Street, Bryan, Texas, at 9:00 A.M. on Monday, December 9, 1985, with the following mem- bers of the Court present: R. J. Holmgreen, County Judge, presiding: Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Agents activities and planned programs for the coming year. The County Judge acknowledged the resignation of William T. "Tom" Sistrunk as County Extension Agent, effective January 31, 1986, and presented him with a Proclamation signed by all members of the Commissioners Court, proclaiming December 9,1985, as "Tom Sistrunk Day" in appreciation of twenty-seven years of 1 faithful service to the citizens of Brazos County. A full copy of the Proclamation is attached hereto. Walter Wilcox, Commissioner of Precinct 2 presented Mr. s Sistrunk with a Crest of the Brazos County Seal, and expressed 1 Asti,.„ a„- 1 i I f ._1 ! - - { II / 10 t I s~ \ v his appreciation for his years of service. Many other citizens praised Mr. Sistrunk for his faithful devotion to the Extension Service programs. The County Judge adJourned the meeting and announced that it would reconvene in the Commissioners Courtroom in the main Courthouse at 10:00 A.M. The Court reconvened at 10:00 A.M. in the Commissioners Courtroom of the Brazos County Courthouse with the following members of the Court present: R. J. Holmgreen, County Judge, presiding: Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. Ruth McLeod Admin Asst. The Court received, approved and ordered filed as submitted the following reports for November, 1985: W. T. Sistrunk, County Extension Agent, Mike McKinney, County Extension Agent; Dale A. Fritz, County Extension Agent; Mable Walker, County Extension Agent; Kathleen McDonald, County Extension Agent. The Court received, considered and approved reports from County and Precinct officers showing revenue collected and re- mitted to the County Treasurer. A copy of the reports are attached hereto. a fi ~ r r 0 The first matter to be considered by the Court were amend- ments to the 1985 budget for various departments. On motion by Commissioner Turner, seconded by Commissioner Beard, the Court voted unanimously to approve the amendments as submitted. A copy of the amendments are attached hereto. The Court proceeded to consider the following bids: 1. Bid No. 256 - One 8 channel console for the Sheriff's Department. (a) Motorola T1617-M 1. Lease purchase - $12,665.52 2. Straight purchase - $10,785.50 The Sheriff's Department recommended the out right purchase of J µ the equipment. On motion by Commissioner Beard, seconded by Commissioner Wilcox, the Court voted unanimously to accept the only bid received, that being Motorola, Inc.; and to purchase the control console with monies to be paid out of Bond funds. 2. Bid No. 255 - Two plain paper copiers for the Courthouse. (a) A.B. Dick -Toshiba 8412 - $12,990.00 (b) Monroe Systems -Monroe RL 7507 - $15,741.00 (c) Business Machines Service -Sharp SF 9500 - $15,990.00 (d) Texas Copy -Cannon NP 7550 - $17,990.00 (e) Central Texas Word Processi ng-Royal 5003 ZMR - $19,983.50 (f) Savin Sales of East Texas -Savin 7055 - $20,338.00 (g) Savin Sales of East Texas -Savin 7055 with sorter - $24,068.00 (h) Xerox Corp. -Xerox 1055 Marathon - $28,490.00 After a review of the bids, it was the consensus of the Court to delay awarding the bid to allow time for further investigation. a The Court next considered approval of the Bylaws adopted by the Brazos County Historical Commission on April 22, 1985. On „ 1 motion by Commissioner Beard, seconded by Commissioner Cooley, the Court voted unanimously to approve the Bylaws as adopted by the local Commission. A full copy of the bylaws are attached to and made a part of these minutes. The Court proceeded to consider amendments to the County Retirement benefits. On motion by Commissioner Turner, seconded by Commissioner Beard, the Court voted unanimously to credit $688.52 received from the Federal Housing Authority to Miscellaneous Revenue of the General Fund. ARTICLE II--Purpose Section 1: The purposes of the Brazos County Historical Commission are as follows- a. to initiate and conduct such programs as may be suggested by the Brazos County Commissioners Court and the Texas Historical Commission for the preservation of the historical heritage of Brazos County; b. to institute and carry out a continuing survey of Brazos County to determine the existence of historical buildings, and other historical sites, private collections of historical memorabilia, or other historical features within the county, and to report the data collected to the Brazos County Commissioners Court and the Texas Historical Commission; and, c. to carry out any other functions mandated in Section 1, Chapter 152, Acts of the 58th Legislature or in subsequent amendments to that act (Article 6145-1, Vernon's Texas Civil Statutes). _e ARTICLE III--Membership ri i Section 1: This Commission shall consist of a minimum of seven persons who are residents of Brazos County, and who shall be appointed by the Brazos County Commissioners Court in January of odd-numbered years for terms of two years. Section 2: Subsequent to the appointments made in January of odd-numbered years, the Brazos County Commissioners Court may appoint additional persons to the Commission; the terms of office of these appointees shall extend until January of the next odd-numbered year. Section S: The secretary shall prepare and record the minutes of the meetings of the Commission. ARTICLE V--Meetings i I Section 1: The Commission shall conduct a minimum of six regularly scheduled meetings each calendar year; at least one meeting each year shall be conducted in the county seat. Section 2: The chairman may call special meetings when necessary in order to carry out the responsibilities of the commission. Section 3: The chairman shall prepare a notice containing the date, time, place and agenda for each meeting, and shall transmit the notice to members of the Commission, to the Brazos County Commissioners Court and to representatives of the news media at least 72 hours prior to each meeting. A copy of the meeting notice shall be posted in a place convenient to the general public in the county courthouse, and in the Bryan Public Library. Section 4. A majority of the membership of the Commission shall constitute a quorum authorized to transact business of the Commission. Article VI--Committees Section 1: The chairman of the Commission shall appoint standing committees and such ad hoc committees as may be necessary in order to exercise the duties and responsibilities of the Commission. ARTICLE VII--Reports i The chairman of the Commission shall submit an annual report to the Brazos County Commissioners Court and to the Texas Historical Commission in December, and shall be responsible for other reports that may be required by the Commissioners Court or the Texas Historical Commission. Robert Brown, Director RE: Optional Benefit Eligibility Plan The Texas County and District Retirement System Act was amended this spring by the 69th Legislature through Board-sponsored legislation. One of the amendments is a new section in the Act entitled "Optional Benefit Eligibility Plan". This plan can be adopted by a TCDRS subdivision to be effective January 1, 1986, if the Actuary determines that the implementation of the plan would not impair the ability of the subdivision to fund all the obligations of its plan before the 30th anniversary of the most recent valuation date, December 31, 1984. According to calculations of the Actuary, your county or district meets the actuarial requirement to be eligible to adopt the Optional Benefit Eligibility Plan. The Optional Benefit Eligibil- ity Plan includes: 1. service retirement eligibility with at least 10 years of service at ages 60 and above, 2. vesting with at least 10 years of service, 3. deferred service retirement (pre-retirement death benefit protection) eligibility with at least 10 years of service at ages 60 and above, 4. nonoccupational disability retirement eligibility- with at least 10 years of service, and 5. early service retirement eligibility with the sum of service and age greater than or equal to 80 years (e.g., age 55 with 25 years of service, age 58 with 22 years, age 52 with 28 years, eta.) 6 VOL ,5 PAGE Z 76 . 1 1• 4y_ 1181 , 1 ti i 1 . H II I or - Optional Benefit Eligibility Plan • Page 2 Currently in TCDRS, a member can retire prior to age 60 if he has 30 or more years of service. There is no minimum age require- ment. From time to time, the staff has received requests for changes in the retirement eligibility provisions to allow retire- ment before age 60 with less than 30 years of service. Several alternatives were considered, and it was decided that the best ' one to include in the Optional Benefit Eligibility Plan was one in which eligibility for retirement will be satisfied when the sum of the member's attained age and service equals or exceeds 80 years. Under such a provision, a member can retire at age 52 with 28 years, at age 55 with 25 years, or at age 58 with 22 years, as just a few examples. This "rule of 80" provision will provide the option to retire to a member who is several years away from age 60 or several years away from having 30 years of service, yet who has had a fairly long career with the county or district. A summary comparison of your present TCDRS plan and your new TCDRS plan if the Optional Benefit Eligibility Plan is adopted is shown on the attached Exhibit 1. Also attached are Exhibits 2 and 3 which give some additional explanation of deferred service retirement and of vesting. The new provisions of the Optional Benefit Eligibility Plan will be effective January 1, 1986, if your county or district adopts the plan. We are also enclosing a model order to be used as a guideline in the preparation of your order. We will need to receive your completed order no later than January 1, 1986. As somewhat of an addendum to this Memorandum, we want to mention that we will have a TCDRS meeting in Austin in October of this year. One of the purposes of this meeting will be to discuss the Optional Benefit Eligibility Plan. Another aspect of the meeting will be to discuss the new amendments to the TCDRS Act. We hope that those county and district officials who feel the need for information about TCDRS will make arrangements to be in attendance. An employee who does not have this right has a more limited death benefit protection in that the benefi- ciary has a right only to a refund of the employee's accumulated TCDRS deposits. With the adoption of the Optional Benefit Eligibility Plan, each employee who (a) has 10 or more years of service and is age 60 or older, or (b) has 20 or more years of service, regard- less of age, will have the right to apply for deferred service retirement. How does deferred service retirement work? Let's assume John Doe, who is an employee age 60, with credit for 10 years of service with TCDRS, accumulated prior service credit of $5,000 and accumulated deposits of $12,000, dies before retiring. Under a plan that does not have 10 year and age 60 deferred service retirement, his designated beneficiary would be entitled to receive only his accumulated deposits of $12,000. If his county or district has adopted the Optional Benefit Eligibility Plan, the member's designated beneficiary shall be entitled to receive a monthly annuity instead of his accumulated deposits. If he is survived by his wife, Mary Doe, who is also age 60, and he has designated her to receive a lifetime income by selec- ting option 1 on his deferred service retirement application,. then she will be entitled to receive a monthly annuity for as long as she lives. The amount of the monthly annuity will depend upon the benefit design of the county or district's TCDRS plan. For example, if the plan has an employer matching ratio of 2.0/1 and a prior service allocation percentage of 150%, then the monthly benefit would be $208. Assuming she lives 25 years (her approximate life expectancy), she will receive total payments of at least $62,400 ($208 x 12 x 25). %°1 l ,s S P ~r VOL i , y 1 { y • Exhibit 3 Vesting Vesting is the right of a member to receive a TCDRS retirement benefit when he reaches retirement age (60 or higher) if he terminates employment with the county or district before reaching retirement age. Vesting in a TCDRS plan is conditional vesting in that the former employee who has enough service to be vested must (1) leave his accumulated deposits in TCDRS and (2) live to retirement age. A member with a right to vesting forfeits that right if he elects to receive a refund of accumulated de- posits. In addition, if a vested member who has terminated employment dies before attaining an age at which he is eligible to retire, he loses his vested status. However, such a member's beneficiary would be eligible for a death benefit under the deferred service retirement provisions if he had 20 or more years of service. Similarly, if a vested terminated member dies while eligible for retirement, his beneficiary would be eligible for a death benefit. If a vested, terminated member dies before reaching retirement eligibility and has less than 20 years of service, his beneficiary would receive a refund of the member's accumulated deposits. How does vesting work? Assume Ralph Jones, who is an employee age 50 at the end of 1985, has credit for 10 years of service with TCDRS, accumulated prior service credit of $5,000, and accumulated deposits of $12,000. Further assume he terminates employment with the county or district at that time. If his county or district adopts the Optional Benefit Eligibility Plan, which includes the 10-year vesting provision, - and Mr. Jones does not withdraw his accumulated deposits, then he would be entitled to make application for retirement upon attaining age 6,0 in 1995, and could begin receiving a TCDRS Standard Benefit or the actuarial equivalent thereof in the form of another option- al retirement benefit. The amount of the benefit would depend upon the benefit design of the county or district's TCDRS plan and the interest credited on the member's accumulated deposits each year.
