1987

SPECIAL MEETING
JULY 27, 1987
A special meeting of the Commissioners' Court of Brazos
County. Texas, was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 2:30
P.M. on Monday, July 27, 1987, with the following members of the
Court present:

Jim Walter Homes
The Court recognized Pete Palasota, Insurance agent, who
requested an opportunity to present a cancer plan and intensive
care policy to all County employees. The Coverage to be
presented by the MFM, Company of Dallas with American Public
Life Insurance Company as the underwriter and paying agent. The
County Judge outlined the County Health Plan for employees and
advised Mr. Palasota that the Court had passed an order
disallowing solicitation of County employees on County time.

Mr. Palasota requested authorisation to distribute fliers with
employees pay checks explaining the coverage to be offered. He
further requested the use of a room to allow interested
employees to come and com

coverage provided by American Public Life. On motion by
Commissioner Turner, seconded by Commissioner Beard, the Court
voted unanimously to allow Mr. Palasota to use the
Commissioners' Court room on a specified date for the meetings.
County Attorney Jim Kuboviak next addressed the Court
requesting authorization to trade the vehicles currently used by
his department for vehicles no longer used by the Sheriff's
Department. Mr. Kuboviak advised the Court that the vehicles
were used by his Department to serve warrants and subpoenas on
hot check offenders, etc. On motion by Commissioner Turner,
seconded by Commissioner Beard, the Court voted unanimously to
authorize the trade.

The Court next considered a request from Jim Walters
Homes, Inc. for a variance on the building set back lines
required in the County's Subdivision Regulations. The variance
pertains to the home of Mr. and Mrs. Donald Gordon which, when

constructed, encroached on the set back line at the corner of FM
2223 and Mancuso Road. The Court was advised that the house is
completed and that the builder was unaware of the set back line

on a county road when the house was constructed. On motion by

Commissioner Turner, seconded by Commissioner Beard, the Court
voted unanimously to grant the variance for the building.

Election Code, the County Clerk presented a list of persons to

tion. On motion by Commissioner Cooley, seconded by
Commissioner Beard, the Court voted unanimously to appoint
election judges and alternate election judges for the current

voting year according to the list presented by the County Clerk
and attached hereto.
The Court next discussed the condition of Wallis Road in
Precinct 3. Commissioner Beard requested that Wallis Road be a
priority consideration of the Road and Bridge Department for
resurfacing. He asked that the road be seal coated as soon as
possible. Howard Long, a consultant to the Road and Bridge
Department asked about the design of the road. Commissioner
Wilcox indicated that the improvement would be to the existing
roadway. Discussion was held regarding a possible addition to
the existing road or a complete new road. After discussion,
Commissioner Turner moved that priority be given to resurfacing
of Wallis Road. The motion was seconded by Commissioner Beard
and carried unanimously.
The Court next considered Budget Amendment #14, which
would reallocated funds currently budgeted for the Justice of
the Peace, Precinct 7 Place 1. On motion by Commissioner
Cooley, seconded by Commissioner Turner, the Court voted
unanimously to approve the budget amendment as submitted a copy
of which is attached hereto.
Next to be discussed was the County maintenance of roads
within the city limits of College Station. The County Judge
stated he had no problem in continuing the maintenance if there
was a written agreement with the city. Commissioner Cooley
stated that in the past the County continued to maintain the
roads that were annexed by the City as long as they remained
rural sections. The City assumed the maintenance when they were
upgraded to a city road. Commissioner Beard stated he would get
a contract with the cities of Bryan and College Station for
maintaining the roads in his precinct. Commissioner Wilcox
asked that the County enter into contract through the Inter-
Governmental Act. He further asked that W. R. Vance research
the law regarding work on roads within the cities. Commissioenr
Beard requested permission to continue maintenance on 1,650 feet

of roads within the cities of Bryan and College Station that are
in Precinct 3. Commissioner Cooley made a motion to enter into
agreement with the cities of Bryan and College Station for the
maintenance of roads within the city limits of all cities. The
motion was seconded by Commissioner Beard, with Commissioners
Cooley, Beard and Turner voting "Aye". Commissioner Wilcox
voted "No", whereupon the County Judge declared the motion had
passed. Commissioner Wilcox again requested that W. R. Vance
prepare the contract.
The Court next considered the following bids:
1. Bid No. 87-376 - Purchase of meat for August and
September 1987 for the jail.
(a) Sysco Food Services $3,820.40
(b) White Swan $3,930.40
(c) Frostex Foods $3,292.80
Rebecca Schults, Purchasing Agent, recommended acceptance
of the low bid submitted by Frostex Foods. On motion by
Commissioner Beard, seconded by Commissioner Turner the
Court voted unanimously to accept the low bid and award
the contract to Frostex Foods for August and September
1987. A full copy of the bid tabulation is attached
hereto for further reference.

On motion by Commissioner Beard, seconded by Commissioner
Turner, the Court voted unanimously to approve the Claims as
submitted.
Under other business, Commissioner Cooley asked if a
welder from the Road and Bridge Department could be used at the
Rodeo Arena to repair some damage. He stated that he would like
for the work to be completed this week. It was the consensus of
the Court to allow the employee to do the work if he was not
needed for Road and Bridge work.
Commissioner Cooley also asked for authorization for the
Sheriff to pay overtime to jailers to oversee the jail inmate
work crew during the convalesence of Oliver Fields, the jailer
who normally performed the task. The jailers performing the
task would be on a voluntary basis and would not necessarily be
one jailer. On motion by Commissioner Cooley, seconded by
Commissioner Turner, the Court voted unanimously to authorize
the overtime pay.

the County Judge recessed the meeting until 3:00 p.m. that
afternoon.
The County Judge announced the meeting closed to the
public at 3:00 p.m. to allow the Court to discuss pending
litigation in closed executive session.
The meeting was re-opened to the public at 3:20 p.m. to
allow the court to take action on the closed session.
On motion by Commissioner Beard, seconded by Commissioner
Cooley, the Court voted unanimously to authorized W. R. Vance to
represent the County in a pending law suit filed in the 85th
District Court styled "Kenneth L. Hayes vs Robert T. Lyons, John
W. Lyons, Jr., Lucille Stousland Lyons and Brazos County,
Texas", same being a suit to establish an easement to private
langs.
There being no further business to come before the Court
the meeting was adjourned.

BUDGET AMENDMENT(S) FOR THE 1987 BUDGET YEAR

On this the 27th day of July 1987 at a special meeting of the
Commissioners' Court the following members were present:
R. J. Holmgreen, County Judge, Presiding
Bill J. Cooley, Commissioner, Precinct 1;
Walter Wilcox, Commissioner, Precinct 2;
Billy E. Beard, Commissioner, Precinct 3;
Milton Turner, Commissioner, Precinct 4;
Frank Boriskie, County Clerk.
The following proceedings were held:
THAT WHEREAS, on July 27, 1987, the Court heard and approved a
budget amendment for the 1987 budget year for Brazos County, Texas.
WHEREAS, an emergency expenditure is necessary due to grave public
necessity to meet unusual and unforeseen conditions which could not
be reasonably included in the original budget adopted October
27, 1986, the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).
ADOPTED AND APPROVED this the 27th day of July 1987
