Other Business 0 f~ ti t l' L VOL .51 -PAGE t i a•~P , E i COMMISSIONERS' COURT SPECIAL MEETING JANUARY 27, 1986 A special meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A.M. on Monday, January 27, 1986, with the following members of the Court present: R. J. Holmgreen, County Judge, presiding: Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The first matter to come before the Court was approval of the minutes of the Commissioners Court Meetings held December 9, 1985, December 16, 1985, December 18, 1985, December 22, 1985, and December 30, 1985. On motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to approve the minutes as submitted. The next matter to be considered were Change Order numbers 19 and 20 for modification and addition to the Courthouse. On motion by Commissioner Cooley, seconded by Commissioner Wilcox, the Court voted unanimously to approve Change Order number 19 in the amount of $7,036.24 and Change Order number 20 in the amount of $24,494.39. s ' f V 0, 11 i I The Court proceeded to consider amendments to the 1986 Budget for various departments. The amendments would increase the General Fund by $2,140.00. On motion by Commissioner Cooley, seconded by Commissioner Wilcox, the Court voted unanimously to approve the amendments as submitted. A full copy is attached to and made a part of these minutes. II The Court next considered two invoices from Jack Cumpton and Associates for services in connection with modifications and addi- tions to the Courthouse. On motion by Commissioner Turner, second- ed by Commissioner Beard, the Court voted unanimously to approve invoice No. 14 in the amount of $15,262.53 to be paid out of Pro- position I, Capitol Projects funds, and invoice No. 2 in the a- mount of $2,831.66 to be paid out of Proposition II, Capitol Pro- ' jects funds. On motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to approve the Official Bond of Warren B. Davis, County Treasurer and ordered same filed in the Official Bond Records in the County Clerk's Office. a The Court reviewed an Agreement between Brazos County and the City of Bryan, regarding housing of the County Law Library in the Bryan Public Library, and for various services in connec- tion with same. On motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to approve the Agreement and authorized the County Judge to execute the Agree- ment on behalf of Brazos County. A full copy of the Agreement is attached to and made a part of these minutes. Next to be considered was a resolution concerning the pre- servation of the Warren Long Truss Bridge on Bird Pond Road. The Resolution will enable the Department of Highways and Public Transportation to include the work and cost necessary for the re- location of the bridge in a contract which the County has pre- viously agreed to participate in an amount of 20%. A fully executed copy of the Resolution is attached hereto. I i I The County Judge next recognized Chester Fehlis, District Director of the Texas Agricultural Extension Service. Mr. Fehlis introduced Jim Mazurkiewicz as the person appointed as County Extension Agent-Agricultural to fill the vacancy created by the resignation of Tom Sistrunk. Mr. Mazurkiewicz will begin his duties in Brazos County on February 16, 1986. The Court proceeded to consider the following bids and pay- ment thereof: 1. Dan Beto, Chief Adult Probation Officer and Queen Walker, Administrative Assistant for the District Attorney's Office, rejected all bids submitted for their Departments. On motion by Commissioner Beard, second- ed by Commissioner Wilcox, the Court voted unanimously to accept the bid of Moore Business Forms, Inc., for the first 5 items and rejected all bids received for the last 2 items. Under other business, Commissioner Wilcox announced that the comments he had requested on the Personnel Policies had been turn- ed by the majority of people, and that copies would be made for all members of the Court. Billy Eubanks, County Engineer announced that he had received a call from Commissioner Brown in Grimes County who advised him that the bridge on Long Trussel Road would be closed for repairs on the Grimes County side. Mr. Eubanks stated that signs would be installed on the Brazos County side stating that the bridge would be closed indefinately. Claims were approved as per the following page. The new formula for - apportionment calculates two sums, one for the operating budget of the Administrative Region and one for the County's share of the Presiding Judge's salary. Both population figures and the number of fudges serving your County have been supplied to us by the Office of Court Administration. This new formula has increased the assesment for some Counties and lowered it for others. This information has only recently been received and your normal budget cycle is already in progress and, perhaps, been completed. Administrative Presiding Judge , Assistant ~.I ~ ~ - ;ems „+i :r• ~ . , - • I 76-1050.18 THE STATE CF TEXAS I COUNTY CF BRAZOS I THIS AGREEMENT, made and entered into this;2_M day of . by and between the Commissioners' Court of Brazos County, Texas, hereinafter designated as the "COUNTY", and the City of Bryan, a Municipal Corporation of the State of Texas, hereinafter designated as the "CITY", is as follows: IN AND FOR THE CONSIDERATION of mutual benefits, the COUNTY agrees to loan to the CITY, for use by the patrons of the Bryan Public Library, Bryan, Texas, the BRAZOS COUNTY LAW LIBRARY, made up of (1) legal publications and material owned or leased by the COUNTY including, but not exclusively, a video cassette player, monitor, cart, and tapes; computer equipment for use with Westlaw research system; and (2) legal publications and material on loan b i to the COUNTY from members of the Brazos County Bar Association; it being the express agreement of the parties that the title to legal publications and materials constituting the Brazos County Law Library, shall remain in the COUNTY, and in those members of the Bar who have legal publications and materials on permanent loan to the Brazos County Law Library. COUNTY warrants to the CITY that it has secured the consent to this Agreement of the Brazos County Bar Association and any persons claiming an dr interest in any of the books which make up the Law Library collection. > COUNTY agrees to move the BRAZOS COUNTY LAW LIBRARY to the Bryan City F Library and to remove same on any termination of this Agreement at its expense. COUNTY further agrees to provide temporary bookcases to store the Law Library collections until such time as delivery is made of Remington-Rand bookcases of the same style and quality as those presently used in the Bryan Public Library; purchase of the Remington-Rand bookcases shall be at the COUNT'YIS expense. The COUNTY will also provide, at its expense, a card catalog case for use with the Law Library collection. It is the intent of the COUNTY to continue adding legal publications and materials to the Taw l Library collection. That in and for the consideration of mutual benefits, the CITY agrees to house the BRAZOS COUPITY LAW LIBRARY in the Bryan Public Library, Bryan, f' . I; VOL a l I e Texas, where it will be available to the public during the normal operating hours of the library. Use of the Law Library collection shall be subject to the Rules and Regulations of the Bryan City Library as they now exist, or any amendment thereof. The Law Library collection shall not be available for circulation to patrons of the Bryan City Library. Use of the Westlaw system shall be limited to Brazos County Bar Association members holding State Bar of Texas cards. The City shall maintain sign-in/sign-out sheets to monitor use of the Westlaw system. The CITY will not be responsible for any lost or damaged books, materials, audio-visual material or equipment, computer equipment or furniture; and any insurance of the Law Library collection shall be at the COUNTY'S expense. The CITY further agrees that the staff of the -Bryan City Library will process and catalog the BRAZOS COUNTY LAW LIBRARY, and the additions thereto. All materials received by the Bryan City Library for the law Library collection shall be stanped "Property of Brazos County Law Library". On receipt of the initial Law Library collection the staff of the Bryan City Library shall prepare a list of the publications and materials contained therein, and a copy of such list shall be attached to this AGREEMENT as Exhibit "A". Additions to the Law Library collection shall be subject to the same provisions as the initial collection. Separate lists of such additions shall be prepared by the Bryan City Library staff, and one copy shall be furnished to the COUNTY and one to the CITY Secretary for attachment as an amendment to this contract. The COUNrY'S consideration is based solely on the provisions of this Agreement and CCUNIY shall not be entitled to any grants received by the Bryan Public Library, any fees for the use of the library, or any charges for books that are checked out of the library, if permitted by the Rules and Regulations of the Library, and not returned on the due date. It is the further agreement of both COUNTY and CITY that the selection of materials to be added to the Brazos County Law Library shall be made by the Library Committee of the Brazos County Bar Association, subject, however, to the approval of the Brazos County Judge. All such additions, as well as costs of maintaining the law library in current condition, (i.e. pocket , parts, new volumes, supplemental volumes) shall be paid for by BRAZOS COUNN from its Law Library Fund. Upon such termination, the COUNTY shall cause the entire law library collection to be removed from the Bryan Public Library, as well as all bookshelves and other physical assets therefor purchased by BRAZOS COUNTY. Andron City Attorney Marvin Tate Mayor r h i' ~r VOL ..6'-PAGE AS j , t X17 f , y 11 r , !1 i f. _ K• r~ i f; , f 4 i rt- i~ E r i , , RESOLUTION AGREEING TO PARTICIPATE IN MOVING AND MAINTAINING BIRD POND ROAD WARREN TRUSS BRIDGE THE STATE OF TEXAS § Bryan, Texas COUNTY OF BRAZOS § January 27 1986 MOTION was made by Commissioner Billy Beard and seconded byCommissioner Bill Cooley that the Commissioners' Court of Brazos County participate in the preservation of the Warren Long Truss Bridge over Carters Creek on Bird Pond Road in the amount of twenty percent (20%) of the cost of moving and placing said bridge at a site designated by the Court on the grounds of the Brazos Center, and to maintain it as a pedestrian bridge, said cost to be determined by bids taken by the State Department of Highways and Public Transportation in connection with replacement of said bridge and one other bridge on Bird Pond Road by the Department as part of the Federal Bridge Replacement Program. The preservation of the Warren Long Truss Bridge on Bird Pond Road is in the public interest because the Texas Historical Preservation Commission has deter- mined that said bridge is eligible for the National Register of Historical places. VOTE on the motion was as follows: Judge R. J.
