COMMISSIONERS' COURT

JULY 12, 1985
i 4:00 P.M.
The Commissioners Court met in Special Session on Friday,
July 12, 1985, at 4:00 P.M. for the purpose of considering the
Order of the District Court to call a Special Election to be
held Saturday, August 10, 1985. The following members of the

Court present were:
R. J. Holmgreen, County Judge, presiding:
Bill J. Cooley, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Billy Beard, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4 - Absent
Frank Boriskie, County Clerk.
The following citizens and officials were in attendance:

The County Judge opened the meeting and announced that
notice had been received that the Court of Appeals for the
Fourteenth Supreme Judicial District of Texas at Houston, Texas,
had passed an Order ordering the Commissioners Court, The County
Clerk, and Tax Assessor Collector to immediately cease and desist
from doing any act in furtherance of the special election schedul-
ed for August,10, 1985, for the office of Sheriff of Brazos County,
including com mencing absentee balloting on July 22, 1985. He
i
stated that in view of the Order that the meeting need not be held.
{
A full copy of the Order is attached to and made a part of these
minutes.
Therelbeing no further business the meeting was adjourned.

TEMPORARY INJUNCTION ORDER
This is an original proceeding ancillary to appeal. f Ronnie Miller,
appellant, has petitioned this Court for temporary relief under TEX. REV. CIV.
STAT. ANN. art. 1823 to enjoin respondents, R. J. (Dick) HoIngreen, County
Judge of Brazos County, Texas; Bill Cooley, Brazos County Commissioner, Precinct
1; Walter Wilcox, Brazos County Commissioner, Precinct 2; Billy Beard, Brazos
County Commissioner, Precinct 3; Milton Turner, Brazos County Commissioner,
Precinct 4; Frank Boriskie, Brazos County Clerk; Gerald R. (Buddy) Winn, Tax
Assessor/ Coilector for Brazos County, to immediately cease and desist from
doing any act in furtherance of the special election scheduled for August 10,
1985, for the office of sheriff of Brazos County, Texas.
The August 10, 1985, election has been ordered pursuant to the judgment of
the Honorable Arthur Lesher, issued April 2, 1985. Appellant has perfected his
appeal of that j udguent to this Court. It appears from the papers filed with

this Court that appellant is entitled to such temporary relief. To preserve
and protect the jurisdiction of this (bunt, it is, accordingly, ORDERED that
respondents immediately cease and desist from doing any act in furtherance of

the special election scheduled for August 10, 1985, for the office of sheriff of
Brazos County, Texas, including commencing absentee balloting an July 22, 1985, C
pending final hearing and determination of this cause or until further order of
