Other Business VO PAGE---L.- r, COMMISSIONERS- COURT SPECIAL MEETING OCTOBER 27, 1986 A special meeting of the Commissioners- Court of Brazos County, Texas, was held in the Commissioners- Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A.M. on Monday, October 27, 1986, with the following members of the Court present: . R. J. Holmgreen, County Judge, presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. Morris Visitor Florence Kling Republican Party of Brazos County Jim Kuboviak County Attorney The first item on the agenda was the discussion of Bid No.297-: Fourth Quarter Dairy Contract for the county jail. The bids had been considered at the Commissioners- Court meeting held on September 15, 1986 with the Court selecting the high bid of Lilly Dairy Products. The decision to acce2t the bid of Lilly Dairy Products was based on the fact that they were locally based. The I VOL -T_ PAG i lr r i 1 1 II u. Mr. Lamar Kristof, representing Oak Farms Dairies advised the Court of Oak Farm Dairies connection with local business. He indicated that Oak Farms Dairies • paid $30,000.00 in Property taxes in Brazos County, that they are owned by Southland Corporation who also owns the thirteen (13) Seven-Eleven Stores, that they are involved in local fund raising projects, that they furnish dairy products to A&M Consolidated schools, Texas A&M, St. Joseph Hospital, all Seven-Eleven Stores and Tanner Dairy Queens. Mr. Kristof stated that the bid of Oak Farms r I` • A Dairies had been submitted in good faith and was willing to abide by the Court's final decision. Commissioner Beard, moved to rescend the order adopted by the Commissioners Court at the meeting held September 15, 1986 awarding the dairy contract to Lilly Dairy. The motion was seconded by Commissioner Turner and carried unanimously. Commissioni:•r Cooley then moved to accept the low bid of Oak Farms Dairies and to award the dairy contract to Oak Farms Dairies. The motion was seconded by Commissioner Beard and carried unanimously. The Court next considered approval the minutes of the Commis- sioner's Court meetings held August 25, 1986, September 8, 1986, Workshop sessions on the County Budget held September 8, 1986 through September 12, 1986, Commissioner's Court meetings held September 15, 1986, Sept., oi.r 29, 1986, October 9, 1986 and Public Hearing on the increase cF the 1986 Tax Rate held October Q, 1986. On motion by Commissioner :'aoloy, seconded by Commissioner Turner, the Court voted unanimously to approve the minutes as submitted. The next matter to be considered were amendments to the 1986 budget for various departments. The amendments would increase the General Fund Budget by $6,700.00. On motion by Commissioner Beard, seconded by the County Judge, the Court voted unanimously to approve the amendments as submitted. A full copy of the amendments are attached hereto. The meeting continued with the appointment of the following Election Judges and Election Judge Alternates to fill vacancies created by previously appointed persons: Bruce Jones Alternate Judge Precinct 20 Randy Goldsmith Election Judge Precinct 34 Perry Shirley Alternate Judge Precinct 37 Jim Ward Alternate Judge Precinct 39 On motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to appoint the above referenced persons. On motion by Commissioner Wilcox, seconded by Commissioner Beard, the Court voted unanimously to adopt an order certifing that Brazos County had 469.95 miles of roads which were maintained exclusively by Brazos County. The number of county maintained road miles will be used by the County Tax Assessor/Collector to compute the distribution of automobile registration fees collected in the 1987 calendar year. A full copy of the order is attached to and made a part of these minutes. The next matter was consideration of a contract between Brazos County and the City of College Station which would authorize the Tax Assessor/Collector to assess and collect taxes for the City of College Station. On motion by Commissioner Cooley, seconded by Commissioner Wilcox, the Court voted unanimously to authorize the County Judge to execute the contract on behalf of Brazos County. A full copy of the contract is attached to and made a part of these minutes. A contract with Gates Steen for the collection of delinquent taxes was next considered by the Court. Mr. Winn, Tax Assessor/ Collector, stated that John Sandstedt and Jeff Brown had indicated an interest in the collection of delinquent taxes for the County. John Sandstedt cf Sandstedt & Gose addressed the Court presenting the qualifications of his firm in the collection of the delinquent taxes and asked that his firm be considered . He requested that the contract be for a two year term, and contain a dissolution clause at the Court wishes. The County Engineer requested VOL ~AG satisfactorly, however he was also interested in doing business with local attorneys and did not feel he could make a recommendation. On motion by Commissioner Beard, seconded by Commissioner Cooley, the Court voted unanimously to delay action on the contract to allow time to request additional proposals and to receive input from the other taxing entities. The Court next considered two requests from Bryan Woodbine Gathering, Inc. for authorization to install pipelines across the following rights-of-way: 1. One pipeline, gas or oil across the right-of-way of MaLino Road in Precinct 2. 2. One pipeline, gas or oil across the right-of-way of Crosswinds Drive in Precinct 2. on motion by Commissioner Wilcox, seconded by Commissioner Beard, the Court voted unanimously to grant the request and to authorize the installation of the pipelines. A copy of both applications are attached hereto. The meeting continued with the consideration of Kemp Road dedication in Precinct 4. Billy Eubanks, County Engineer stated that the road has been used by the public for a number of years without it having been platted and an attempt is being made to plat the road and a determination of the requirements for the County to maintain the road. It was indicated that prior verbal agreement had been given by Commissioner Cooley and later by Commissioner Stasny that the road was satisfactory for County maintenance. The road is a 60 foot right-of-way without utility easements. On motion by Commissioner Turner, seconded by Commissioner Beard, the Court voted unanimously to approve the road dedication conditioned on: 1. Improvement of the drainage ditches 2. The County Attorney presented a request for authorization for two employees in the County Attorney's office to attend a three day computer programing seminar in Shawnee Mission, Kansas. The em- ployees would learn to program the recently purchased computer for hot check collection. Mr. Kuboviak stated that this computer would tie into the Texas and National check information centers. Commissioner Wilcox requested that Dr. Colunga be allowed to review the system and program to be utilized. Commissioner Cooley asked why the cost should not be paid from Hot Check funds. After considerable discussion, Commissioner Cooley moved to authorize the expenditure of $1,500.00 for the training. The motion was seconded by Commissioner Wilcox and carried unanimously. On motion by the County Judge, seconded by Commissioner Beard, the Court voted unanimously to deny payment for additional computer equipment that had not been approved by the County's computer consultant, Dr. Colunga. On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court voted unanimously to deny payment for out of state travel expenses that had not received prior approval of the Commis- sioner's Court. The exception to this action is the apprehension of criminals and/or the gathering of evidence for criminal cases.
