Other Business ~ V4L (Z -AGE t r 1 a , f A 1 t COMMISSIONERS' COURT SPECIAL MEETING JANUARY 28, 1985 A special meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Brvan, Brazos County, Texas, beginning at 10:00 A.M. on Monday, January 28, 1985, with the following members of the Court present: R. J. Holmgreen, County Judge, presiding: ' Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The following citizens and officials were in attendance: Carol Snedeker Sandy Lange Billy Eubanks John Wallace Maria Sandberg Terra Hooten Sharon Fairchild J. M. Beamer Ron Miller Buddy Winn Winfred E. Pittman Louis Garcia, Jr. Henry Wedel Edwin Dobbins Ruth McLeod County Judge's Secretary Treasurer's Office County Engineer GTE Auditor's Office KBTX Auditor Sheriff's Department Sheriff Tax Assessor Collector Constable, Precinct 7 Constable, Precinct 4 Building and Yards Building and Yards Admin.Asst.Commissioners Court John Wallace, representing GTE gave a 30 minute presentation on the expansion of the local telephone operations, and the pro- posed new exchanges for the area. On motion by Commissioner Cooley, seconded by Commissioner ,i Beard, the Court voted unanimously to approve the Official Bonds of Billy Beard, Commissioner of Precinct 3 and Jim Kuboviak, Coun- ty Attorney, and ordered that they be recorded in the official Re- cords of the County Clerk's Office. The court proceeded to consider the following requests to utilize county rights-of-way for installation of pipelines: 1. Ferguson Crossing proposed to install a natural gas pipeline within the right-of-way of Sims Lane in VOLrZPAGE3W r I ~ I Precinct 4. On motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to it approve the request and authorized the installation. 2. Producer's Gas Company proposed to install a 4~" gas i pipeline within the right-of-way of Blue Ridge Drive I1 in Precinct 1. Commissioner Cooley moved to approve the request and authorized the installation with the II understanding that the pipeline is within a 100 foot right-of-way and the chances of having to move the pipe- line is greater than normal. The motion was seconded + by Commissioner Beard and carried unanimously. A copy of both permits are attached hereto. t On motion by Commissioner Cooley, seconded by Commissioner i Turner, the Court voted unanimously to charge a minimum of $35.00 i per rod for the installation of pipeline within county rights-of- way. The County Judge next announced that he waived his right to approve the Purchase Orders for the Road 6 Bridge Department and that Commissioners Wilcox and Turner would sign them on his be- half. The Court next considered amendments to the 1985 Budget for the Road and Bridge Department and the Sheriff's Department. On motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to approve the amendments as submitted. A i copy of the amendments are attached. On motion by Commissioner Wilcox, seconded by Commissioner Turner, the Court voted unanimously to pay the annual dues to the County Judges and Commissioners Association of Texas in the amount of $125.00. The Court next considered a request from the Brazos County Historical Commission to have the old Highway 21 Bridge Plaque on permanent display in the Bryan Public Library. After discussion i~ Commissioner Beard moved to allow the plaque to be displayed at i ~I the Bryan Public Library. The motion was seconded by Commissioner Turner, with Commissioners Beard, Turner and Wilcox voting "Aye." I ~ Commissioner Cooley voted "No", whereupon the County Judge an- nounced the motion carried and that the plaque would be displayed at the Library. ~ ♦ 1 i r i I The Court next discussed changes requested by the County Engineer on the following forms used in the operation of the Road and Bridge Department: 1. Certain changes in the Oil Damage Assistance Agreement. 2. Certain changes in the Permit to Construct Access Drive Facilities on County Right-of-Way. After discussion Commissioner Wilcox moved to authorize the changes as submitted. The motion was seconded by Commissioner ` Turner and carried unanimously. A copy of both forms are attached. The Court proceeded to consider the following bids: 1. Bid No. 182 - Annual contract for jumpsuits for the Sheriff's Department. On the recommendation of the Sheriff, the Court rejected all bids and authorized the Auditor's Office to rebid the items. 2. Bid No. 183 - Jail Commodities Robinson Bob Barker Texas Dept.of Walter F. Stephens, Jr. Inc. for cups; and that the shower cur- tains not be purchased. On motion by Commissioner Turner, se- conded by Commissioner Beard, the Court voted unanimously to I i follow the Sheriff's recommendation and award the bid for the 1 i purchase of commodities as recommended. L 3. Bid No. 184 - Heavy Duty Washer and Dryer for the fail. These items to be rebid. 4. Bid No. 185 - Eighteen 19 inch color televisions for the Sheriff's Department. On motion by Commissioner Cooley, seconded by Commissioner Beard, the bids were rejected and ordered that the items be rebid as non- cable ready televisions. pro YAGE 3&~ i I - s 0 Under Other Business the Court discussed various depart- ments and the liaisons with the Commissioners Court. It was the consensus of the Court that Commissioner Cooley be the liai- son between the Personnel Department and Recreation Facilities; Commissioner Beard be the liaison between the Maintenance Depart- ment and the Commissioners Court; and that Commissioners Wilcox and Turner be the liaison between the Road and Bridge Department and the Commissioners Court. Commissioner Cooley moved that these responsibilities be approved and rotated annually. The motion was seconded by Commissioner Beard and carried unanimously. The County Judge laid before the Court a letter from the Texas Justice Court Training Center advising that Antone Dobrovolny Justice of Peace, Precinct 5 had successfully completed a forty hour course in the duties of the office of Justice of the Peace and ordered that it be entered into the minutes of this Court meeting. The Court next discussed the County property on South College Avenue. The County Judge suggested that it be leased to the MHMR and allow them to construct a building that would revert to the County after a period of time. No action was taken. The Court next discussed the number of county road miles maintained by Brazos County and agreed that 454, as presently be- ing used by the Tax Assessor Collector to compute registration fees was a current figure and that no change was necessary. The Court next discussed that the County should start search- ing for a location to construct a minimum security jail. Also dis- cussed was a contract with the two cities for handling city priso- S ! ners when confined in the county jail. The Sheriff was authorized i to begin work on such a contract. The County Judge next presented an Animal Control Ordinance for Brazos County. After discussion, Commissioner Beard moved that the Ordinance be adopted. Commissioner Cooley seconded the motion which carried unanimously. The Commissioner of the Precinct in which the right-of-way lies must be notified prior to the beginning of construction in order that the Commissioner might be on hand to designate the actual location of the installation. 2. Maintenance of facility constructed hereunder shall be the responsibility of the grantee, and the County of Brazos reserves the right to require any changes, maintenance or repairs as may be necessary to provide protection of life of property on or adjacent to the roadway. Changes in design will be made only with approval of the County Engi veer of Brazos County, Texas. The Grantee shall hold harmless the County of Brazos and its duly appointed agents and employees against any action for personal injury or property damage sustained by reason of the exercise of this permit. 5. The grantee shall not erect any sign on or extending over any portion of the County road right-of-way, and vehicle fixtures such as pumps, vendor stands, tanks or water hydrants shall be located at least twelve (12) feet from the right-of-way line to insure that any vehicles serviced from these fixtures will be off the roadway. 6. The top of all culverts will be installed at least six (6) inches below the shoulder of the roadway or eight to ten (8 - 10) inches below the crown line of the roadway. The County of Brazos will assist as follows: This permit shall not be valid until grantee signs the statement in which he agrees to comply with the conditions herein. The County Engineer should be contacted at least twenty-four (24) hours before beginning the work author- ized by this permit.
