SPECIAL MEETING
MARCH 24, 1987
A special meeting of the Commissioners' Court of Brazos
County, Texas, was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
A.M. on Tuesday, March 24, 1987, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Bill J. Cooley, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Billy E. Beard, Commissioner of Precinct 3 absent;
Milton Turner, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.
The following citizens and officials were in attendance:

The first matter to be considered by the Court was a
RESOLUTION AUTHORIZING APPLICATION FOR GRANT TO REPLICATE MODEL
JUVENILE JUSTICE PROJECTS. Such application to be made to the
Criminal Justice Division for a one year grant for a total
amount of $24,348; $23,618 to be state funded and $730 being
locally funded with existing budget dollars. The grant would
fund a volunteer coordinator's position which would recruit,
screen, train and supervise volunteers in the Juvenile Services
Department. The County Judge recommended adoption of the
Resolution and so moved for the adoption of the Resloution which
authorized the County Judge to make application for the grant

;I and authorized the County Judge to accept such grant funds

~ should they be tendered. The motion was seconded by Commis-
sioner Coooley and carried unanimously. A copy of the

The meeting proceeded with the Court's consideration of a

~I RESOLUTION AUTHORIZING APPLICATION FOR GRANT FOR VICTIM
ASSISTANCE/FAMILY VIOLENCE to be administered by the County
;I
Attorney. Such application to be made to the Criminal Justice
Division for a one year grant for a total amount of $71,561;
I
$35,841 to be applicant funded, and $35,720 would be State
funded. The grant would provide a Family Violence Unit that
will screen, counsel and provide legal services in the form of
protective orders for victims of domestic violence. The County
Judge advised the Court that this application is a continuation
of an existing grant which the County has been utilizing. It
had proven to be very sucessful and worked out very well. He

recommended its approval and moved for the adoption of the
Resolution which authorized the County Judge to make application
for the grant and authorized acceptance of such grant funds
Ishould they be tendered. The motion was seconded by
Commissioner Turner and carried unanimously. A copy of the
Resolution is attached hereto.

The next item on the agenda was approval of the minutes of
j the Commissioners' Court meetings held February 16, 1987 and
February 23, 1987. Commissioner Wilcox recommended that the
,i minutes of the meeting held February 16, 1987 relating to the
i construction of Pate Road be amended to clarify the type of road
to be constructed by the County and who would bear the expense
~j of covering the pipeline which crossed Pate Road. Commissioner
jI Cooley and the County Judge agreed that it was understood that
the County would install the necessary culverts and that the
owners had contributed $6,000 toward the construction of the
Road and that the minutes reflected a true accounting of the

discussion and action of the Court meeting. Commissioner Wilcox
further stated that the $6,000 would not cover the entire cost

of constructing the road. He further stated that the County
Engineer had met with the pipeline company on Friday March 20,
1987 and that the pipeline company was requiring that the
pipeline be wrapped before covering. The County Judge stated
that the Friday meeting had no barring on the minutes of the
meeting held February 16th. It was the consensus of the Court
after further discussion that approval of the minutes of the
meeting held February 16th be delayed pending a review of the
tape recording of the meeting.
On motion by Commissioner Wilcox, seconded by Commissioner

Turner, the Court voted unanimously to approve the minutes of
the meeting held February 23, 1987 as submitted.
The County Judge laid before the Court a letter from the
Texas Justice Court Training Center advising that Justices of
ii the Peace Mary C. Horn, Ray Mack Truelove, and Antone Dobrovolny
I~ had successfully completed a twenty hour course in the duties of ;
the office of Justice of the Peace and that it be entered into
the minutes of the meeting.
I The Court next considered a request from the manager of
lj Data Processing for authorization for an employee in that
I~ department to attend a conference in Salt Lake City, Utah. Mrs.
Deen indicated that this conference covered all aspects of the
I
new computer equipment, whereas other conferences she had
considered covered only (-3rtain functions which would
necessitate the employee attending several conferences to get
the same training. The County Judge recommended approval of the
request, whereupon Commissioner Wilcox moved to grant the
request and authorized the employee to attend the conference.
The motion was seconded by Commissioner Cooley and carried
unanimously.

I Next to be discussed were Lease Agreements with the Brazos
Valley Art League and Brazos Valley Museum for the lease of
space at the Brazos Center. On motion by the County Judge,
~i seconded by Commissioner Wilcox , the Court voted unanimously to

authorize the County Judge to execute the leases on behalf of
II Brazos County. A full copy of both Lease Agreements is attached I

,i hereto.
~I The meeting proceeded with the Court considering Budget

ii Amendment No. 5 for various departments. This amendment would
increase the General Fund Budget by $6,631. On motion by
j Commissioner Cooley, seconded by Commissioner Turner, the Court

voted unanimously to approve the budget amendment, a copy of
which is attached to and made a part of these minutes.

Grocery Company. On motion by Commissioner
Wilcox seconded by Commissioner Turner, the Court
voted unanimously to accept the recommendation
of the Sheriff and award the contract to Brenham
Wholesale Grocery Company and award the alternate
contract to Readfield Meat & Freezer Service for
item #2 45 lbs. Beef Round Tip which Brenham
Wholesale Grocery did not bid.

COUNTY OF BRAZOS -
A RESOLUTION AUTHORIZING APPLICATION FOR GRANT
TO REPLICATE MODEL JUVENILE JUSTICE PROJECTS
WHEREAS, the Governor of Texas, through the Criminal Justice Division, under
the provisions of the Juvenile Justice and Delinquency Prevention Act and
within the authority of the Texas Family Code, has set forth a program to
provide special services for juvenile offenders; and
WHEREAS, in implementing the aforementioned program, the Governor is making
grant funds available for the position of Volunteer Coordinator; and
WHEREAS, the Juvenile Court serving Brazos County has continuing need for
a wide range of services to be provided to selected juveniles through a
Volunteer Program.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONER'S COURT OF BRAZOS COUNTY
at its meeting on the 23rd day of March, 1987, that:
1. The County Judge of Brazos County be authorized to make applica-
tion to the Criminal Justice Division, Office of the Governor,
for grant funds to be used for the position of Volunteer Coordi-
nator;
2. The County Judge be authorized to accept such grant funds should
they be tendered;
3. This Resolution become effective upon its adoption.

WHEREAS, the County Attorney is in need of expansion of its Family
Violence Unit; and
WHEREAS, grant funds may be available through the Criminal Justice
Division - Justice Assistance Act; and
MIEREAS, the County Attorney has prepared the grant proposal; now
therefore
BE IT RESOLVED by the Brazos County Commissioner's Court; that
1. The Commissioner's Court shall join the County Attorney's
application for grant funds; and,
2. Those matching funds, in the form of space, construction,
equipment, and salaries are hereby designated for use by the
County Attorney's Family Violence Unit.

LEASE AGREEMENT
•
This agreement is made between BRAZOS COUNTY, TEXAS, hereinafter called Lessor,
and BRAZOS VALLEY ART LEAGUE, hereinafter called Lessee is as follows;
Lessor, the Owner of the Brazos Center, a multi-use building and the adjacent
grounds has agreed and does hereby agree, to lease and demise unto Lessee, a portion

of the Brazos Center, hereinafter described, upon,the following terms and conditions.
1. Lessee shall be entitled to the space allocated to it by the
Director of the Center for a term beginning March 1, 1987 and
ending February 28, 1988. The space allocated to Lessee is de-
scribed in Attachment "A" hereto, which has been signed by the
Director of the Center.
2. A. In consideration therefore, Lessee agrees to pay the Lessor
on the first day of each calendar month during the term hereof,
in advance, the sum of $50 representing the agreed monthly rental
for use of such space as herein set forth.
B. In addition Lessee has permission to use concourse space, as
scheduled with (and convenient to more extensive uses of) the
• Brazos Center for three art shows per year, namely the annually
held Juried Art Show, the Nature in Art Show and the Youth Art
Show. Other space used in conjunction with either show shall
require satisfactory payment for additional space.
3. Lessee agrees to arrange and hang work of local artists on a
continual basis in Showcase III. Artists works chosen to be
spotlighted are the sole responsibility of Lessee. At least
ten artists per year will be featured.
4. Lessor shall furnish all utilities, including gas, water and
electricity.
5. Lessee will pay the regular User fees for space used by it,
other than space allocated to it under this agreement.
6. Lessor does not provide and will not provide furnishings, cust-
odial care, or maintenance of the space allocated to Lessee under
this agreement.
7. Lessee shall take good care of the space allocated to it, reason-
able wear and tear only excepted, and shall surrender the premises
at the termination of this agreement.
8. Lessee agrees that no improvements to or alterations to the space
shall be made without the consent of Lessor in writing.
9. Risk of loss of all property owned by Lessee shall remain with
Lessee, it being understood that Lessor will maintain no in-
surance on such property. Any insurance desired by Lessee on Lessee's
property shall be purchased by Lessee at its expense.

10. Lessor shall not be liable to Lessee or the Lessee's employees for
any damage to person or property caused by the negligent act of Lessor,
its agent, servants, or employees or due to the act of any other
tenant in the building, or due to any defect or want of repair in
any part of the building of which the allocated space forms a part.
11. Lessee agrees to hold Lessor harmless from any and all claims,
damages, expenses, including attorney's fees, growing out of or
arising form any negligent act on the part of Lessee, its agents,
servants or employees.
12. No sign shall be placed at, on, or about the premises by Lessee
except with the approval of the Center Director in writing.

LEASE AGREEMENT
This agreement between BRAZOS COUNTY, TEXAS, hereinafter called Lessor, and
BRAZOS VALLEY MUSEUM, hereinafter called Lessee, is as follows:
Lessor, the Owner of the Brazos Center, a multi-use building and the adjacent
grounds has agreed and does hereby agree to lease and demise unto Lessee a portion
of the Brazos Center, hereinafter described upon the following terms and conditions:
i 1. Lessee shall be entitled to the space allocated to it by the
Director of the Center for a term beginning March 1, 1987 and
ending February 28, 1988. The space allocated is described in
Attachment "A" hereto, which has been signed by the Director of
the Center and the Judge of the Brazos County Commissioner's

Court. Lessor agrees to provide space designated in Attachment "A"
for Lessee's use during the term of this agreement.
2. A. In consideration therefore, Lessee agrees to pay to Lessor on
or before the first day of each month during the term hereof, the
sum of $104.00 representing the agreed monthly rental for the use
of such space as herein set forth;
B. and two dollars ($2) per camper per week for day camp sessions.
3. Lessor shall furnish all utilities, including gas, water and
electricity.
4. Lessee will pay the regular User fees for space used by it, other
f than space allocated to it under this agreement.
5. Lessor does not provide and will not provide furnishings, custodial
care or maintenance of the space allocated to it under this agreement.
6. Lessee will be responsible for having an individual and/or an
automatic answering device to answer the telephone during the
announced business or visiting hours.
7. Lessee agrees that it will be open on Saturdays and Sundays at hours
agreed to by the Center Director and Lessee, and if specifically re-
quested, will serve as the Center authority on those days.
8. Lessee shall take good care of the space allocated to it, reasonable
wear and tear only excepted, and shall surrender the premises at the
termination of this agreement if Lessee fails to meet obligations
delineated in this contract.
9. Lessee agrees that no improvements to or alterations to the space
shall be made without the consent of Lessor in writing.
10. Risk of loss of all property owned by the Lessee shall remain with
Lessee, it being understood that Lessor will maintain no insurance
on such property. Any insurance desired by Lessee on Lessee's
property shall be purchased by Lessee at its expense.

11. Lessor shall not be liable to Lessee or its agents or employees for
any damage to person or property caused by the negligent act of any
Lessor, its agents, servants, or employees or due to the act of any
other tenant in the building, or due to any defect or want of re-
pair in any part of the building of which the allocated space forms
a part.
12. Lessee agrees to hold Lessor harmless from any and all claims,
damages and expenses, including attorney's fees, growing out of or
arising from any negligent act on the part of Lessee, its agents,
servants, or employees.
13. No sign shall be placed at, on, or about the premises by Lessee
except with the approval of the Center Director in writing.
14. Lessee agrees to abide by the rules determining types, housing,
maintaining and reporting inventory of wild animals in the Brazos
Center entitled Attachment "B" which is incorporated in the Lease
Agreement between BRAZOS COUNTY, TEXAS and the BRAZOS VALLEY MUSEUM
and duly signed by the Museum Director and Board President.
15. Lessee agrees to have a minimum of four different exhibits annually
displayed in the Brazos Center showcases.
16. Lessee is granted permission to sell merchandise on the premises
provided that merchandise is secondary to the principal objective
of Lessee's occupancy of the premises.
17. Lessee may, when available, use space entitled Classroom AB for
temporary purposes, after clearing dates with the Center scheduler.
All other space used other than that herein defined will require fees
normally charged. Use of such space is on a first-received request
basis.

1.1 No venomous animals.
1.2 All snakes should be housed in locked cages.
1.3 Birds must not be maintained on a permanent basis; no birds will be
free-flying; any cages being used will be cleaned daily.-
1.4 No large animals will be allowed. "Large" is defined as those re-
quiring more than 10 cubic feet of space in order to be properly
maintained.
1.5 All live animals will be used for educational purposes only. No
exotic animals will be permitted.
II. CONTAINMENT AND MAINTENANCE
2.1 All animals will be kept in maximum sanitary conditions.
2.2 A rigid cleaning schedule will be maintained.
2.3 Feeding schedule will be followed.
2.4 All foods must be stored in tightly covered containers.
2.5 Numbers of animals kept shall be permitted as space allows.
2.6 Animals will be checked regularly (at least once per month)
and on schedule, for parasitesand diseases.
2.7 Any diseased animal will be treated, released or sacrificed.
III. INVENTORY
An inventory of animals including a description of each will be kept up to
date and on file at the Brazos Center office.
3.1 No more than 30 vertebrate animals (excluding fish and mice) may be
kept on the premises at one time.
3.2 Animals allowed include:
Fish (in aquariums)
Snakes under 5 feet in length (see 1.1 and 1.2 above)
Lizards
Frogs
Mice (no more than 15 adults)
Flying squirrels
Small turtles under 6' in shell length
3.3 Animals prohibited include:
Rabbits
Rats
Squirrels
Racoons
Armadillos
Opossum
All other animals may be kept only by agreement between the Museum

BUDGET AMENDMENT(S) FOR THE 1987 BUDGET YEAR

On this the 24th day of March 1987 at a special session of the
Commissioners' Court the following members were present:
R. J. Holmgreen, County Judge, Presiding
Bill J. Cooley, Commissioner, Precinct 1;
Walter Wilcox, Commissioner, Precinct 2;
Billy E. Beard, Commissioner, Precinct 3;
Milton Turner, Commissioner, Precinct 4;
Frank Boriskie, County Clerk.
The following proceedings were held:
THAT WHEREAS, on March 24, 1987, the Court heard and approved a
budget amendment for the 1987 budget year for Brazos County, Texas.
WHEREAS, an emergency expenditure is necessary due to grave public
necessity to meet unusual and unforeseen conditions which could not
be reasonably included in the original budget adopted October
27, 1986, the following amendment(s) to the original are hereby
authorized, as described on the attached 3 page(s).
ADOPTED AND APPROVED this the 24th day of'March, 1987
