J. Holmgreen, County Judge, presiding: Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. Asst. i i The first matter to come before the Court was the discussion of widening State Highway 30. Lonnie Williams, representing the i State Department of Highways and Public Transportation presented the Court with an agreement to contribute funds for the project. Such contract agrees that Brazos County will contribute ten per- cent (10%) of the cost of the right of way for the proper develop- ment and construction of the road from FM 158 S.E. to its inter- 1 VOL 3 PAGE section with Bird Pond Road for an approximate cost of $102,500. After having the project outlined, Commissioner Beard made the motion to authorize the County Judge to execute the contract on behalf of Brazos County and to pay $102,500 to the State Depart- ment of Highways and Public Transportation. The motion was sec- onded by Commissioner Cooley and carried unanimously. A copy of the fully executed contract is attached hereto. The Court proceeded to consider amendments to the 1986 Bud- . I get for various departments. On motion by Commissioner Turner, seconded by Commissioner Beard, the Court voted unanimously to approve the amendments as submitted. A full copy of the amend- ments are attached to and made a part of these minutes. The Court next considered a request from City Savings Assoc- iation for a refund on two tracts; 1.68 acre tract and 1.66 acre tract in the C. Burnett League No. 7 owned by Welsh Street Joint Venture. The taxes were irroneously paid on property that the Mortgage Company no longer held a loan and was in the total amount of $3,363.93. On motion by Commissioner Beard, seconded by Com- missioner Turner the Court voted unanimously to authorize the re- fund. The County Judge laid before the Court a letter from the Texas r. r .r r` 4^'•. f Justice Court Training Center advising that Judges B. H. Dewey, Jr., Carolyn Hensarling, Michael B. Calliham, and Antone Dobrovolny had successfully completed a twenty hour course in the duties of Justice of Peace in accordance with Art.5972 of the Texas Revised Civil Statutes and Supreme Court. The meeting continued with the Court considering the follow- ing plats: 1. Final Plat of Deerfield Estates in Precinct 3. No plat was presented for review; however, the County Engineer stated that he had inspected the subdivision and found the following: (a) ditches appear to be too close to driving surface. (b) ditches are not deep enough. (c) ditches will erode at cul-de-sac. (f) that the developer provide a maintenance bond in the amount of $10,000 and that the two year maintenance period commence today. On motion by Commissioner Beard, seconded by Commissioner Wilcox, the Court accepted the Engineers recommendations and voted unani- mously to approve the plat. The Court next considered the following bids and the payment thereof. 1. Bid No. 280 - Construction of parking lot addition for Brazos County at 25th. & Washington Streets. (a) B5 Inc. -No Bid (b) Wade Contractors -$114,640 - 60 calendar days (c) R.B. On motion by Commissioner Beard, seconded by the County Judge, the Court voted unanimously to accept the al- ternate bid of Texas Communications in the amount of $23,400. WHEREAS, the State had requested the County to enter into contractual agreements and acquire right of way on the following projects: Highway Account No. Limits SH 30 From FM 158 S.E. to Intersection with Bird Pond Road and, WHEREAS, the County has now requested that the State assume responsibility for acquisition of all necessary right of way; and, WHEREAS, the County desires to voluntarily contribute to the State funds, equal to ten percent (10X) of the cost of the right of way, for the proper development and construction, of the State Highway System. 0 NOW, THEREFORE, in consideration of the foregoing premises and the mutual benefits to be derived therefrom, the County shall contribute to the State an amount equal to ten per- cent (10X) of the cost of the right of way to be acquired by the State and shall transmit to the State with the return of this agreement, executed by the County, a warrant or check payable to the State Department of Highway's and Public Transportation in the amount of One Hundred Two Thousand Five Hundred and NO/100------------------- Dollars 102, 500.00 which represents 10% of the estimated cost of the right of way; however, if it is found that this amount is insufficient to pay the County's obliga- tion, then the County, upon request of the State, will forthwith supplement this amount in such amount as requested by the State. Upon completion of the project and in the event the amount as paid is more than 10% of the cost of the right of way, then any excess amount will be returned to the County. Cost of the right of way acquired by the State shall mean the total value of compensation to owners for their property interests either by negotiation or eminent domain. 7 VOL .S PAGE213 ,y •r l c r I l .
