Other Business t' f VQ pAG • 3 COMMISSIONERS- COURT REGULAR MEETING AUGUST 11, 1986 A regular meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A.M. on Monday, August 11, 1986, with the following members of the Court present: R. J. Holmgreen, County Judge, presiding: Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4 Frank Boriskie, County Clerk. The following citizens and officials were in attendance: M. J. Kling Kling Engineering The Court received, approved and ordered filed as submitted the following reports for July, 1986: Jim Mazurkiewicz, County Extension Agent; Mike McKinney, County Extension Agent; Mable Walker, County Extension Agent; Kathleen M. Barnett, County Extension Agent. The Court received, considered and approved reports from County and Precinct Officers showing revenues collected and remitted to the County Treasurer. An excerpt from those reports is attached hereto. vo PAGE '71 Y I ,~1 L Commissioners' Court Meeting, August 11, 1986, continued... • The first matter to come before the Court was to canvass the results of the Special Election for a Fire Prevention District in Precinct 2 held Saturday August 9, 1986. The County Judge read aloud the following results. Absentee Pct 5 Pct 6 Total For 4 26 31 61 Against 28 50 78 Total 4 54 81 139 On motion by Commissioner Beard, seconded by Commissioner Cooley, the Court voted unanimously to certify the cumulative results as true and correct and ordered the results recorded in the official records in the County Clerk's office all in accordance with the law. The next item on the Court agenda was a presentation by Margaret Van Bavel on the Booneville Cemetery. Due to unforseen circumstances Mrs. Van Bavel was unable to make the presentation and would reschedule. The Court next considered amendments to the 1986 budget for various departments. On motion by Commissioner Wilcox, seconded by Commissioner Beard, the Court voted unanimoulsy to approve the amendments as submitted. A copy is attached to and made a part of these minutes. The next item on the agenda was consideration of a Bridge Load Posting Program in conjunction with the State Department of Highways and Public Transportation. The state would evaluate all bridges on county roads and provide the necessary signs with Federal funds. The county would order the signs from the State, install and maintain them according to State regulations.. On motion by Commissioner Beard, seconded by Commissioner Turner the court voted unanimously to adopt a resolution agreeing to parti cipate in the Bridge Load Posting Program. The motion was seconded by Commissioner Turner and carried unanimously. The Court next considered a request from Sam Fachorn, Constable, Precinct 5, for Arthur Dixon and Johnny Hoelscher Reserve Deputy Constables to be upgraded to Deputy Constables. This would bring Precinct 5 up to the total alloted number of Deputy Constables. I ] I The next item to be addressed by the Court was an amendment to the Emergency Nutrition/Temporary Emergency Relief Program Contract. A full copy of the Contract is attached to and made a part of these minutes. The Court next considered the acceptance of the Replat of Lots 1 through 80, Block 2, and Lots 1 through 4, Block 4 of Fawn Lake Estates in Precinct 2. Commissioner Wilc ox moved approval of the replat conditioned on receipt of the signa ture letter of one of the property owners and subject to approval of the City of Bryan. Commissioner Beard seconded the motion which carried unanimously. VO PAG r~ • • i i i i Commissioners- Court Meeting, August 11, 1986, continued... Under other business, the Court considered a request for payment in the amount of $126,224.37 to Rockford Business interiors for additional furniture ordered for the Courthouse. On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court voted unanimously to approve payment of the statement. The next matter to come before the Court was Change Order Number 2 to the contract with Wade Construction for the parking lot project at 25th and Washington Streets. The change order would allow for the construction of a sidewalk between the new parking lot and Maintenance Buildings at a cost of $800.00. The Court further considered a request from Wade Contractors in the amount of $10,531.50 for work completed on the parking lot project. On motion by Commissioner Cooley, seconded by Judge Holmgreen, the Court voted unanimously to approve Change Order No.2 in the amount of $800.00 and payment of $10,531.50 to Wade Contractors. The Court discussed landscaping for the new parking lot at 25th and Washington Streets. It was the consensus of the Court to ask Contemporary Landscaping to draw the plans. Commissioner Cooley next laid before the Court a Letter of Agreement to lease a vehicle from the Community Action Agency to transport probationers to do community service work in the Precinct 1 Litter Control Program and for the landfill. The only obligation to the County would be to supply oil and gasoline for the vehicle when used. On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court voted unanimously to authorize the County Judge to sign the Letter of Agreement, a full copy of which is attached hereto. II VOL-b-5--PAGE -21-Y. Commissioners- Court Meeting, August 11, 1986 continued... The County Judge advised the Court of a request asking the Court to issue a Resolution to the State Legislature asking that the Farm to Market funding program be spared from being cut from the state budget in the special budget cutting session. After some discussion on the necessity for continued funding, the Court, on motion by Commissioner Cooley, seconded by Commissioner Wilcox, voted unanimously to adopt the Resolution and authorized the County Judge to forward it to the state legislature. At 10:35 a.m., the Judge asked the courtroom be cleared of all spectators so that the Court could meet in a closed session to discuss personnel matters. The meeting was re-opened at 11:15 a.m. and The County Judge announced that no action was necessary on the closed session, whereupon the meeting was adjourned. WHEREAS, the State desires to enter into an agreement with the Local Jurisdiction concerning the installation of load posting signs on t+ bridges within the Local Jurisdiction; i A G R E E M E N T NOW, THEREFORE, the State and the Local Jurisdiction, in con- sideration of the mutual covenants and agreements herein contained, do mutually agree as followss The Local Jurisdiction agrees to order load posting signs from the State, the State agrees to administer Federal funds to provide the load posting signs at no cost to the Local Jurisdiction, and the Local Jurisdiction agrees to take delivery, install, and maintain the signs as stated in the sections to follow. 1. The Local Jurisdiction shall properly authorise all propose s gns by ordinance, resolution, or other appropriate action and shall provide a copy of such which shall be attached hereto and designated Attachment B. 4. Delivery. The Local Jurisdiction shall take delivery of all pro- posed signs, sign supports, and hardware as agreed upon with the appropriate State Department of Highways and Public Transporation District Office. S. Installation and Documentation. The Local Jurisdiction shall install all proposed s gns n accordance with the requirements of Attachment C, "Load Posting Signs," and Attachment D, 'Vertical and Lateral Clearances'. The Local Jurisdiction shall document the installation by marking the date sticker affixed to the back of each sign. 6. Notification- and Inspection. The Local Jurisdiction shall notify the appropriate State Department of Highways and Public Transportation District Office in writing within 1S days after all proposed signs have been properly installed. The Local Jurisdic- tion shall allow the Federal Highway Administration to perform on-site inspection of the installed signs and shall adjust any. signs that are found to be improperly installed. 7. Maintenance. The Local Jurisdiction shall keep the installed signs clean, eg ble, and open to the view of approaching motorists for at least 150 feet. The Local jurisdiction shall reinstall signs that have been knocked down by vandalism, traffic accidents, or other causes. So State Reponsibility. The appropriate State Department of Highways and Public Transportation District office agrees to provide the Local Jurisdiction with reasonable consultation assistance in accomplishing the objectives-of this agreement. to State Indemnified. The Local jurisdiction shall save harmless the State from a •c aias and liabilities due to activities of the Local Jurisdiction, its agents, officials, or employees performed under this agreement and which result from an error, omission, or negli- geat act of the Local Jurisdiction, its agents, officials, or employees. The Local Jurisdiction shall also save harmless the State from any and all expenses, including attorney fees which Right be incurred by the State in litigation or otherwise resisting said claims or liabilities. VOL s PAGE _X~3 11 /RS 10, Disputes. Should disputes arise under this contract, the State's decision shall be final and binding. 11. Civil Rights Compliance. With regard to work performed under this contract, the Local Jurisdiction, in compliance with regulations of the Department of Tansportation (49CFR21 and 23CFR710.405), Executive orders 11246 and 11375 regarding Equal Employment opportunity, and regulations of the Department of Labor (41CFR60), shall not discriminate on the grounds of race, color, sex, or national origin. 12. Inspection of Books and Records. The Federal Highway Administration, the Department of Transportation, the Office of Inspector General, and the Comptroller General of the United States, or any duly authorized representatives thereof, shall have access to any books, documents, papers, and records which are directly pertinent to this contract for the purpose of making audits, exami- nations, excerpts, and transcriptions. i ' I IN WITNESS WHEREOF, the State and the Local Jurisdiction have executed duplicate counterparts of this Agreement. The sign should be placed so as to allow the driver of an overweight vehicle to detour around the bridge. I. BTS Agrees To: 1. Furnish the County with the appropriate capacity vehicles to be utilized in the program on Saturdays and Sundays. II. The County Agrees To: 1. Pick up vehicles an Friday afternoons prior to 6:00 pm.; 2. Furnish to BTS the names and Texas Drivers License Numbers of proposed drivers and have such drivers complete BTS Drivers Training Program; 3. Reimburse BTS on a monthly basis for fuel and oil utilized by the vehicles when utilized by the County; 4. Complete appropriate vehicle utilization logs; and 5. Return vehicle to BTS no later than 6:00 a.m. each Monday. III. The County agrees to indemnify and hold BTS harmless of and from any and all damages, claims, suits, injuries, actions and/or causes of actitons whatsoever arising from and/or connected with the operation of the BTS vehicle while involved in the County Project. WHEREAS, Congress increased the federal fuel tax to 9 cents a gallon in the Surface Transportation Act of 19ffi; and WHEREAS, an amendment to that legislation sponsored by Senator Lloyd Bentsen provided equity to each state by • guaranteeing a return of at least 85 percent of federal h4hway user taxes collected in that state; and WHEREAS, prior to the enactment of the Bentsen amendment, Texas was receiving less than 75 cents for each dollar paid into the Highway Trust Fund; and WHEREAS, the increase in the federal fuel tax and adoption of the 85 percent provision substantially increased the federal highway funds received by Texas; and WHEREAS, the increased federal highway funds, together with additional state funds provided by the Legislature, are being used in a long overdue program to rehabilitate, improve, and expand the 72,000 mule Texas highway system; and WHEREAS, the Reagan Administration has proposed legislation which would prevent Texas from receiving a fair return of federal highway user taxes collected here by destroying the equity achieved by the Bentsen Amendment; and WHEREAS. Congress is considering legislation to reauthorize federal highway and transit programs; ` NOW THEREFORE BE IT RESOLVED that members of Me Texas Congressional Delegation be urged to support kgislaton which includes the following: 1. Continue the present 85% minimum allocation program. 2. Remove transportation trust funds from the Unified Federal Budgd, allowing revenues from i user fees to flow unimpeded to provide improvements in transportation facilities. Funding levels should fully utilise revenues available in the bust funds. a 3. Authorise W. Secretary of Transportation to approve the Interstate Cost Estimate Ad- ministratively. 4. Provide adequate general revenue appropriations to meet transit capital needs. 5. Continue to dedicate all fuel tax revenues to die Highway Trust Fund.
