A special meeting of the Cc"nmissioners' Court of Brazos
County, Texas, was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
A.M. on Monday, March 25, 1985, with the following members of
the Court present:
R. J. Holmgreen, County Judge, presiding:
Bill J. Cooley, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Billy E. Beard, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.
The following citizens and officials were in attendance:

The first matter to come before the Court were amendments
to the 1985 Budget as follows:
1. County Attorney
2. Sesquicentennial
On motion by Commissioner Wilcox, seconded by Commissioner Turner,
the Court voted unanimously to approve the amendments as submitted.
A copy of the amendments is attached.
The Court proceeded to consider the following bids:
1. Bid No. 201 - 1,200 tons of oversized rock for the
Road and Bridge Department.
a. Young Brothers - $5.00 per ton loaded only
7.50 per ton loaded/hauled
b. Delta Material Corp. - $5.00 per ton loaded only
17.94 per ton loaded/hauled
On motion by Commissioner Beard, seconded by Commissioner Wilcox,
the Court voted unanimously to award the annual contract to Young
Brothers and authorized the payment thereof.

2. Bid No. 199 - Replace Metal Covering on building for
the Maintenance Department.
a. R. H. Owen - $8,450.00
b. Gassiot Construction - $6,905.00
C. JHW General Contractor - $7,875.00
On the recommendation of Mr. Dobbin, and motion by Commissioner
Wilcox, seconded by Commissioner Beard, the Court voted unani-
mously to award the contract to Gassiot Construction Company in
the amount of $6,905.00 and the payment thereof.
The Court next considered a request from Ferguson Crossing
Pipeline Company to install a natural gas pipeline across the
right-of-way of Sims Lane in Precinct 4. On motion by Commissioner
Turner, seconded by Commissioner Beard, the Court voted unani-
mously to grant the request and authorized the installation of
the pipeline. A copy of the request is attached hereto.

to approve the changes.

The County Judge laid before the Court a Resolution regarding
the taxing of normally tax exempt entities who mine or might mine
lignite. After discussion Commissioner Beard moved that the Court
adopt such Resolution and to submit it to the State Legislature.
The motion was seconded by Commissioner Wilcox and carried unani-
mously. A full copy of the Resolution is attached.

The Court next considered a Resolution regarding the collec-
tion of fees by the County and District Clerks to be submitted
to the State Comptroller. On motion by Commissioner Beard, se-
conded by Commissioner Turner, the Court voted unanimously to
adopt the Resolution and submit it to the State Legislature. A
full copy of the Resolution is attached hereto.

The following proceedings were held:
THAT WHEREAS, on March 25, 1985 the Court heard and
approved a budget amen ment or the 1985---Fudget year for Brazos
County, Texas.
WHEREAS, an emergency expenditure is necessary, due to grave public
necessity to meet unusual and unforseen conditions which could not
be reasonably included in the original budget adopted December 10`1284
ereby authorizzed•

NOTICE OF PROPOSED INSTALLATION IN COUNTY RIGHT-OF-WAY
TO THE COMMISSIONERS' COURT OF BRAZOS COUNTY, TEXAS

Ferguson Crossing Pipe Line Co. Type Installation 4" Polyethylene
P. 0. Box 388 (Hwy 36 N.) Road Name Sims Lane

Formal notice is hereby given that Ferguson Crossing Pipe Line Co.,
Applicant, proposes to place a natural gas pipeline within the right-of-way
of Sims Lane in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown
by three copies of the drawings attached to this notice.
Ferguson Crossing Pipe Line Co., Applicant, understand and agree that:
4. That BRAZOS COUNTY is in no way responsible for any damage that
might occur to any existing utility lines in the right-of-way.
3. That BRAZOS COUNTY reserves the right to require Applicant to
relocate or lower any such line at no cost to BRAZOS COUNTY, should same
become necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.

5. That the line will be constructed and maintained on the county
right-of way in accordance with governing laws.
1. The County Engineer must be notified prior to the beginning of
construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County Engineer.
6. That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage is to be considered at least two feet (2') below the center
of the roadway.
7. That all roads be bored to forty feet (40') on either side,of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barracaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners- Court on
January 28, 1985.
Construction of this line will begin on or after February 5, 1985.

WHEN MINED BY PRIVATE ENTERPRISE;
WHEREAS, AUTHORITIES AND GOVERNMENTS ARE UNDERTAK-
ING AN EXPANSIVE LIGNITE MINING PROGRAM;
WHEREAS, OUR COUNTY WILL SUFFER DEMANDS OF GREATER
SERVICES WITHOUT TAX COMPENSATION IF LIGNITE IS MINED IN OUR

WHEREAS, it has come to the attention of the Brazos. County
Commissioners' Court that possible legislation is being considered
which could require couities to collect additional funds to be sent
to the State of Texas, and
WHEREAS, we the Commissioners' County of Brazos County
meeting in a Regular session this 25dtky of March , 1985, do here-
by object to any legislation which would require Brazos County
offices to collect any additional fees or monies to be sent directly
to the State of Texas, wereby adding additional duties and responsibili-
ties to county offices and extra tax burdens to local citizens for the
purpose of obkaining state funding
BE IT THREFORE RESOLVED that the Texas Legislature be urged not
to consider any legislation which would bring about the collection of
any fees by any minty office to be sent directly to the State of
Texas.
