COMMISSIONERS' COURT SPECIAL MEETING JUNE 22, 1987 I I A special meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A.M. on Monday, June 22, 1987, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Bill J. Cooley, Commissioner of Precinct 1 Absent; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. Mounce Visitor The first matter to come before the Court was a presentation by Mr. Mike McCleary, a resident of the Wellborn Community regarding the condition of the roads in Precinct 1. Mr. McCleary stated that the practice of not using the same operator to maintain the roads in the precinct had caused a wide variation in the quality of road maintenance. He innumerated several problems he thought could all be attributed to the inconsistency of the work being done. The County Judge thanked Mr. McCleary for bringing this to the attention of the Court and said the Court would take the matter under consideration. John Deere 670 B 3. 30 days 4. 30 years 5. 4 support shoes C Commissioner Wilcox moved to delay the purchase of any major equipment until such time as the new County Engineer assumes his duties with the county. The motion was seconded by Commissioner Turner and carried unanimously. Bid No. 87-370 - Annual Decking Timber Contract for the Road & Bridge Department. Commissioner Wilcox requested the bid be rejected due to a lack of specific description. The motion was seconded by Commissioner Turner and carried unanimously. The Court next considered a request for the Right-of-Way abandonment of a portion of Foxfire Drive in Precinct 1 submitted by T. David Chin of Kling Engineering on behalf of the two adjacent property owners, Mr. Ray Warren James (Lot 37) and Mrs. Chu-Chih Chen (Lot 24). The property owners also requested VOLE PAG Commissioners Court meeting June 22, 1987 i . I quit-claim deeds be issued deeding to each owner the 30 feet of right-of-way adjacent to their property. On motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to grant the request of the property owners for the abandonment of the right-of-way and to issue a quit claim deed to each adjoining property owner for a 30 foot wide strip. The Court next considered a petition submitted by several elected and appointed officials, and department heads of Brazos County requesting that vendors, insurance agents, and others whose presence is disruptive to the efficient functions of county offices not be allowed to solicit business from county employees on county property during office hours. On motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to recommend that there be "No Solicitation" of employees on county time. On motion by Commissioner Beard, seconded by Commissioner Wilcox, the Court voted unanimously to delay action on the Order of the District Judges appointing the County Auditor to a two year term of office to allow more study of the most recent bill before the state legislature. Next to be discussed was Budget Amendment #08 for various departments. The amendment would increase the District Attorney's budget by $2,300 which was needed to complete the microfilming of records for that office. The amendment would also reallocate currently budgeted funds in the Sheriff's Department, Constable of Precinct 4 and Non Departmental. On motion by Commissioner Beard, seconded by Commissioner Turner the Court voted unanimously to approve the Budget Amendment. A full copy of the amendment is attached hereto. The Court next discussed the parking lot at 27th Street and Washington Street. Commissioner Beard reported that he had met with the First Baptist Church officials and that they had requested assistance from the County in clearing the i t k' i ,I ,I VOL._ll! The church proposed to allow the county the use of the lot for parking during business hours during the week, except as such time as the church might have special functions. The Church officials felt that their purchase of the property and the County's clearing and construction of the parking lot would be equal contributions for use. The County Judge stated he felt that a compromise was in order and suggested the church have the lot cleared and then the County would construct a lot comprable to the adjacent County parking lot. After a brief discussion, it was the consensus of the Court to request the church have the lot cleared, obtain a building permit from the city for the construction and that the Engineer submit an estimate of the • total cost of the job to the Court. Both Commissioner Wilcox and the County Engineer estimated the total cost to be approximately $85,000. On motion by Commissioner Turner, seconded by Commissioner Beard the Court voted unanimously to authorize Commissioner Beard to discuss this proposal with the church officials. The Court proceeded to consider the change of status of the following employees: Lopez, Joseph Moeller, Edward Clay, Bobby Sweeten, Sherry Morris, Ann M. Sheriff's Dept. Brazos Center Sheriff's Dept. Under other business the Court considered a request by Phyllis Dozier for authorization to attend the Annual Conference of Conference Manangers in Washington D.C. On motion by the County Judge, seconded by Commissioner Beard, the Court voted unanimously to authorize Mrs. Dozier to attend the Conference in Washington D.C. and to pay her expenses. At 10:40 a.m. the County Judge announced the meeting closed to the public to allow the Court to discuss the authorization of a law suit by the County Attorney. i i The meeting was opened to the public at 11:05 a.m. to allow the Court to take action on the closed session. The Court considered an Order Authorizing the County Attorney to File Suit Against Ralph Bobbitt for Violations of the Texas Water Code. Commissioner Beard moved to adopt the Order authorizing the suit. The motion was seconded by Commissioner Wilcox, with Commissioners Beard, Wilcox and the County Judge voting "Aye"; Commissioner Turner abstained, whereupon the County Judge announced the motion carried. A copy of the approved Order is attached hereto and made a part of these minutes." There being no further business to come before the Court, V0 the meeting was adjourned.
