COMMISSIONERS' COURT REGULAR MEETING JANUARY 13, 1986 A regular meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A.M. on Monday, January 13, 1986, with the following members of the Court present: R. J. Holmgreen, County Judge, presiding: Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. Tax Payer WTAW County Judge's Secretary The Court received, approved and ordered filed as submitted the following reports for December, 1985: W. T. Sistrunk, County Extension Agent; Mike McKinney, County Extension Agent; Dale A. Fritz, County Extension Agent; Mable Walker, County Extension Agent; Kathleen McDonald, County Extension Agent. The Court received, considered and approved reports from County and Precinct Officers showing revenue collected and re- mitted to the County Treasurer. A copy of the reports are attached hereto. Commissioner Cooley moved to set the rate at $.205 per mile in accordance with Internal Revenue guidelines. The motion was seconded by Commissioner Turner and carried unanimously. The Court proceeded to the selection of the Salary Grie- vence Committee for 1986 in accordance with law. The follow- ing names were drawn from the list of persons who served on the Grand Jury during the previous twelve months: 1, Rudolph Johnson 905 Hudson Bryan, Texas 77801 2. Ralph Wellman 2006 Rayburn Court College Station, Texas 77840 3. George T. Garrett 909 N. Avenue Bryan, Texas 77801 Alternate - 1. John C. Mayfield, Jr. 2386 Briargate Circle Bryan, Texas 77801 Alternate - 2. Danny T. Borskie 3602 Oakcliff Bryan, Texas 77801 On motion by Commissioner Cooley, seconded by Commissioner Tur- ner the Court voted unanimously to name the above listed persons as those to serve as the County Salary Grievence Committee for 1986. The County Judge announced that he waived his right to sign purchase orders for the Road and Bridge Department and so made the motion. The motion was seconded by Commissioner Wilcox and carried unanimously. On motion by Commissioner Turner, seconded by Commissioner Cooley the Court voted unanimously to certify that the total county road miles was 454. The Court requested the County Engi- neer to attempt to drive each road during 1986 so that there would be an official record of the length of each county road. VOL PAGE 23 I; if ~I The Court next considered payment of the statement of Utley James of Texas, Inc. in the amount of $68,314 for work completed on the modification and addition to the Courthouse. On motion made by Commissioner Wilcox, seconded by Commissio- ner Turner, the Court voted unanimously to approve the state- ment for payment. The Court proceeded to consider an amendment to the 1986 budget for the District Attorney's Department. On motion by i Commissioner Cooley, seconded by Commissioner Turner, the Court voted unanimously to approve the amendment as submitted. A full copy of which is attached. On motion by Commissioner Wilcox, seconded by Commissioner Turner, the Court voted unanimously to approve the official Bond of J. D. Langley, as Judge of the County Court at Law. On motion by Commissioner Wilcox, seconded by Commissioner Cooley the Court voted unanimously to approve for payment the annual dues to the State County Judges and Commissioners Associa- tion in the amount of $125.00. On motion by Commissioner Wilcox, seconded by Commissioner Cooley, the Court voted unanimously to receive and attach to these minutes the Certification of the Juvenile Detention Faci- lities by the Juvenile Board. On motion by Commissioner Cooley, seconded by Commissioner Turner, the Court voted unanimously to set the court cost fee of $5.00 to be collected on all Civil Cases filed in the District Courts and County Courts At Law, excepting delinquent tax suits. Such fee is in accordance with Art.1630d Texas Revised Civil Sta- tutes Annotated to establish an Appellate Supreme System Fund. The Court next considered a request from CDC Operating Com- pany for a tax refund in the amount of $515.79. The Tax Assessor stated the reason as being a reduction of the working interest in • VO L-~ PAGE a ~ _0 = ~.P 0 i i 6_ an oil well known as Cheree W #1 and identified by account num- ber N71050-9001-6586-0020. On motion by Commissioner Cooley, seconded by Commissioner Turner, the Court voted unanimously to authorize the refund. Commissioner Wilcox next announced that he had requested input from various county employees on the proposed personnel policies. He further indicated that all of the information had not been received and requested that the appointment of a com- mittee to discuss the policies be delayed until the next meet- ing. The Court next considered changes in status of various em- ployees. Those submitted were step increases for employees who had not received an increase in the last six months. These changes were all in accordance with the 1986 Budget and were to become effective January 1st. Other changes were terminations and discontinuing of car allowances for selective persons. On motion by Commissioner Turner, seconded by Commissioner Cooley, the changes were approved as submitted. The Court proceeded to set the holidays to be observed by County offices during 1986. After discussion Commissioner Cooley moved to set the following days as the official holidays for Brazos County employees: April 21 - Sesquicentennial Day May 26 - - Memorial Day July 4 - Independence Day September 1 - Labor Day November 27 and 28 - Thanksgiving Day and the Friday after. December 25 and 26 - Christmas Day and the Friday after. January 1, 1987 - New Years Day Two (2) floating days to be observed by an employee after preclearance by the Department Head, but would not require. the county offices be closed. v o va~ . i I The motion died for lack of a second. The County Judge then moved to declare the following days as official holidays to be observed by Brazos County: January 20 - Martin Luther King Day May 26 - Memorial Day July 4 - Independence Day September 1 - Labor Day November 27 and 28 - Thanksgiving Day and the Friday after. December 25 and 26 - Christmas Day and the Friday after. January 1, 1987 - New Years Day One (1) floating holiday to be observed by an employee after preclearance by the Department Head, but would not require the closing of county offices. The motion was seconded by Commissioner Turner, whereupon Com- missioner Wilcox moved to amend the motion to add April 21 as Ses- quicentennial Day. The motion to amend the original motion was seconded by Commissioner Beard. The County Judge called for a vote on the motion to amend the original motion which carried un- animously. The County Judge then called for a vote on the original motion which carried unanimously. The County Judge announced the original motion passed and the amendment to the motion passed and that the following dates are hereby set as the official holidays for all county offices: January 20 - Martin Luther King Day April 21 - Sesquicentennial Day May 26 -'Memorial Day July 4 - Independence Day September 1 - Labor Day November 27 and 28 - Thanksgiving Day and the Friday after. We hereby find that: 1. Children in detention are not detained in or committed to a compartment of a jail in which adults are detained or committed; 2. Children in detention are not permitted contact with adults who are detained or committed to a jail; 3. The detention facility meets the requirements of Article 5115, Revised Civil Statutes of Texas, 1925, as amended, defining "safe and suitable jails"; 4. The detention facility meets recognized professional standards for the detention of children as provided by Section 51.12(c) (3) of the Texas Family Code; and THEREFORE, the Brazos County Juvenile Detention Center is hereby certified as a suitable facility for children until the next annual onsite inspection due one year from the above personal visit. The Commissioner's Court of Brazos County, Texas, shall be provided copies of said certifica- tion, and the original copy shall be filed with Juvenile Records in the County Clerk's Office.
