APRIL 8, 1985
A regular meeting of the Commissioners' Court of Brazos
County, Texas, was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginninq at 10 00
A M on Monday, April 8, 1985, with the following members of
the Court present

The Court first considered for approval the minutes of the
Commissioner Court meetings held March 11, 1985 and March 25, 1985.
On motion by Commissioner Wilcox, seconded by Commissioner Beard,
the Court voted unanimously to approve the minutes as submitted.
The County Judge laid before the Court a certified copy of a

L Court Order of the 85th. District Court in Cause No 26,163 styled
Howard Hill vs Ronnie Miller. Such Court Order declared that the
General Election on November 6, 1984, for the office of Sheriff of
Brazos County is declared void. The Court Order further ordered
that the officials of Brazos County, charged by law with calling
and holding elections for the office of Sheriff, call and hold an-
other election for the office of Sheriff on the earliest date pro-
vided by law The County Judge advised the Court that, according
to Art 2.Olb subparagraph (a) of the Election Code, the second Sat-
urday in August, or August 10th., was the earliest date that the
election could be held. On motion by Commissioner Turner, seconded
by Commissioner Beard the Court voted unanimously that the date for
the Special Election for the Office of Sheriff of Brazos County be
set on Saturday, August 10, 1985.
The Court next considered award of the following bids for the
Road and Bridge Department and authorize the payment thereof

low bid of H&M Wholesale The motion was seconded by Commissioner
Turner and carried unanimously

At the request of the County Engineer and on motion by Commissioner
Cooley, seconded by Commissioner Beard the Court voted unanimously
to delay award of this bid until the next meeting to allow the
Engineer more time to review the bids

After the review of both bids, No. 205 and 206 Commissioner Cooley
moved to accept the bids of Farm & Ranch and to award the contract

for bridge decking and bridge piling to them. The motion was
seconded by Commissioner Beard and passed unanimously.
The Court proceeded to consider the final plat of Oak Lake
Estates and a resubdivision of a portion of Quail Run Estates in
Precinct 1. Notation was made that the preliminary plat was
approved prior to adoption of the new regulations on March 22, 1985,
and that this plat does not conform to the new regulations. After
considerable discussion Commissioner Beard moved to approve the
plat as submitted subject to the acquisition of the signature of
all of the property owners in the Quail Run Subdivision or the ex-
clusion of the resubdivision of the two lots in Quail Run The
motion was seconded by Commissioner Turner and carried unanimously.
On motion by Commissioner Turner, seconded by Commissioner
Beard, the Court voted unanimously to pay the statement of Utley
James of Texas in the amount of $28,142.42 for modifications and
additions to the Courthouse.

The Court having received the results of a Salary Study con-
ducted by Ray & Associates of Austin proceeded to consider the
'
adoption of the recommendations as well as a request and recommenda-
tions for the reorganization of the professional staff in the Dis-
trict Attorney's Office. Commissioner Cooley moved for the approv-
al of the new pay schedule, the reclassification of the employees,

recommended hiring procedures and recommendations of the District
Attorney. The hiring procedures and pay schedule to become effec-
tive immediately, and the reclassification to become effective with

the first pay period in June. The motion was seconded by Commissio-
ner Beard with Commissioner Cooley, Commissioner Beard and the County

Judge voting "Aye". Commissioner Turner voted "No". Commissioner
i
Wilcox abstained. Copies of the new salary schedule, reclassifica-
1 tion by Department, hiring procedures and reorganization of the
District Attorney's Office are attached.

BE IT REMEMBERED, on the 11th day of March, 1985, the
above styled and above cause came on to be heard. The Plantiff -
Contestant, HOWARD HILL, was present in person and by Counsel.
The Defendant - Contestee, RONNIE MILLER, was present in person
and by counsel. All parties announced ready for trial.
The Court, having read the pleadings and having heard
and considered all of the evidence and argument of Counsel, and
after the Contestant and the Contestee had rested, finds that
this proceeding is an election contest as provided for in
Chapter Nine of the Texas Election Code and, in particular, the
contest for the office of Sheriff of Brazos County, Texas, held
in the General Election on November 6, 1984 in Brazos County,
Texas. The Court has jurisdiction of this cause and of the
parties The Court further finds that illegal votes were cast
in the November 6, 1984 General Election in Brazos County,
Texas, and that the number of such illegal votes is sufficient it
to change the outcome of the said election for the Office of
Sheriff of Brazos County Texas.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that
the General Election on November 6, 1984 for the office of

Sheriff of Brazos County is declared void. IT IS FURTHER
ORDERED that the officials of Brazos County, Texas, charged by
law with calling and holding elections for the Office of Sheriff
of said County, call and hold another election for the Office
of Sheriff of Brazos County, Texas, on the earliest date provided
by the laws of the State of Texas, and that forthwith a certified
copy of this judgment be delivered by the District Clerk of
Brazos County, Texas, to the county Judge of Brazos County,
Texas, and to each of the four (4) Commissioners of said County

and additionally, the said District Clerk shall deliver a
certified copy of this judgment to the County Clerk and the
County Tax Assessor-Collector of Brazos County, Texas.
All relief not expressly granted herein is denied.

These procedures for classification and pay administration
apply to all employees of Brazos County. They are adopted in
order to provide an orderly and fair system of compensating
employees for their services and to provide a merit basis for
personnel decisions.

For the purposes of classification and pay administration,
definitions are as follows:
A position is an organizational slot (or job) consisting of a
-
duties or responsibilities requiring the full-time or
group of
part-time employment of one person.
A class is a group of positions having similar duties and
responsibilities and which can be described by one Job title
(e.g., secretary).

A job description (sometimes called class description) is a
written description of the duties, responsibilities, reporting
relationships, and requirements for one class of positions.
A classification plan is an organized inventory of classes of
`
positions arranged in groupings under broad types of govern-
mental activity and by level of difficulty of each class. It
includes (1) the grouped listing of jobs by title, and (2) the
procedures for administering the plan.
A reclassification of a position is a reassignment of a posi-
tion to a lower, higher, or different class based on an evalua-
tion of the current duties and responsibilities of the posi-
tion. Such changes are made necessary by reorganization of
departments, assignment of new duties to certain classes of
employees, or changes of work procedures or technology.
A pay plan is a document that assigns dollar values to each job
class, groups classes into pay groups, arrays pay groups on a
pay schedule showing salary ranges for each group, and sets
forth procedures for administering the pay schedule.

TYPES OF POSITIONS
Classified Position. A classified position is an authorized
e,
and budgeted position which is assigned to a job class and to a
i>
pay group of the Brazos County Pay Plan. A Classified position
i
can be full time, part time, or temporary.
Exempt Position. An exempt position is an authorized and
Su gete position for which the pay is set by'-individual
determination. Exempt, positions of Brazos County are (1)
elected county officials; (2) positions funded partially from
non-county funds; and (3) those hourly, part-time, or seasonal
;
positions which, in the judgment of the Commissioners Court,

should not be placed in a regular classified position.

CLASSIFICATION
Hiring. New employees are hired into budgeted, classified
AND PAY
positions unless specifically exempted. New employees normally
ADMINISTRATION
are hired at the entry pay of the pay group to which their
position is assigned.

Officials and department heads may hire a i9ew employee above
the entry pay (Step 1) of the position's pay group under the

(1) The prospective employee's unusually high qualifica-
tions or significant` experience clearly warrant
higher pay; and
(2) Funds are certified as available in the official's or
department's personnel budget to finance the higher
pay rate for the remainder of the fiscal 'year.
Probations Hiring in a Lower Pa Group. A new employee, or
existing employee being considered or promotion, whose quali-
fications or experience for the position sought are marginal,
may be placed in a lower pay group for a temporary period of
time. An employee hired in a lower pay group will be advanced
to the proper pay group after a period of probationary employ-
ment not to exceed six months. The county elected official or
department head responsible for hiring is authorized to extend
the probationary period beyond the initial six months but not
to exceed an additional 90 days.
Merit Increases. After six months of employment, an employee
is eligible for merit increases in pay based upon performance.
A merit increase is an advancement within the pay range of the
same pay group and is granted to recognize exceptionally good
performance in the same position. A merit increase cannot
increase an employee's salary beyond the maximum for the pay
group of the position. Merit increases are granted by an

employee's supervising official or department head. Merit in-

creases are not used to recognize increased duties and respon-
sibilities (a promotion) and should be granted without regard
to cost-of-living factors. Merit increases recognize outstand-
ing performance and thus should be granted in conjunction with
a performance evaluation of the employee.
Elected officials and department heads must obtain certifica-
tion that funds are available in their personnel budget for a
-
merit increase prior to granting an increase.
Promotion. A promotion is a change in the duty assignment of
an employee from a position in one classification to a higher
position in another classification in a higher pay group. A
promotion recognizes advancement to a higher position requiring
higher qualifications and involving greater responsibility.
Promotions are granted by the employee's supervising official
or department head, provided that the higher position is
authorized in the budget and funds for the position are certi-
fied as available.

Demotion. A demotion is a change in duty assignment of an
employee from a position in one classification to a position in
another classification in a lower pay group. Demotions are
made by the employee's supervising official or department head.
Pay Reductions for Disciplinary Reasons. As a disciplinary
measure, a supervising official or department head may reduce
an employee's pay for continued performance in the same posi-
tion to a lower amount in the pay group for the position or in
the next lower pay group. Restoration of the employee to his
or her prior rate is upon the decision of the supervising
official or department head.
Reclassification of Positions. A reclassification is a reas-
signment of a position (not an employee) to a lower, higher, or
different class based on current duties and responsibilities of
the position. Reclassifications are approved and implemented
;
only by the Commissioners Court.

Reallocation of Classes to Pay Groups. Reallocation is the
reassignment of an entire class of positions to a new pay

group. Reallocation can be to either a lower or a higher pay
group. Reallocations are approved and implemented only by the
.Commissioners Court.
Cost-of-Living Adjustments. Cost-of-living adjustments 'are
achieve by multiplying the entire pay schedule by a constant
percentage to increase the minimum and maximum of each pay

group. Individual employees' pay can then be multiplied by the

groups to give cost-of-living adjustments as this will'make the
pay schedule obsolete. Cost-of-living adjustments are approved
and implemented only by the Commissioners Court.
At least annually, the Executive Assistant will review the
classification and pay plans and recommend changes to the
County Judge for consideration in budget preparation.
This review and, where appropriate, recommendations will
include:
r
• Positions to be exempt;
• Reclassification of position(s) to a lower, higher, or
different class based on changes in the duties and respon-
sibilities of the position(s); •
• Reallocation of classes to new pay groups if changes in
the prevailing rates of pay for certain pay classes have
rendered the original placement in a pay group obsolete;
• Percentage changes in the entire pay schedule to adjust
pay rates to be more comparable with other organizations
in the labor market or to recognize changes in the cost-
of-living; and
• The continuing validity of the foregoing procedures for
pay administration.

PAY GROUP. The group in the County Pay Schedule to which this position is

ORGANIZATIONAL RELATIONSHIPS. Clearly defines to whom a person in this

GENERAL STATEMENT OF DUTIES. A brief general statement of the duties involved

CERTIFICATES AND LICENSES REQUIRED. Lists any specific certificates or
licenses which are required to be held by an applicant to be considered for
the particular job. If the job requires frequent travel, a valid Texas
driver's license or available alternate means of transportation would be
necessary. If the position involves handling public funds, the candidate must
be bondable. Certain other positions require special certificates by state or

1. Officials and Administrators. Occupations in which employees set broad

policies, exercise overall responsibility for execution of these poli-
cies, or direct individual departments or special phases of the agency's
operations, or provide specialized consultation on a regional, district,
or area basis. Includes: department heads, bureau chiefs, division
chiefs, directors, deputy directors, controllers, examiners, wardens,
superintendents, sheriffs, police and fire chiefs and inspectors, and
kindred workers.
2. Professionals. Occupations which require specialized and theoretical
knowledge which is usually acquired through college training or through
work experience and other training which provides comparable knowledge.
Includes: personnel and labor relations workers, social workers, doc-
tors, psychologists, registered nurses, economists, dieticians, lawyers,
systems analysts, accountants, engineers, employment and vocational
rehabilitation counselors, teachers or instructors, police and fire
captains and lieutenants, and kindred workers. °
3. Technicians. Occupations which require a combination of basic scientific
or technical knowledge and manual skill which can be obtained through
specialized post-secondary school education or through equivalent on-the-
job training. Includes: computer programmers and operators, drafters,
- surveyors, licensed practical nurses, photographers, radio operators,
technical illustrators, highway technicians, technicians (medical,
dental, electronic, physical sciences), assessors, inspectors, police and
fire sergeants, and kindred workers.
4. Protective Service Workers. Occupations in which workers are entrusted
with public safety, security, and protection from destructive forces.
Includes: police patrol officers, firefighters, guards, deputy sheriffs,
bailiffs, correctional officers, detectives, marshals, harbor patrol
officers, and kindred workers.
S. Paraprofessionals. Occupations in which workers perform some of the
uties of a professional or technician in a supportive role, which
usually require less formal training and/or experience normally required
for professional or technical status. Such positions may fall within an
identified pattern of staff development and promotion under a "Hew
Careers" concept. Includes: library assistants, research assistants,
medical aids, child support workers, police auxiliary, welfare service
aids, recreation assistants, homemakers' aides, home health aides, and
kindred workers.
6. Office and Clerical. Occupations in which workers are responsible for
internal and external communication, recording and retrieval of data
and/or information and other paperwork required in an office. Includes:
bookkeepers, messengers, office machine operators, clerk typists, stenog-
raphers, court transcribers, hearing reporters, statistical clerks,
dispatchers, license distributors, payroll clerks, and kindred workers.

Please find attached a flow chart of my department. "Applying
my department's internal structure to your recommended pay steps
may I make the following recommendations:
(a) Three*(3) entry level attorneys be classified as
Assistant District Attorneys I and hired at steps
15-1, 15-2 or 15-3, depending on their skills.
(b) The three (3) department chiefs be classified as
District Attorneys II and be paid the range of Group 16.
(c) The first assistant be classified as District Attorney
III and be paid from the range of Group 17.
