On motion by Commissioner Cooley, seconded by Commissioner Turner, the Court voted to approve the amendments as submitted. A full copy of the budget amendments is attached hereto. The Court proceeded to consider the following bids: 1. Bid No. 248 - Law Books for the 361st. District Court. (a) State Bar of Texas 1. $115.00 - 3 volumns Texas Pattern Jury Charges. (b) West Publishing Company 1. $ 7,546.00 - 343 volumns Southwestern Reporter Texas Cases. 2. $ 2,726.00 - 154 volumns Texas Digest. 3. $ 2,895.00 - 109 volumns Vernon's Texas Civil Statutes. Total cost of $10,943.01 On motion by Commissioner Turner, seconded by Commissioner Cooley, the Court voted unanimously to accept the bid of West Publishing Company for the purchase of the books. 2. The Court proceeded to consider the City-County Health Agree- ment for 1985-86. On motion by Commissioner Turner, seconded by Commissioner Beard, the Court voted unanimously to authorize the County Judge to sign the contract on behalf of Brazos County. A copy of the fully executed Agreement is attached to and made a part of these minutes. The next matter to be discussed was the Final Plat of Wood- lake Estates, Section 3, in Precinct 1. The County Engineer an- nounced that he had no problem with the plat, whereupon Commissio- ner Beard moved that the Plat be approved as submitted. The motion was seconded by Commissioner Cooley and carried unanimously. Claims were approved as per the following page. The Court reconvened at 11:00 A.M. at which time the County Judge turned the meeting over to Jody Bates, Director of the Brazos County Sesquicentennial Committee. Mrs. Bates in turn introduced Representative Richard Smith who performed the first official act of the Sesquicentennial Celebration by presenting the new Brazos County flag to the Commissioners Court. Representative Smith stat- ed that this was the flag authorized by the Texas Legislature to be used by Brazos County. The flag was designed by Joydelle Wolfram of Falls County. A full description is attached. The County Judge expressed the appreciation of the Court for the flag with assurance k I 3 that the flag would be flown and replaced when worn. There being no further business the meeting was adjourned. That the matters set forth in the preamble are true and correct and are made a part of this agreement. 2. In consideration of the benefits to be received by the City of Bryan, the City of College Station, and Brazos County, by reason of the joint venture, the parties herein agree to pay, and Brazos County agrees to collect and disburse funds for the operation of the Brazos County Health Unit, Fiscal Year October 1, 1985 - September 30, 1986, on the following prorata basis: Amount Percent City of Bryan 140,001.00 46% City of College Station 60,870.00 20% Brazos County 91,305.00 30% Public Health Training 12,174.00 4% 304,350.00 1008 aaaaaaaaaaa neaaaaa 3. J ' ~i L This contract is for a period of one year and all payments shall be made from current revenues of each of the parties. Payments shall be made by the City of College Station to Brazos County at the Brazos County Courthouse prior to the tenth day of each month with each monthly payment representing one-ninth (1/9) of the respective total share for the City of College Station. The City of College Station shall commence monthly payment during October of the contract year and continue through the next eight months. Payments shall be made by the City of Bryan to Brazos County at the Brazos County Courthouse prior to the tenth day of each month with each monthly share representing one-twelfth (1/12) of the respective total share of the City of Bryan. If credit is due any of the parties, Brazos County shall make the necessary reimbursement no later than the end of the first (1st) quarter of the next fiscal contract year. Reimbursement due to overpayment shall be made in the amount overpaid by the entity. .Reimbursement due to non-encumbered funds at the close of the contract year shall be made to each of the parties with the reimbursement allocated on the same pro-rata basis stated in Section 2 of this contract. No appropriation of money shall be made unless unanimously approved by the City of Bryan, the City of College Station and Brazos County. VOL. Authority for non-budgeted items shall come only from the approval of the Governing Board. 5. The Brazos County Health Unit shall maintain records of all income and disbursements of the Public Health Training Program. Such records shall be brought before the Governing Board each quarter for approval. No appropriation of money in this account shall be made unless unanimously approved by the Governing Board. 6. The Brazos County Health Unit shall maintain records of usage of the facilities and services by the citizens of each city and citizens of the county who live outside the two cities. Such records shall be used to determine the percentage of costs to be charged to the participating entities for the following contract year. 7. The Public Health Services will be under the supervision of the Governing Board consisting of the County Judge, the City Manager of Bryan, the City Manager of College Station, or their respective representatives, and a representative appointed by Texas A&M University. 8. -1' This contract can be renewed on an annual basis by resolution. 9. Attached as Exhibits "A" and "B" are the budget and supplemental pages for the Public Health Services showing how the monies are to be expended. 10. .1 The Director of the Public Health Services shall submit financial and activity reports for both Health Unit and Foodhandler's Permit accounts upon request by members of the Governing Board; but in no event shall such financial and activity reports be submitted less frequently than quarterly. The Director shall submit the annual financial and activity report no later than the close of the first quarter of the next fiscal year. The name of the County on the right front of the flag is in white, and the appropriate color of the star under the county name has a white Texas Lone Star around the county star, with the date of creation of the county in white letters. Centered at the far left front of the flag is an eighteen inch seal with a sin- gle large white star in the center representing the Lone Star State. Immediately around the white star are 37 small gold stars representing counties established by the Republic of Texas, 1836 through 1845. Surrounding the white, and gold stars is a band of 115 small red stars which represent counties established by the State of Texas, 1846 through 1860, before the Civil War.
