Other Business VO PAGE ao I i • • E ~ t i I 1 I I I COMMISSIONERS' COURT SPECIAL MEETING 1 MARCH 2, 1987 A special meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A.M. on Monday, March 2, 1987, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk absent. G. Edwards & Sons The County Judge recognized Anne Bell representing the Bryan/College Station Convention & Visitors Bureau. Ms. Bell introduced Jack Speer, Executive Vice President of the Chamber of Commerce and Mary Brannen, Gloria Norman and Kim Autrey who distributed literature and material inviting the members of the Court and the public to the Hospitality Fair at the Brazos Center on March 4, 1987 from 2-8 p.m. The Hospitality Fair is being presented to encourage organizations to bring meetings and conferences to the Bryan/College Station area. , VOL Commissioners' Court meeting March 2, 1987 Davis McGill representing A. G. Edwards & Sons presented an ORDER APPROVING AND AUTHORIZING PUBLICATION OF NOTICE OF !i INTENTION TO ISSUE CERTIFICATES OF OBLIGATION in the amount of ii $4,500,000 for the purpose of providing for the payment of i~ contractual obligations to be incurred for road and bridge ~I 'I rights-of-way acquisitions and improvements and the payment of I contractual obligations for professional services related I li thereto. Mr. McGill read aloud the order in full for the Courts' consideration. Commissioner Wilcox moved that approval of the Order be delayed until the next meeting. Mr. McGill sited the need for speed in posting the order so as to meet all i i the filing requirements dictated by law. The County Judge asked ;I'%for a second to the motion made by Commissioner Wilcox; the motion died for lack of a second. On motion by Commissioner ' Beard, seconded by Commissioner Cooley; Commissioners Beard, Cooley and Turner voted "Aye"~ Commissioner Wilcox voted "No". Commissioner Beard moved to publish the Notice of Intent to li Issue Certificates of Obligation. The motion was seconded by i I~ Commissioner Cooley with Commissioners Beard, Cooley and Turner i voting "Aye". Commissioner Wilcox voted "No", whereupon the County Judge announced the motion carried. A full copy of the Notice and Order are attached hereto. i On motion by Commissioner Turner, seconded by Commissioner Cooley, the Court voted unanimously to approve the names j submitted by Topaz Huges, President of the Child Protective Service Board of Brazos County and appoint the following people to the Board: Dr. Mark Sicilio Marsy Clarke Richard Shahan Next to be discussed were the following bids: Bid No. 87-334 - Meat Contract for March for the County Jail. Rebecca Shults, Purchasing Agent, advised the Court that Brenham Wholesale, the low bidder, had been notified of the Court's intention to award the bid to Readfield Meats, the second low bidder and that they V® L 7- PAG 0 • Commissioners' Court meeting March 2, 1987 had declined to appear before the Court. Ms Shults further advised the Court that the Jail Administra- tor preferred awarding the bid to Brenham Whole- sale. On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court voted unanimously to award the contract to Readfield Meat & Freezer Service. After considerable discussion, Commissioner Beard moved to award the contract to Texas Crushed Stone, with the alternate bid to Glen Fuqua. Receiving no second to the motion, Commissioner Cooley moved to award the contract to Young Brothers and to Glen Fuqua, Inc. as alternate and to notify the low bidder. The motion was seconded by Commissioner Turner and it carried unanimously. Rebecca Shults, purchasing agent, advised the Court that several surrounding counties were planning to have an area auction to sell surplus property and asked the Courts opinion on Brazos County participating in the sale. On motion by Commissioner Beard,•seconded by Commissioner Cooley,the Court voted unanimously to authorize the purchasing agent to pursue the issue and report her findings to the Court. • The County Judge laid before the Court a request submitted by Bryan Woodbine Gathering, Inc-for installation of a 6 inch steel pipeline crossing the right-of-way of Boatcallie Road. On motion by Commissioner Beard, seconded by Commissioner Cooley Commissioners, Court meetig March 2, 1987 the Court voted unanimously to authorize the installation of a steel pipeline by Bryan Woodbine Gathering, Inc.. A full copy of the request is attached to and made a part of these minutes. On motion by Commissioner Beard, seconded by Commissioner Cooley, the Court voted unanimously to submit a letter to Mr, Dealy Carol trading a portion of property off Old Weedon Road i right-of-way for the new section of right-of-way on Old Weedon i Road. The purpose of this trade is to work in conjunction with the State Department of Highways and Public Transportation on the straightening of State Highway 30. There being no further business to come before the Court, the meeting was adjourned. SIGNED AND SEALED this 30th day of March, 1987. t County -Clerk County Judg6 (COMMISSIONERS COURT SEAL) VO -TPAGE 521--- • ORDER APPROVING AND AUTHORIZING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION t i , i . i WHEREAS, the Commissioners Court of Brazos County, Texas (the "Commissioners Court"), finds that road and bridge right-of-way acquisitions and improvements and the payment of contracts for professional services rendered in connection therewith (the "Contractual Obligations") would be beneficial to the inhabitants of Brazos County, Texas (the "County"), and are needed to perform essential governmental functions; r WHEREAS, the Commissioners Court has determined that certificates of obligation (the "Certificates") should be issued pursuant to the provisions of the Certificate of Obligation Act of 1971, Article 2368a.1, Vernon's Texas Civil Statutes, as amended (the "Act"), for the purpose of financing the Contractual Obligations; and WHEREAS, prior to the issuance of such Certificates, the +I Commissioners Court is required under the Act to publish notice of its intention to issue the Certificates in a newspaper of general circulation in the County the notice stating (i) the time and place the Commissioners Court tentatively proposes to pass the order authorizing the issuance of the Certificates, (ii) the maximum amount of Certificates proposed to be issued, (iii) the purposes for which the Certificates are to be issued, and (iv) the manner in which the Commissioners Court proposes to pay the i Certificates; „II NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT OF 1 BRAZOS COUNTY, TEXAS, THAT: SECTION 1. That all roads be bored to forty feet (40') on either side of the centerline of the right-of-way or cased for such distance. 8. That all sites will be barracaded during construction period. 9. That the normal charge is $500 per crossing and/or $40 per rod when paralleling the roadway established by the Commissioners' Court on January 28, 1985.
