Other Business • • i t i 4 V 9 r-I r r-) r r - , COMMISSIONERS' COURT SPECIAL MEETING FEBRUARY 2, 1987 A special meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A.M. on Monday, February 2, 1987, with the following members of the Court present: R. J. Holmgreen, County Judge, absent; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2, Presiding; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Administrative Assistant Carol Snedeker County Judge's Admin. Asst. Bea Green Secretary to Commissioners Sharon Fairchild Auditor Rebecca Schults Purchasing Billy Eubanks County Engineer Sandy Walker Treasurer Terri White Treasurer's Office Ronnie Crocker Bryan/College Station Eagle Travis Nelson District Clerk Chuck Clements WTAW The first matter to come before the Court was approval of the minutes of the Commissioners' Court meeting held January 12, 1987. On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court voted unanimously to approve the minutes as submitted. V ® PAG- E Commissioners Court meeting February 2, 1987 The Court proceeded to consider the following Budget Amendments: 1. Budget Amendment #23 to the 1986 Budget which • reallocates funds in 2. Budget Amendment #04 the to Welfare Budget. the 1987 Budget which transfers funds from the Court Administration Budget to the budgets of the County Court at Law I County Court at Law I I, 85th District Court, 272nd District Court and 361st District Court. On motion by Commissioner Cooley, seconded by Commissioner Turner, the Court voted unanimously to approve the Budget Amendments as ' submitted. A full copy of both Budget Amendments are attached to and made a part of these minutes. Commissioner Beard reported on the meeting of the Committee to study proposals from various firms proposing to contract with Brazos County for the collection of delinquint taxes. Commissioner Beard reported that the Committee was unanimous in the decision to continue the contract with Gates Steen. Commissioner Beard moved to enter into contract with Gates Steen for the collection of delinquent taxes. The motion was seconded by Commissioner Wilcox with Commissioners Beard, Wilcox and Turner voting "Aye". Commissioner Cooley voted "No", whereupon Commissioner Wilcox announced the motion carried. A full copy of the contract is attached hereto. The Court next considered a request from Wixon Water Supply Corporation for authoriz ation to install a service pipeline across the right-of-way of Lori Lane in Precinct 3. On motion by Commissioner Beard, seco nded by Commissioner Wil cox, the Court voted unanimously to grant the request and authorized the installation of the water line. A copy of the authorization is attached hereto. Under other business, the County Auditor advised the Court that Sysco Foods Service had been advised that the contract for supplying meat to the County Jail had been awarded to Readfield Meat and Freezer Company and that Sysco Food Service did not wish to address the Court on the matter. Commissioner Cooley reminded the Court that he had been authorized to negotiate the trade of a tract of land adjoining the property purchased for the expansion of the County landfill at Millican. Commissioner Cooley reported that an agreement had been reached for the trade of the 26.25 acres. Commissioner Cooley moved to authorize the County Judge to sign the necessary documents to accept the deed for 26.25 acres of land from Peggy Benton; after receipt of the deed to authorize the County Judge to sign the final plat of Millican North Subdivision; after recording the plat of Millican North, to authorize the County Judge to execute the Deed to Peggy Benton for Reserve Tract 1 of Millican North. I. First Party agrees to employ and does hereby employ Second Party to enforce by suit or otherwise the collection of all delinquent taxes, penalty and interest owing to the County of Brazos, which said taxes, penalty and interest are collected through the offices of First Party's tax assessor and collector. It is provided that current year taxes falling delinquent within the period of this contract shall become subject to its terms on the first day of July of the year in which same become delin- quent by law. II. Second Party is to call to the attention of the collector or other officials any errors, double assessment or other discrepancies coming under his observation during the progress of the work, and is to intervene on behalf of First Party in suits for taxes hereafter filed by any taxing unit on property located within the corporate limits of the County of Brazos. First Party agrees to pay to Second Party as compensation for the services required hereunder fifteen percent (15X) of the amount collected of all delinquent taxes, penalty and interest of the years covered by this contract, actually collected and paid to the collector of taxes during the term of this contract, as and when col- lected. All compensation above provided for shall become the property of Second Party at the time payment of the taxes; penalty and interest is made to the collector. The collector shall pay over said funds monthly by check. III. This contract is drawn to cover the period beginning January 1, 1987, and ending December 31, 1988, provided however that Second Party shall have an additional V0 L PAC E, / 5~ 1 r six months to reduce to judgment all suits filed prior to the date last mentioned, • and provided further that Second Party shall handle to conclusion all suits in which trial court judgments are obtained during the period of this contract and which are appealed by any party. This contract will continue in full force and effect after the expiration date by its own terms unless First Party notifies Second Party that it does not wish to renew and continue the agreement. In consideration of the terms and compensation herein stated, Second party hereby accepts said employment and under- takes the performance of this contract as above written. This contract is executed on behalf of First party by the presiding officer of its governing body who is authorized to execute this instrument by order hereto- fore passed and duly recorded in its minutes. COUNTY OF BRAZOS, First Party 4& l~ u By: 64/c, County Judge 7 i Gates Steen, Second Party RESOLUTION AND ORDER On this the 2nd day of February , 19 87 , at a Special meeting of the Commissioners' Court of Brazos County, Texas, there came on for consideration the making of a contract for the collection of delinquent taxes, and motion was made by Commissioner Beard , County Commissioner of Precinct No. 3 seconded by Commissioner Wilcox , County Commissioner of Precinct No. 2 , said Commissioners' Court in behalf of said County do make and enter into a contract with Cates Steen, a licensed attorney, for the latter to collect delinquent taxes in said County for 15Z of the amount of taxes, penalty and interest collected, said contract to end on the 31st day of December, 1988, with six months thereafter to complete pending suits. That all damage to the roadways and rights-of-way will be repaired to their original condition to the satisfaction of the Commissioner in which the roadway or right-of-way lies. 3. That BRAZOS COUNTY reserves the right to require Applicant to re- locate or lower any such line at no cost to BRAZOS COUNTY, should same become necessary due to widening or lowering, or other alter- ation of the roadway or right-of-way. 4. That BRAZOS COUNTY is in no way responsible for any damage that might occur to any existing utility lines in the right-of-way. 5. That the line will be constructed and maintained on the county right- of-way in accordance with governing laws. 6. That the line or lines will be constructed no less than forty-eight inches (48") lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (2') below the center of the roadway. 7. That all roads be bored to forty feet (401) on either side of the centerline of the right-of-way or cased for such distance. 8. That all sites will be barracaded during construction period. 9. That the normal charge established by the Commissioners' Court is $500 per crossing and/or $25 minimum per rod when paralleling the roadway.
