Other Business • Closed Executive Session with Attorney to discuss lawsuit. i COMMISSIONERS' COURT SPECIAL MEETING FEBRUARY 16, 1987 t k V0 A special meeting of the Commissioners' Court of Brazos . I ' County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 ~ A.M. on Monday, February 16, 1987, with the following members of i the Court present: R. J. Holmgreen, County Judge, Presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The first matter to be considered by the Court was approval 1 of the minutes of the Commissioners Court meeting held February I J ! 2, 1987. On motion by Commissioner Wilcox, seconded by Commis- i I ! sioner Turner, the Court voted unanimously to approve the I minutes as submitted. The Court next considered a request from Wellborn Water ~f Corporation to install a waterline in the right-of-way of I&GN I~ i Road in Precinct 1 from FM 2818 to Holleman Drive. After some I discussion as to whether the County was indeed the owner of the 4j property in question, the County Judge moved to approve the PAG 14 • • I; Commissioners' Court meeting February 16, 1987 installation subject to verification of ownership of this property. The motion was seconded by Commissioner Cooley and carried unanimously. A full copy of the permit is attached hereto. Next to be considered was Budget Amendment #25 to the 1986 budget. The amendment was to balance the Road and Bridge budqet. On motion by Commissioner Cooley, seconded by Commissioner Turner, the Court voted unanimously to approve the amendment as submitted. A full copy of the amendment is attached to and made a part of these minutes. The Court next considered the appointment of the Brazos County Historical Commission for the 1987-88 term. The County Judge suggested reappointing the current commission members and the addition of the following persons for the next term: Jody Bates Dr. Gary Halter Stephen C. Beachy Ryan Smith Dr. Charles R. Schultz On motion by Commissioner Beard, seconded by Commissioner Wilcox, the Court voted unanimously to appoint the following persons to the Brazos County Historical Commission for the 1987- 88 term: Dr. James L. Boone, Jr. Dr. J. Milton Nance Mrs. Jody Bates Mrs. Eleanor Hanover Nance Mr. Stephen C. Beachy Mr. Billy E. Beard Dr. J. Russell Bradley Dr. Rand B. Evans Dr. Gary Halter Mr. Walter Carl Jones Dr. Paul Van Riper Dr. Charles R. Schultz Mr. D. Ryan Smith Mrs. Madge Wallace Mrs. Mary Bess Young The County Judge next recognized Mr. C. Wendell Horne who addressed the subject of the Pate Road right-of-way. Mr. Horne stated that he and fellow land owner, Dr. Jim Anderson had donated 100 feet of right-of-way along Pate Road in March of 1984 and the County had agreed to construct a road and maintain it with a long term plan of it becoming an arterial type road. He inumerated several delays and obstacles that had been over- come in particular he mentioned the pipeline and said: Von. 7- pr-r-p: 7 Commissioners' Court meeting February 16, 1987 I' "So the next time we inquired, we understood there ~i was a question about the pipeline. This has been worked on and has now been resolved." i and then stated that they still did not have their road ~j constructed. it Commissioner Beard moved to proceed immediately with I j r t VC) ` construction of the road, Commissioner Cooley seconded the motion. Commissioner Wilcox stated that the original figure of $6,000 deposited with the County was to cover the cost of materials only and that any other cost of completion would have to be paid by the landowners. At that point the County Judge ' called for a vote on the motion. Commissioners Cooley, Beard and Turner voted "Aye". Commissioner Wilcox voted "No". P/T Davis, Sheryl Sheriff's Office Step Increase I Hanna, Annette District Attorney Promotion On motion by Commissioner Turner seconded by Commissioner Cooley the Court voted unanimously to approve the changes as submitted. AGE 8$ • • • Commissioners' Court meeting February 16, 1987 I At 10:30 a.m, the County Judge announced the meeting closed to the public so that the Court could meet in executive session I I with legal counsel, W. R. Vance, to discuss pending litigation. ; I' The meeting was thrown open to the public at 10:50 a.m. whereupon Commissioner Cooley moved that Hays, McConn, Price and Pickering, attorneys representing employees of Brazos County in a case styled Roland Lee Goad vs John Andrew Rollins, et al, in the United States District Court Southern District of Texas, be authorized to file the stipulation attached as Exhibit "A" on behalf of Brazos County. The motion was seconded by Commis- sioner Beard and carried unanimously. There being no further business to come before the Court, the meeting was adjourned. 4 VOL_7- PAGE I 51 . Texas as follows: The location or description of the proposed installation is more fully shown by copies of the drawings attached to this notice. I understand and agree that: 1. The Commissioner of the Precinct in which the right-of-way lies must be notified prior to the beginning of construction in order that the Commissioner might be on hand to designate the actual location of the installation. 2. That all damage to the roadways and rights-of-way will be repaired to their original condition to the satisfaction of the Commissioner in which the roadway or right-of-way lies. 3. That Brazos County reserves the right to require Applicant to relocate or lower any ouch line at no cost to Brazos County, should same become necessary due to widening or lowering, or other alteration of the roadway or right-of-way. 4. That Brazos County will in no way be responsible for any damage that might occur to any existing utility lines in the right-of-way. 5. That the line will be constructed and maintained on the county right-of-way in accor- dance with governing laws. 6. That the line or lines will be constructed no less than forty-eight inches (48") lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (2') below the center of the roadway. 7. That all sites will be barricaded during the construction period.
