Other Business PAG F 7 5 S VOL S • • ~J COMMISSIONERS' COURT REGULAR MEETING SEPTEMBER 8, 1986 : i A regular meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A.M. on Monday, September 8, 1986, with the following members of the Court present: R. J. Holmgreen, County Judge, presiding: Bill J. Cooley, Commissioner of Precinct 11 Walter Wilcox, Commissioner of Precinct 21 Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4 Frank Boriskie, County Clerk. Burley District Clerk Billy Eubanks County Engineer Bea Green Secretary to Commissioners Sharon Fairchild Auditor Rebecca Schults Purchasing Carol Snedeker County Judge's Secretary Chuck Clements WTAW/KTAW Roger Lewis Visitor/Candidate Judy DiScipio KTAM/KORA The Court received, approved and ordered filed as submitted the following reports for August, 1986: Jim Mazurkiewicz, County Extension Agent; Mable Walker, County Extension Agent; Mike McKinney, County Extension Agent The Court received, considered and approved reports from County and Precinct Officers showing revenues collected and remitted to the County Treasurer. The first matter to come before the Court was a plan providing for the selection of names of persons for jury service with the aid of mechanical or electronic equipment as submitted by the District Judges of Brazos County. On motion by Commissioner Turner, seconded by Commissioner Cooley, the Court voted unanimously to approve the revised procedures. A full copy is attached and made a part of these minutes. The Court next discussed an item that had been inadvertently missed when transcribing the minutes of the Commissioners' Court meeting held April 28, 1986. The matter considered at that meeting was approval of the Final Plat of Rustic Oaks Subdivision in Precinct 3. On motion by Commissioner Beard, seconded by Commissioner Cooley, the Court voted unanimously to amend the minutes of the April 28, 1986 Commissioners' Court meeting as followss "The Court next considered approval of the final plat of Rustic Oaks Subdivision in Precinct 3. The County Engineer recommended approval of the plat, but noted the following conditions. 1. Low plasticity of base material and ditches and low CBR values. 2. Pavement will be subject to localized failures (pot holes) and washboarding. 3. Ditches will be subject to erosion. The County Engineer- recommended: a. The County reserve the right to maintain the roads as gravell b. Establish vegetation on the ditches as soon as possiblel c. That the developer provide a maintenance bond of Ten Thousand dollars ($10,000.00)1 and d. That the two year maintenance period of the roads commence today. On motion by Commissioner Beard, seconded by Commissioner Wilcox, the Court accepted the Engineer's recommendations and voted unanimously to approve the plat." Bid No 303 - Annual Road Gravel Contract, Addition #2 a. Felix Torres $4.00 per cubic yard if loaded & hauled by County $4.50 per cubic yard if loaded by Torres & Dally Co. 212 acres of material located one mile east of Hearne, Texas. This bid on nongraded crushed rock. b. Thomas Barret Lyne - $2.00 per cubic yard for first 3,000 cubic yards. $1.70 per cubic yard over 3,000 cubic yards. 760 acres of material located off FM 974 near Edge. Material already stock piled on Lyne ranch. C. Felix Torres - $1.40 per cubic yard of gravel. The County Engineer recommended acceptance of bid of Felix Torres for non graded crushed rock, and Thomas Barret Lyne for z Gravel. Commissioner Beard moved acceptance of all bids and to award the contract to both bidders to allow for flexibility in hauling. The motion was seconded by Commissioner Cooley and carried unanimously. The next item to come before the Court was the request from Wixon Water Supply Corporation to install pipeline within the right- of-way of the following county roads: 1. Installation of a 2 1/2 inch PVC water pipeline across the right of way of Bird Pond Road in Precinct 1; 2. Installation of a 4 inch PVC water pipeline across the right of way of Grassburr Road in Precinct 3. On motion by Commissioner Wilcox and seconded by Commissioner Beard the Court voted unanimously to approve both requests and authorized the installation of the pipelines. A full copy of both applications is attached hereto. The Court proceeded to consider the final plat of the Arnold 'Tract in Precinct 1. Commissioner Wilcox moved to grant a variance from the subdivision regulations regarding the width of the right of way for the road in Tract •A" and to approve the final plat. Under other business the County Judge stated that he had received the construction placques for the Courthouse addition and stated that the Architect had recommended placing them on the blank wall across from the elevator on the ground floor of the Courthouse. It was the consensus of the Court that that would be the appropriate location. Commissioner Wilcox displayed a Safety Placque that had been presented to him, as Safety Coordinator for the County. The placque was presented by the Texas Association of Counties for the County's excellent safety record. The source of prospective jurors for jury service is the current voter registration lists from all the precincts in Brazos County, Texas, an certified by the Tax Assessor-Collector of Brazos County, Texas, which shall be entered on the prospective juror selection computer program that has been prepared for such purpose by the Data Processing Department of Brazos County, Texas, except that the names of persons listed in a register of persons exempt from jury service may not be used in preparing the record of names from which a jury list is selected as provided by Sections 62.108 and 62.109, Texas Government Code. II. OFFICIAL IN CHARGE The Clerk of the District Courts of Brazos County, Texas, herein called the "Clerk", is designated as the official to be in charge of the prospective juror selection process, and shall have the duties and authority as set forth herein. Ill. PRESIDING JUDGE FOR PROCESSING THE PROSPECTIVE JUROR LIST(S) • The local administrative judge provided by Article 200 a-l, Section 5.001, V.A.T.S. (or designee) shall act as the presiding judge for processing the prospective juror list. IV. ACCESS TO VOTER REGISTRATION LIST The Tax Assessor-Collector of Brazos County, Texas, shall, as part of his present, regular duties, maintain a current voter registration list. -I- VO L 6 PAGE 7 7 5- from the voter registration list, the Tax Assessor-Collector (or designee), shall be the only person with access to the voter registration list, and such access shall be for updating purposes only. The Tax Assessor-Collector gains access to the voter registration list only by entry into the computer of the particular security code isslled to the Tax Assessor-Collector for this purpose. Such security code shall be in the sole possession of the Tax Assessor-Collector of Brazos County, Texas (or designee). The Jury Coordinator shall have access to the Voter Regigtrntlon list for display purposes only to determine, when the need arises, the identification of a prospective juror. (e.g. when there is a "Jr." and "Sr." in the same household and the voter is registered only by last name). The identity of the person summoned can be determined'by verifying Date of Birth, Social Security Number, Birth City or Birth County. The computer will allow access on the Jury Coordinator's terminal on the Voter Registration Master Menu by requesting "Option Code 2" for "Display Registration". If any other "Option Code" is requested, the terminal will go back to "Main Menu" and will not allow access because the Jury Coordinator does not possess the security code of the Tax Assessor-Collector. i I Other than at such times as a random list of prospective jurors is obtained ; V. RANDOM SELECTION OF NAMES OF PROSPECTIVE JURORS In preparing the computer program for prospective juror selection, the Data Processing Department of Brazos County, Texas has devised a system which provides a fair, impartial and objective method of selecting names of persons for jury service with the aid of electronic or mechinical equipment. All eligible (non-jury exempt) voter certificate numbers are read into a table. This table is then shuffled using the random number generator to select numbers to re-order. The LCH generates the sequence by the relation: XN+1 - (aXN + c) mod d (KNUTH 69) where: X N+1 is the new random number, x N is a last random number, a is a large multiplier, c is a large addor, and d is a large number that determines the range of the X's avid the number of random numbers that can be generated from the sequence. There are criteria for selection a, c, and d. Proper selection yields a "good" generator where a poor selection yields a "biased" generator. The criteria (Knuth 69) for selecting a, c, and d are: let b - a - 1, then b is a multiple of every prime factor of d, b is a multiple of 4 if d is also, c is relatively prime to d, and d is large but can still be represented in one word. The actual values chosen were: a - 715,827,883 c - 3,141,592,654 d - 2,147,483,647 - 231 - 1 - 2'32'7'11'31'151'331 These came from: b - 2'3'7'11'31'151'331 - 715,827,882 a - b + 1 - 715,827,883 -3- VO PAGE` 777 Ile These values were recommended in (Knuth 69) for 32-bit computer such as the Univac System System 80. This sequence will generate a run from 0 to 2,147,483,646 0-1) in random order. No value will repeat itself until every value has been generated. Therefore there are 2,147,483,647 (d) random numbers for each starting point or seed. The sequence of numbers is different for every starting Reed. VI. LIST OF PROSPECTIVE JURORS I f i i VQ From time to time, as needed during the year, the Presiding Judge (or designee), the Jury Coordinator, the Clerk (or designee), and the Sheriff of Brazos County (or designee) shall assemble for the purpose of activating the computer for juror selection program, and thereby produce a List of Prospective Jurors. A unique security code shall be issued to each of the above named officers and protected by him/her to insure the integrity of the juror selection process. The program cannot be activated on the computer unless all three security codes are properly entered, as herein set forth. The process for activating the prospective juror Relection program is described as follows. The Jury Coordinator types in a transaction code which identifies with the Juror Selection System for Brazos County, Texas. This will cause Screen 91 to appear on the computer terminal. Screen ®1 is for the purpose of entering, the security codes of rite three officers mentioned above. In the event that a wrong code has been entered, the computer will notify the Coordinator and allow entry of the correct code. After the correct entry of all three codes, the system will "unlock" and a different screen will appear. that being Screen A2. This Screen requires the Coordinator to enter how many jurors are needed for each panel to be pulled and the summons date and time of day to appear. and loratton code. The Coordinator may enter information for up to sixteen panels in any combination of courts. This information is then sent to the computer. VII. SELECTION OF PROSPECTIVE JURORS FOR PARTICULAR WEEKS Once the Prospective Juror List has been printed by the above described process, the Data Processing Department of Brazos County, Texas, shall address a juror summons to each person on the Prospective Juror List. The Jury Coordinator will summon by First Class mail for the dates designated a sufficient number of jurors to meet the demands of the various courts using this plan. A true and complete written list of the names and i addresses of the persons summoned to begin jury service on a particular date shall be filed of record with the County Clerk at least ten (10) days before that date. VIII. RESCHEDULED PROSPECTIVE JURORS The names of persons previously called for jury service whose • service has been postponed to a later date, shall be entered as "rescheduled prospective jurors" on a list of prospective jurors to be called nt n later date. This list shall be filed with the County Clerk at least ten (10) days before the designated date of jury service. IX. ADDITIONAL PROSPECTIVE. JURORS When the number of prospective jurors previously selected for any designated date is insufficient, additional persons shall be selected, listed, and summoned in the same manner as those previously selected. X. JUDGE OF GENERAL PANEL(S) The District Judges of Brazos County shall designate any duly r~ qualified active, former, or retired Texas, Appelate, District or County Court at Law Judge as Judge of General Panel(s) to whom General Panel will report. The Judge of General Panel shall: organize, control and supervise the members of the general panel; cause the prospective jurors to be duly sworn; rule upon the qualifications, exemptions and excuses; deliver such instructions -5- II VOL- ~5 - _PAGE~ 14~ L . assigned to a particular court for duty. XI. PROSPECTIVE JURORS USED INTERCHANGEABLY The prospective jurors, duly empaneled shall constitute A general panel(s) for the week(s) for service as jurors in all District and County Courts at Law, in Brazos County, Texas, and shall he used interchangeably in all of said Courts. The Jury Coordinator acting under instructions of the Judge of General Panel(s), shall divide the general panel(s) into panels and assign such jurors to the different courts as requested by the Judges of said Courts. i as may be required or appropriate before the prospective jurors are XII. RECORD OF NAMES This plan will use the same record of names for the selection of persons for prospective jury service tintil that record is exhausted. XIII. AMENDMENTS This plan may be amended at any time by the Commissioners Court of Brazos County, Texas upon recommendation of the District Judges of Brazos County, Texas. XIV. EFFECTIVE DATE This plan shall become effective immediately upon adoption by the Brazos County Commissioners Court.
