J. Holmgreen, County Judge, absent. Walter Wilcox, Commissioner of Precinct 2, presiding: Bill J. Cooley, Commissioner of Precinct 1; Billy E. Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. T. Sistrunk, County Extension Agent; Mike McKinney, County Extension Agent; Dale A. Fritz, County Extension Agent; Mable Walker, County Extension Agent; Kathleen McDonald, County Extension Agent. The Court received, considered and approved reports from County and Precinct Officers showing revenue collected and re- mitted to the County Treasurer. A copy of the reports are attached hereto. 6IMPA 3.53 The first matter to come before the Court was the appoint- ment of the Brazos County Historical Commission. On motion by Commissioner Turner, seconded by Commissioner Cooley, the Court voted unanimously to appoint the following persons to serve as the Brazos County Historical Commission for a two year term ena- ing December 31, 1986: James L. Boone, Jr. Chairman Billy E. Beard J. Russell Bradley 'John Carroll Frances Henry Walter Carl Jones The Committee Jane Mrs. Lynn On motion Eleanor Hanover Nance J. Milton Nance Hazel Richardson Paul VanRiper Madge Wallace Mary Bess Young :ourt proceeded to the selection of a Salary Grievance for 1985 as follows: Ferguson Kenneth L. Hayes, Alternate Alton Hensarling Ed Bush, Alternate Copeland by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to appoint the foregoing names as the Salary Grievance Committee for 1985. Such names were randomly drawn from the list of Grand Jurors for 1984, as submitted by the District Clerk. The Court next acknowledged receipt of the Certification of Juvenile Facilities by the Brazos County Juvenile Board. Such certification to be attached to and made a part of these minutes. On motion by Commissioner Turner, seconded by Commissioner Beard, the Court voted to set the following dates as the Official Holidays to be observed by Brazos County for 1985: MEMORIAL DAY - Monday, May 27, 1985 INDEPENDENCE DAY - Thursday, July 4, 1985 LABOR DAY - Monday, September 2, 1985 THANKSGIVING - Thursday, Nov.28, 1985 & Friday, Nov.29, 1985 CHRISTMAS - Tuesday, Dec.24, 1985 & Wednesday,Dec.25,1985 NEW YEARS - Wednesday, January 1, 1986 On motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to pay the statement of Utley James of Texas, Inc. for modifications and additions to the Courthouse. j i� • j The Court next considered a request from Merl Smith, Con- stable of Precinct 3, to increase the number of Reserve Deputy 1 t Constables for Precinct 3 to five. On motion by Commissioner Cooley, seconded by Commissioner Wilcox, the Court voted unani- mously to grant the request and increased the number of Reserve j Deputy Constables for Precinct 3 to five. A copy of the adopted Resolution is attached to and made a part of these minutes. The Court next discussed the vacating and resubdivision of lots 35, 36 and 37 of the Nantuckett Subdivision in Precinct 1. i On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court voted unanimously to approve the resubdivzsion and grant a variance of the Subdivision Regulations that pertains to signatures of all property owners of the subdivision. l� an f 1 � y i 1 '1 1 F i X44 1 The Court proceeded to discuss the following Plats: 1. Final Plat and roads in Fawn Lake Estates Subdivision in Precinct 2. After review of the plat and on motion by Commissioner Wilcox, seconded by Commissioner Beard, the Court voted unanimously to approve the plat as submitted. 2. Preliminary Plat of Quail Run Estates in Precinct 1 and the extra territorial 3urisdicti.on of the City of Col- lege Station. After reviewing the plat, Commissioner Beard moved to reject the plat as submitted. He fur- ther moved to require a 70 foot dedicated right -of -way to comply with the requirements of the City of College Station for a 32 foot driving service. The motion was seconded by Commissioner Cooley and carried unanimously. 3. Preliminary Plat of Oak Lake Estates in Precinct 1 and the extra territorial jurisdiction of the City of Col- lege Station. The Engineer indicated he had a verbal variance from the City of College Station regarding the width of the road. After review Commissioner Beard moved to approve the plat conditioned on the following: a. Submission of the variance from the City of College Station on the width of the roads. b. Addition of the location of the retainage lakes and water level of lake on final plat. c. Addition of drainage easements. d. Addition of utility easement on Walnut Road. The motion was seconded by Commissioner Cooley and carried unanimously. No child shall be detained within this facility for more than forty -eight (48) hours. Any child requiring detention for any longer period of time must be transported to and placed with a certified facility outside of Brazos County. 2. Children in detention shall not be detained in a compartment of the Brazos County Jail in which adults are detained. 3. Children in detention shall not be permitted contact with adults detained or committed to the Brazos County Jail. 4. An officer of the Brazos County Juvenile Probation Department will have personal contact with each and every child detained in the Brazos County Jail at least two (2) times daily, including holidays and weekends. i The certification of this facility remains in effect only until such time the newly constructed Brazos County Juvenile Detention Center has been inspected and certified, and is opened for the intake of children. A motion was presented by Commissioner —��l� - h mote- o duly seconded by Commissioner was voted on as follows: q .,Ayer p rNayr It is hereby resolved by the Court that the Constable of Precinct Brazos County, Texas, may appoint reserve deputy constables who shall serve as peace officers during the actual discharge of off- icial duties. The minimum training standard and minimum Physical, mental educational, and moral standards for all reserve deputy con- stables shall be the standards established for reserve law enforce- ment officers as provided by the Commission on Law Enforcement Officer Standards and Education. The Constable will certify to the Commission- ers Court that the appointee has achieveLl minimum standard -,. 'rhe Constable may appoint, Eub3ect to confirmation by the Conu►,issioners Court, not more than reserve deputy constables. No person appointed to the positioT n of reserve deputy constable may carry a weapon or otherwise act as a peace officer until confirmed by the Commissioners Court. After confirmation he may carry a weapon only when discharging official duties as a duly constituted peace officer. He serves at the discretion of the Constable and may be called into service at any time the Constable considers it necessary to leave additional officers to preserve the peace and enforce the law. Be- fore he enters upon the duties of his office, he must take and sub- scribe to the official oath, which shall be endorsed on his appoint- ment. The appointment, the oath, and the certificate of the officer administering the oath shall be recorded and deposited in the office of the County Clerk of Brazos County, Texas. Reserve deputy constables will wear an emblem or a badge at all times while on active duty. The emblem or badge will bear tine words "Deputy Constable ". The County of Brazos and the Constable shall not incur any liability by reason of appointment of any reserve deputy constable, sustaining any personal injury while serving in such capacity, however, Commissioners Court may provide hospital and medical assistance to a reserve deputy con- - stable who sustains in)ury in the course of performing official duties as a peace officer in the same manner as provided for a full time duputy constable. In no case shall any person serve as a reserve deputy constable after January 1, 1973, unless he has fulfilled the minimum physical, mental, educational, . noral and training standards established by the Texas Commission of Law Enforcement Officer Standards dnd Education. Reserve deputy constables, while on active duty shall be vested with the same rights, privileges, obligations and duties of any other peace officer of the State of Texas.
