'it, COMMISSIONERS' COURT REGULAR MEETING SEPTEMBER 9, 1985 A regular meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A.M. on Monday, September 9, 1985, with the following members of the Court present: R. J. Holmgreen, County Judge, presiding: Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The following citizens and officials were in attendance: David Nunnelee Ronnie Miller B. V. County Engineer Constable, Precinct 4 Admin. Asst.Commissioners Court County Judge's Secretary The Court received, approved and ordered filed as submitted the following reports for August, 1985: W. T. Sistrunk, County Extension Agent; Mike McKinney, County Extension Agent; Dale A. Fritz, County Extension Agent; Mable Walker, County Extension Agent; i Kathleen McDonald, County Extension Agent. The Court received, considered and approved reports from County and Precinct Officers showing revenue collected and re- mitted to the County Treasurer. A copy of the reports are t, ~r attached hereto. On motion by Commissioner Turner, seconded by Commissioner Beard, the Court voted unanimously to approve the statement as submitted. 4; t r, The Court proceeded to consider amendments to the 1985 budget for the Road and Bridge Department. On motion by Com- missioner Wilcox, seconded by Commissioner Beard, the Court voted unanimously to approve the amendments as submitted. A copy of the Budget Amendments are attached hereto.. I The Court next considered the following bids and the pay- ment thereof: 1. Bid No. 230 - Replacement of bridge on Democrat Road in Precinct 3 and removal of existing structure to the County Shop. a) Southwest Bridge Contractors 1.)$57,363.00 2.)$5,000.00 b) Alston Bridge & Bulkheading 1.)$61,024.99 2.)$12384.11 On motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to award the contract to Southwest Bridge Contractors, Inc. The Court next considered a Construction And Maintenance Agreement For Bridge Replacement Or Rehabilitation Off The State System between Brazos County and the State Department of Highways and Public Transportation for the replacement of the bridge across Carter Creek on County Road 184 (Bird Pond Road.) The estimated cost of the project being $189,000.00 with the county's portion being $37,800.00 or 20% of the total cost of the project. After discussion, Commissioner Beard moved to authorize the County Judge to execute the contract on behalf of Brazos County. The motion was seconded by Commissioner Turner and carried unanimous- ly. A copy of the Agreement is attached hereto. The Court proceeded to consider a request from Raymond Day, Constable of Precinct 1 for authorization to appoint Elton L. Musgrove, Sr. as Deputy Constable for Precinct 1. The meeting continued with the Court considering a request from Louis Garcia for authorization to appoint Isaac Butler, Jr. as Reserve Deputy Constable and Lance Mitchel Belostock as Deputy Constable for Precinct 4. On motion by Commissioner Wilcox, se- conded by Commissioner Beard, the Court voted unanimously to authorize Constable Garcia to appoint Isaac Butler, Jr. as Re- serve Deputy Constable and Lance Mitchel Belostock as Deputy Con- stable for Precinct 4. Both appointments are conditioned on both I persons taking the Oath of Office and filing the proper bond. I" I ' c' f Next to be considered was approval of the following rates for Group Insurance Coverage for county employees and dependents: Employee - $87.00 per month paid by County Child(ren) - $27.64 per pay period Spouse - $51.33 per pay period Family - $65.63 per pay period on motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to approve the before mentioned rates to become effective September 1, 1985. I+ • I i f i I `P 11 I~ I The Court next considered a request from Wixon Water Supply Corporation for authorization to install a 4 inch PVC waterline across the right-of-way of Dilly Shaw Tap Road in Precinct 2. On motion by Commissioner Wilcox, seconded by Commissioner Beard, the Court voted unanimously to grant the request and authorized the installation. A full copy of the permit is attached hereto. Road 8 a s CONSTRUCTION AND MAINTENANCE AGREEMENT ' FOR BRIDGE REPLACEMENT OR REHABILITATION OFF THE STATE SYSTEM t THIS AGREEMENT, made on the date shown hereinafter, by and between the State Department of Highways and Public Transportation, hereinafter called the "Department", and Brazos Count a local govern- ment, or governments agency or entity, hereina ter called the "Governmental Agency" acting by and through its Commissioners' Court and by virtue of the authority shown on Exhibit A attached hereto and made a part hereof. W I T N E S S E T H WHEREAS, the Governmental Agency is owner of a bridge located on a public road or street within its jurisdiction at Carter Creek Relief Bridge on County Road 184 ; and i WHEREAS, under Title 23, United States Code as amended by the Surface Transportation Assistance Act of 1978 and subsequent Federal legislation, a program entitled 1985-86 Off-State System Federal-Aid Bridge Replacement and Rehabilitation Program has been approved by the State Highway and Public Transportation Commission and said bridge is included in this program; and 1 WHEREAS, it is incumbent upon the Department to assure accomplishment of this work. y A G R E E M E N T a ' NOW, THEREFORE, in consideration of the premises and of mutual cove- nants and agreements of the parties hereto to be by them respectively kept and performed, as hereinafter set forth, it is agreed as follows: ~J t 1. The Governmental Agency hereby authorizes the Department or its r contracted consultant and Department's contractor to enter on the site of said bridge and adjacent right of way or relocation right of way to perform ' surveys, inspection, construction and other purposes necessary to replace or rehabilitate said bridge and approaches. 2. The Governmental Agency agrees to provide, at its expense, the necessary adjustment of any and all utilities and services, whether F' publicly or privately owned, as may be necessary to permit the work authorized herein. The Governmental Agency agrees to provide 20% of the actual construction cost of the bridge replacement or rehabilitation project including preliminary engineering and construction engineering, or that portion of the cost of the project not reimbursable by the Federal Highway Administration. The Governmental Agency further agrees to acquire, at no cost to the Department, any additional right of way, if required. Within 30 days following execution of this agreement the Governmental Agency agrees to pay to the Department by check made payable to the State Department of Highways and Public Transportation an amount equal to 10% of the estimated cost of the project. Forty-five days prior to the Department's scheduled date for the contract letting, the Governmental j Agency agrees to pay to the Department an amount equal to the remaining 10% of its obligation. If, at any time during plan development or construction of the project, it is found that the amount received is insufficient to pay the Governmental Agency's obligation, then the Department shall immediately notify the Governmental Agency which shall promptly transmit the required amount to the Department. After the project is completed, the actual cost will be determined by the Department, based on its standard accounting pro- cedures, and any excess funds paid by the Governmental Agency shall be returned to the Governmental Agency. 4. If, after execution of the agreement, the Governmental Agency elects to terminate the project, the Governmental Agency shall be re- sponsible for those eligible expenses incurred by the State which are attributable to the project. 5. The Department will prepare or provide for the construction plans, advertise for bids and let the construction contract, or otherwise provide for the construction and will supervise the construction or reconstruction as required by the plans. The cost of all services performed by the Department will be borne by others. It is mutually agreed that as the pro- ject is developed to the construction stage, both parties shall approve the plans by signature approval thereon, and a copy of such plans will be attached hereto, marked "Exhibit 811, and made a part hereof, 6. In the event the terms of this agreement are in conflict with the provisions of any other existing agreements and/or contracts between the Governmental Agency and the Department, this agreement shall take precedence over the other agreements and/or contracts. 7. Upon completion of the project, the Governmental Agency agrees to accept ownership and operate and maintain the facility authorized by this agreement for the benefit of the public without charge. 8. The Governmental Agency agrees to indemnify the Department against any and all claims for damages to adjoining, abutting or other property for which the Department is or may be liable arising out of, incident to or in any manner associated with or attributed to the project.
