A special meeting of the Commissioners' Court of Brazos
County, Texas, was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00

On motion by Commissioner Cooley, seconded by Commissioner Turner,
the Court voted unanimously to accept the low bid and award the
contract to The Greenery.
Next to be discussed was the acceptance of the road in
Forrest Lakes Subdivision in Precinct 3. Commissioner Wilcox
moved to defer action on this matter until such time as Com-
missioner Beard can be at the Commissioners Court meeting due -
to the subdivision being in his precinct. The motion was se-
conded by Commissioner Turner and carried unanimously.
Commissioner Wilcox laid before the Court a Petition for a
Rural Fire Prevention District in Precinct 2 and announced that
a public hearing must be held on the petition before the Court
could order an election to be held. Commissioner Wilcox noted
that the petition contained the proper number of signatures and
that the names had been certified by the Tax Assessor/Collector
as qualified voters of the proposed district. Commissioner
Cooley then moved to set the date of the public hearing as July
2, 1986, and the time to be 10:00 A.M. The place of the public
hearing to be the Commissioners Courtroom of the Courthouse, 300
East 26th. Street, Bryan, Brazos County, Texas. The motion was
seconded by Commissioner Wilcox and carried unanimously. A full
copy of the petition and the notice are attached to and made a
part of these minutes.

Under other business, the Court heard a request from Tom
Sistrunk, President of the Brazos Valley Farmers Market, to use
the Courthouse parking lot each Saturday morning as a place for I'
the farmers to set up and sell their produce. Mr. Sistrunk i
stated that they had been using a different location but had re-

ceived requests to move back to the Courthouse area. Mr. Sistrunk

added that June 14th. would be the earliest date they would need
to use the parking lot. The Court discussed the possibility of
using the 25th. street parking lot if it were completed in time.
Commissioner Cooley moved to amend the agreement that was used
in 1985 to extend it through December 1986, and to authorize the
use of the Annex parking lot until such time as the 25th. Street
parking lot was completed and then they could relocate there. The
motion was seconded by Commissioner Wilcox and carried unanimously.
There being no further business to come before the Court the
meeting was adjourned.

THE STATE OF TEXAS
COUNTY OF BRAZOS 0
? The Commissioners Court of Brazos County, Texas, will
hold a public hearing to consider a Petition for the creation
of a Rural Fire Prevention District to be created and operated
27 under the terms of Article III, Section 48-d of the Constitution
of the State of Texas.
The name of the proposed district shall be "BRAZOS COUNTY
RURAL FIRE PREVENTION DISTRICT NO. 211.
The designation of the boundaries of said proposed district
are:

" SECTION 1: BEGINNING at the point where the centerline of FM
2223 intersects the Brazos County-Robertson County line;
` THENCE northeast along the Brazos County-Robertson County line

its intersection with the centerline of the gravel road )mown

THENCE southeast along the centerline of said county road to
its intersection with the centerline of FM 974;

TO THE HONORABLE JUDGE OF THE COUarY COURT OF BRAZOS COUNTY, TEXAS
Now COME the undersigned qualified voters and owners of taxable
real property within the unincorporated area of Brazos County, Texas and
respectfully present unto this Court their petition for the organization
of a Rural Fire Prevention District in Brazos County, Texas and for the
assessment of a tax as provided for herein to be utilized in the
district so taxed and ask this Court to receive and act upon same and as
reason therefor would show unto this Honorable Court as follows:
I.
That your Petitioners would show that such Rural Fire Prevention
District, in the State of Texas, under the provisions of Section 48-D,

Article III of the State Constitution is to be organized for the
protection of life and property from fire and for the conservation of
natural resources as so provided for in said Act.
II.
The Brazos County Rural Fire Prevention District is located wholly
within Brazos County, Texas. That this petition is signed by not less
than one hundred of the qualified voters, owners of taxable real
property within the proposed district and said district being wholly
enaoq:assed by the'uninoorporated area of Brazos County, Texas.
III
That the said- proposed Rural Firs Prevention District is -to- be

created and operated under the provisions of Article III, Section 48-D
of the Constitution of the State of Texas, as set out below:
The Legislature shall have the power to provide for the
establishment and creation of rural fire prevention districts
and to authorize a tax on the ad valorem property situated in
said district not to exceed Three (c) Cents on the One Hundred
($100.00) Dollars valuation levied in support of said
districts until approved by vote by the people residing
therein.
IV.
The tax provided for in Article III herein is to be utilized
exclusively in the district in which the property so taxes is situated.--

district shall be Brazos County Rural Fire Prevention District No. 2.

That the boundaries of the Brazos County Rural Fire Prevention
District No. 2 of Brazos County, Texas, and are as follows:

2223 intersects the Brazos County-Robertson County line;
THENCE northeast along the Brazos County-Robertson County line
(which is also the centerline of the Old San Antonio Road) to
its intersection with the centerline of the gravel road known
as the Wheelock Hall Road;

VII.
That your Petitioners would further show that none of the land that
is encompassed within the Brazos County Rural Fire Prevention District
No. 2 is included within any other Rural Fire Prevention District.
VIII.
That the names, mailing addresses and voters registration numbers
of each Petitioner are attached to this Petition and made a part hereof
as though copied verbatim and individually herein.
IX.
That your Petitioners would show that the following signed
agreement by five of the Petitioners herein indicates that they have
obligated themselves to pay the costs incident to the formation of the
proposed district not to exceed One Hundred Fifty ($150.00) Dollars,
which shall include, among other necessary and incidental expenses, the
cost of publication of notice and election costs.

• LEASE AGREEftVr
Brazos County, Texas, (hereinafter called "Lessor"), for and in
consideration of Ten and No/100 Dollars ($10.00) and other good and valu-
able consideration the receipt and sufficiency of which is hereby
acknowledged, hereby leases to the Brazos Valley Farmers Market Associ-
ation, an unincorporated association (hereinafter "Lessee"), the Brazos
County Courthouse Annex parking lot (hereafter the "Premises") on every
Saturday during the months of June, July, August, September, October and
November, 1985 to be used by said Lessee for the operation of a "farmers
market" within said space. There shall be no monetary rent due and
owing for this lease except for the expenses that may be occassioned by
the provisions stated herein.
The operation of the farmers market shall be conducted in accord-
ance with the rules and regulations of the Brazos Valley Farmers Market
- Association which are attached hereto as Exhibit "A" and made a part
hereof for all purposes. Such market shall be operated on every
Saturday commencing at 7:30 a.m. and continuing throughout the day until
all of the produce is sold, but in no event later than 6:00 p.m.
Lessee shall not permit the accumulation of waste or refuse
material on the Premises and shall dispose of all garbage and refuge
arising from the operation of its business at such times and in such
manner as may reasonably be prescribed by Lessor. Lessee agrees to keep
all garbage retained in air tight receptacles in a compliance with all
government laws, regulations and orders. Lessee at its own cost and
expense shall provide any and all safeguards so as to prevent the accumu-
lation of such refuge, garbage or rubbish and for the expense of
removing such refuge from the Premises and properly disposing of the
same.
Lessee agrees that it will protect, defend, save and keep the
Lessor forever harmless, and indemnify against and from any penalty or
damage or charges emposed for any violation of any laws or ordinances,
whether occasioned by the negligence of Lessee or those holding under

save and keep harmless the Lessor against and from any and all loss,
cost, damage or expense, rising out of or from any ziccident or other
occurence on or about the said Premises, causing injury to any person or
property whomsoever or whatsoever and will protect, indemnify and save
and keep harmless the Lessor against and from any and all claims, loss,
cost, damage or-expense arising out of any failure of Lessee in any
respect to comply with and perform all of the requirements and
provisions hereof.
For the duration of this Lease, Lessee, at its expense shall insure '
Lessor, Lessor's agents and itself against liability for injury to
persons in connection with the Premises in the amount of $100,000.00 per
any one person and $500,000.00 for more than one person and any one
occurence. This insurance shall be in a form and through an insurance
company satisfactory to Lessor, and Lessee shall deposit the original
policy (with evidence of premium payment) with Lessor. Lessor may, at
its option, procure the said insurance and charge the expense thereof to
Lessee as additional rent to be came due and payable on demand.
Lessee does hereby covenant for itself its successors and assigns
that it will at its own cost and expense, during the term hereof, prompt-
ly comply with every law, statute, rule, ordinance, regulation, and
notice of any municipal, county, state, federal or other authority hav-
ing jurisdiction, pertaining to or effecting the said Premise and the
business to be conducted thereon, and will pay all fines and penalties
imposed upon the Lessor, its successors and assigns by reason of the
failure or neglect or refusal of the Lessee to so comply with such law,
statute, rule, ordinance, regulation or notice.

COME
It is understood and agreed that Lessor has the privilege of cancel-
ling this Lease at any time by giving to Lessee 10 days prior notice in
writing of its intention so to do, and thereupon the term of this Lease
shall wholly cease and expire by lapse of time, upon the date of which
Lessor has elected to cancel the Lease as fully and completely as if
that day were the date herein distinctly fixed for the expiration of the
term, and Lessee shall forthwith vacate the Premises and surrender the
same to Lessor, its successors and assigns.
All notices at any time to be served by the Lessor upon the Lessee
shall be in writing and sent by registered mail with postage prepaid,
addressed to the Lessee care of the Market Manager, whom the Lessee
covenants and agrees to appoint and keep the Lessor informed as to his
