Horn, Ju15- tice of the Peace, Precinct 2 and Ray Mack Truelove, Justice of the Peace, Precinct 5, had successfully completed a twenty hour course in the duties of the office of Justice of the Peace. Mr. LaVergne requested the use of the Annex ; i4 parking lot every Saturday, June through November to enable Texas growers to sell produce to the public. The Association will furnish all necessary equipment, utilities and liability ~ insurance and be responsible for cleanup. David Currie with the Texas Department of Agriculture sanctioned the program and L ' suggested there be a written contract between the Association and the County. On motion by Commissioner Beard, seconded by Commissioner Cooley the Court voted unanimously to authorize the use of the parking lot by the Association and to enter into contract with the Association. The Court proceeded to consider the following requests for installations in County rights-of-way as follows: 1. Ferquson Crossinq Pipeline Company proposed to install j a four inch (4") natural qas line across the right-of- way of Luza Lane in Precinct 4. r 2. Bexco Operating, Inc. proposed to install a natural gas ~ pipeline across the right-of-way of Britten Road in ' Precinct 4. ' On motion by Commissioner Wilcox, seconded by Commissioner Turner the Court voted unanimously to approve both applications and au- ^ ! thorized the installation of the pipelines. A copy of both per- I mits are attached to these minutes. The Court next considered amendments to the Subdivision Re- gulations that had previously been approved by the Court. The ; proposed amendment was to reduce the minimum right-of-way to a_ I seventy feet (701) to comply with state law. After considerable ! discussion, Commissioner Wilcox moved to set the minimum width i ' of right-of-way at seventy feet (701) and to reduce the minimum lot size to one acre to comply with the County Regulations for the installation of septic tanks in the county. The motion was seconded by Commissioner Turner with Commissioners Wilcox, Turner, s and the County Judge voting "Aye". Due to public interest the County Judge appoint- ' ed Commissioners Cooley and Wilcox to meet with a Committee selected I by local Developers and Engineers to discuss revisions of the Sub- division Regulations. Commissioner Beard moved to take the recommendation of the Engineer and to award r the bid to Southwest Bridge Construction Company. Aqua Sheen Latex Enamel 10.98 On recommendation of the Maintenance Supervisor and motion by Commissioner Beard, seconded by Commissioner Wilcox, the Court voted unanimously to take the bid of Bryan Paint & Glass Company for Pittsburgh SpeedHide in the amount of $10.80 per gallon. 4. Bid 209 - Heavy Duty Washer & Dryer for the County Jail. Washer 1. Pallerin Laundry Machine Company - Milnor 30020 $5,018.00 2. Commercial Equipment Company - Wascomat W-184 4,260.00 Dryer 1. Pallerin Laundry Machine Company - Huebsch 37CG $1,675.00 2. Commerical Equipment Company - Cook Pro Dry 1,550.00 The Sheriff, having discussed the bids with the Maintenance Super- visor recommended that the Washer be purchased from Pallerin Laundry Machine Company and the Dryer from Commercial Equipment Company. On motion by Commissioner Beard, seconded by Commissioner Cooley the Court voted unanimously to purchase the Waster from Pallerin Laundry Machine Company in the amount of $5,018.00 and the Dryer from Commercial Equipment Company in the amount of $1,550.00. The Court proceeded to consider the following Plats: 1. Final Plat of Timberwilde, Third Installment in Precinct 3. The County Engineer voiced concern as the roads are not completed and the construction bond has not been posted. He further voiced concern citing the width of the roads previous constructed in Timberwilde, Phase II and about the drainage of various lots of the subdivision, and recommended denial of the Plat until such time as the pro- blems could be resolved. After considerable discussion Commissioner Beard moved for the approval of the Plat sub- ject to Timberwilde Drive in the Second Installment being brought up to the County Standards, and the filing of the bond for the construction of the roads. Final Plat of Grapevine Subdivision' in Precinct 4. The County Engineer asked who would be responsible for the structure of the dam along lots 1 and 22. Also Sand ' Creek Drive, and inquired if the road would be construct- I I ed to the proper width. He further recommended denial i~ i of the platiluntil such time as his questions could be re- solved. After much discussion the Developer agreed to I11 i remove the dam and drain the lake and replace the dam I I with drainage pipes. Commissioner Cooley moved for the • ~ I I approval of?;the plat subject to the removal of the dam and replacing it with drainage pipes and filing of a construction bond for the roads. Commissioner Beard moved that the County enter into the Flood Insurance Program to enable resi- dents in the unincorporated areas of Brazos County to purchase flood i. insurance. The motion was seconded by Commissioner Cooley and carri i' II ed unanimously. The County Judge appointed Commissioner Beard to be 1j { ~ II the liaison between the Commissioners Court and the Flood Insurance i Program. 1 I~ The Court next considered Change of Status of the following i(. Type Installation 4" Polyethylene P. 0. Box 388 (Hwy 36 N.) --Road Name Luza Lane Lyons, TX 77863 Formal notice is hereby given that Ferguson Crossing Pipe Line Co., Applicant, proposes to place a natural gas pipeline within the right-of-way ---of Sims Lane in Brazos County, Texas as follows: The location or description of the proposed installation is more fully shown by three copies of the drawings attached to this notice. Ferguson Crossing Pipe Line Co., Applicant, understand and agree that: It I 1. The County Engineer must be notified prior to the beginning of construction in order that they might be on hand to designate the actual location of the installation. 2. That all damage to the roadways and rights-of-way will be repaired to their original condition to the satisfaction of the County Engineer. 3. That BRAZOS COUNTY reserves the right to require Applicant to relocate or lower any such line at no cost to BRAZOS COUNTY, should same become necessary due to widening or lowering, or other alteration of the roadway or right-of-way. 4. That BRAZOS COUNTY is in no way responsible for any damage that might occur to any existing utility lines in the right-of-way. 5. That the line will be constructed and maintained on the county right-of way in accordance with governing laws. 6. That the line or lines will be constructed no less than forty-eight inches (48") lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (2') below the center of the roadway. l i f f - r l 7. That all roads be bored to forty feet (40') on either side of the centerline of the right-of-way or cased for such distance. 8. That all sites will be barracaded during construction period. 9. That the normal charge is $500 per crossing and/or $40 per rod when paralleling the roadway established by the Commissioners' Court on ..,-January 28, 1985. Colorado 81657 Precinct No.: 4 Formal notice is hereby given that (Applicant) Bexco Operating, T_nc. proposes to place a (type) Precinct Crossing; - Natural .ac Line pipeline within the right-of-way of (Road) Britten Road in Brazos County, Texas as follows: The location or description of the proposed installation is more fully shown by three copies of the drawings attached to this notice. (Applicant) Bexco Operating, Inc. , understand and agree that: 1. The County Engineer must be notified prior to the beginning of construction in order that they might be on hand to designate the actual, location of the installation. 2. That all damage to the roadways and rights-of-way will be repaired to their original condition to the, satisfaction of the County Engineer. 3. That BRAZOS COUNTY reserves the right to require Applicant to relocate or lower any such line at no cost to BRA%OS COUNTY, should same become necessary due to widening or lowertnn„ or other alteration of the roadway or right-of-way. 4. That BRAZOS COUNTY is in no way responsible for any damage that might occur to any existing; utility lines in the right-of-way. 5. That the line will be constructed and maintained on the county right- of way in accordance with governing laws. 6. That the line or lines will be constructed no less than forty-eight inches (48") lower than the lowest part of the drainage or bar ditch anti the drainage is to be considered at least two feet (2') below the center of the roadway. 7. That all roads be bored to,forty feet (40') on either side of the centerline of the right-of-way or cased for atich distance. 8. That all sites will be harracaded during; construction period. 9. That the irmal charge is $500 per crossing and/or $40 per rod when paralleling the roadway established by Lhe Commissioners' Court on January 28, 1985.
